the undersigned does hereby make the following declarations of conditions, limitations and
restrictions on said lands, hereinafter to be known and referred to as a Declaration of Unity of
Title, as to the following particulars:
1. That said property shall be considered as one plot and parcel of land and that no portion of
said plot and parcel of land shall be sold, transferred, devised, or assigned separately except
in its entirely as one plot or parcel of land.
2. The undersigned further agrees that this condition, restriction and limitation shall be
deemed a covenant running with the land, and shall remain in full force and effect, and be
binding upon the undersigned, their heirs and assigns until such time as the same may be
released in writing by St. Lucie Comity, Florida, or its successor, in accordance with the
applicable rules, codes or ordinances of said St. Lucie County, Florida.

Dear 23rd Street Enterprises, Llc,
Your Request for Architectural Change has been approved. Specifically, you have approval to proceed
with the following:
Landscaping removal/additions.
To incorporate lot 11, clearing of the east, roughly half of the property, lot 10. Sabal Creek Phase I. book
23 page 32 from the Saddlebrook Drive property line (east property Line) westward extending to the
eastern most 150' of the FPL Easement. This property has been granted unity of title to lot 11 to the south
& will be used for a larger driveway to landscape yard.
The board has approved your request with the following conditions: The board would like to see the
remainder of the project be presented to the board for its final consideration. They would like to see the
plat with the intended structure and its location on the map, show the areas to be cleared before final
construction approval or vegetation removal approval is granted. In addition, they would like the
homeowner to preserve as many native pines as possible.
We reserve the right to make a final inspection of the change to make sure it matches the request you
submitted for approval. Please follow the plan you submitted or submit an additional request form if you
cannot follow the original plan.
You must follow all local building codes and setback requirements when making this change. A building
permit may be needed. This can be applied for at the County and or City offices.
Our approval is only based on the aesthetics of your proposed change. This approval should not be taken
as any certification as to the construction worthiness or structural integrity of the change you propose. Be
aware that you are responsible for contacting the appropriate utility companies before digging.

Project Description: Applicant requests a vegetation removal for several slash pine trees measuring under
the mitigation threshold. The property has been issued a unity of title for 10 & lot 11. The original 4.56 acres
of property for the single family residence meets and exceeds the landscaping requirements. No clearing is
permitted from the FPL easement west.
Field Notes:

jurisdictional determination and all formal wetland delineations must be obtained from
appropriate state and/or federal agencies.
2. WILDLIFE: None observed.
3. SIGNIFICANT ARCHAEOLOGICAL OR HISTORIC FINDINGS: None Identified.
Permit #20210725 authorizes the following: According to St. Lucie County Land Development Regulations
(Chapter 6.00.04) this project qualifies for a Vegetation Removal Permit. The following vegetation has been
identified for removal:
1. Several slash pine trees measuring under the mitigation threshold
2. Native and non-native underbrush
Specific Permit Conditions: Areas outside of the development footprint shall be considered
preservation/protection areas (Land Development Code Section 6.00.05.A.2). A conspicuous protective
barrier shall be placed and maintained around the perimeter of protected area(s) of vegetation to form a
continuous boundary as specified in the General Conditions of Issuance section.
General Conditions of Issuance: The following minimum standards for vegetation protection shall be
appli€id to areas of vegetation designated to be preserved:
At a minimum distance of either ten (10) feet from the edge of groups of protected vegetation or
I rom the radius of the dripline from all protected trees, whichever is greater;
• Protective barriers or protective designations shall remain in place until removal is authorized by
SLC ERD, or until issuance of a certificate of occupancy;
• In the event that any protective barriers are removed or altered and clearing activities are
conducted within an area identified for preserve, SLC ERD is authorized to direct that all land
clearing and site alteration work at the site be stopped until the barriers are restored and any
necessary corrective actions taken to repair or replant any vegetation removed or damaged as a
result of these encroachments.
• The preserve areas and tree preservation areas shall be maintained in their natural state, so as not to
alter the water and oxygen content of the soil and impair its function;
• A National Pollutant Discharge Elimination (NPDES) Permit, separate from this permit, may be required
for construction activities disturbing 1 acre or more. Please visit
www.dep.state.fl.us/water/stormwater/npdes or contact Jose Vega, St. Lucie County Stormwater
Program Coordinator at 772-462-1668 for more information regarding these requirements.
• No grade changes or excavation of any sort may be made within the barricaded areas;
• If any excavation or other activities are expected outside of the preserve area or dripline, the roots should
first be pruned (to the depth of required excavation) to sever them cleanly;
• If underground utilities must be routed through a protected root zone area, tunneling under the roots shall
be required;
• If irrigation must be installed, it shall be installed outside of the dripline of all preserve areas and protected
trees;
Post Clearing Requirements:
1. Mitigation: Mitigation requirements are to be met through onsite preservation. During a site
visit on 7/15/2021, ERD staff noted that sufficient trees are identified for preservation, to meet
and exceed the mitigation requirement.
2. Landscaping: The landscape requirements of one native tree per 2,500 square feet of property, up
to a maximum of 17 trees, must be met. As this property is 9.09 acres (acres X 43,560 = square feet
of this property) 395,960 square feet, (square feet/2,500 = trees), 17 trees (measuring 2.5" diameter
at breast height (DBH) & 12' HT), or a total of 42.5 DBH of trees are required. Please note that
landscaping requirements are separate from, and in addition to, tree mitigation requirements.
