Kings Highway Property Size: 67.11 acres Project Description: Applicant requests the removal of non-native vegetation in association with the Major Site Plan approval (Kings Highway Major Site Plan, MJSP 4202126008)fora 658,000 SF warehouse/distribution facility with associated infrastructure and stormwater management system. 'Unauthorized vegetation removal was completed by the previous property owner sometime in 2020 based on time-lapsed aerials of the parcel. The subject property did have a bona-fide_agricultural.exemption which exempts the vegetation removal permit process as a no- notice activity per LDC 6.00.03'.D.2; however,'if this exemption had been utilized then no development orders could be approved for any other.use or improvement other than agricultural uses on the same land for a period of four(4) years from the date of the last agricultural exemption.As.this.restriction would prohibit the current owner from moving forward with this major site.'plan approval,, -the applicant agreed to submit an After-the-Fact Vegetation Removal Permit along with mitigation'for the unauthorized vegetation removal in the form of a contribution in the amount of $230,277. Per Land Development Code (LDC)_6.00.05, fhis.request qualifies for issuance of a Vegetation Removal Permit. No impacts to any native vegetation are permitted at this=time° ****ANY NATIVE VEGETATION DESTROYED OR DAMAGED OUTSIDE THE LIMITS OF THIS PERMIT DUE TO CONSTRUCTION ACTIVITIES OR FILL PLACEMENT SHALL BE MITIGATED AT A RATIO OF 4.1(4INCHES OF REPLANTING FOR EACH INCH DESTROYED OR DAMAGED)**** Field Notes: 1. HABITAT: I a. Uplands: Non Residential b. Wetlands: Wetlands were identified within the area of proposed impact. An Informal Non-Binding Wetland Determination issued (Permit No. 56-105730-P), which claimed one 0.9-acre l isolated freshwater wetland (considered Category III per St. Lucie County Comprehensive Plan Policy 6.1.14.1)and 0.7-acres of other surface waters (in the form of historic agricultural ditches). - i 2. WILDLIFE:Based on the lack of intact native habitat onsite,no evidence and therefore no impacts to any listed species are expected to occur as a result of the proposed development. 3. SIGNIFICANT ARCHAEOLOGICAL OR HISTORIC FINDINGS: None Identified. { Permit#20220329 provides authorization for the removal of non-native vegetation)only. No impacts to native vegetation are permitted at this time. ' 1 Conditions of Issuance: The following minimum standards for vegetation protection shall be applied'Jo areas of+vegetation designated to be preserved as shown on the included exhibit.A barrier shall be placed and maintained around the tree's perimeter to form a continuous boundary as specified below subject to restrictions as detailed below: i d i a j I' y� I 9 I • Vegetation protection barricades shall be placed at a minimum distance of either ten (110)feet from the edge of groups of protected vegetation or from the radius of the dripline from all protected trees,whichever is greater; • Protective barriers or protective designations shall remain in place until completion o site construction and clearing activities; • In the event that any protective barriers are removed or altered and clearing activities are conducted within an area identified for preserve, SLC ERD is authorized to direct that all land clearing and site alteration work at the site be stopped until the barriers are restored and any necessary corrective actions taken to repair or replant any vegetation removed or damaged as a result of these encroachments. • The preserve areas and tree preservation areas shall be maintained in their natural state, so as not to alter the water and oxygen content of the soil and impair its function; • A National Pollutant Discharge Elimination (NPDES) Permit from the Department of Environmental Protection may be required for construction activities disturbing 1 acre or more. Please visit NPDES Stormwater Program website or contact Jose Vega, St. Lucie County Stormwater Program Coordinator, at 772-462-1668 for more information; • No grade changes or excavation of any sort may be made within the barricaded areas; • If any excavation or other activities are expected outside of the preserve area or dripline,the roots should first be pruned (to the depth of required excavation)to sever them cleanly; • If underground utilities must be routed through a protected root zone area,jtunneling under the roots shall be required; • No fill material, construction material, concrete, paint, chemicals, or other foreign materials shall be stored, deposited or disposed of within a vegetation preservation area; • No signs, permits,wires, or other attachments shall be affixed or attached to protected vegetation; • No equipment;including passenger vehicles, shall be driven, parked, stored, or repaired within designated vegetation preservation areas. • The granting of this vegetation removal permit is specific to the property described in this permit, and is not applicable/transferable to any other property or location owned by the applicants in St. i ucie County. • The granting of this vegetation removal permit is for the express purpose of providing early work authorizations for the works described in the application of vegetation.,removal,permit referenced in this permit,as described to include limited site clearing activities (specifically, tfe, removal/relocation of the vegetation described in this permit) and no other vegetation removal or works requiring -other vegetation,remova l permitting authorizati ns is to be considered granted under this permit. _ • The granting of this specifictearly work`authorization does not-in any way or form, provide precedential setting for similar requests or approval actions;by St. Lucie"Couhty: Mitigation Requirements:.! 1. Mitigation: Tree mitigation was previously satisfied via donation mitigation for the unauthorized vegetation removal in the form of a fee-in-lieu contribution in the amount of$230,277.00. 2. Landscape: Landscaping shall comply with the updated Landscape Plan dated July 21, 2021 prepared by Kimley Horn and Associates, Inc.
