According to our records, the contractor has not called in the inspection for the fence as of this date. The permit is set to expire on 2/16/2018 if the inspection is not called. If the inspection is not called in, Code Enforcement will send out a notice of violation. In general, fences must be on or inside the property line. In this case, the fence must also be outside the easement. From the initial survey we have on file, the easement in question is 10 feet. Accordingly, the fence must be setback so that it is outside the 10 foot easement. Due to your concerns, we will require a final survey to ensure that the fence is outside the easement. I would like to start with a time line of events. On Dec. 18th i sent an email to code enforcement in regards to a fence that was put up at 61 Aqua Ra Drive on the main street side telling them that the fence was too close to the main street and needed to be checked for set backs and utility easement right of way based on the River Watch Plat. A couple emails later the correspondence is below which is the latest response with no further comment from code enforcement. On Jan.26th i talked to an inspector in our neighborhood about this situation and he told me that because the county is short handed they do not check for easements or setbacks when checking the permit and nothing will happen,but he went on to say that the HOA should get a survey of said property and if it is determined the fence should be moved to hire an attorney and sue the owner,are you kidding me i said,and the subject was ended. The problem gets worse last week we had a break in one of the pipes in our irrigation line and we had to climb over this neighbors fence to turn the main off,so in the future any break in that cul de sac we will have to trespass or climb over a fence to get to this main which should be available on the street side for any member in .our community as well as saint lucie county to have easy access. The owner does have six months before the permit expires. It will be the determination of the assigned inspector to either fail the job or final out the permit.
