1. That the said party of the first part for and in oonsideratlon of the oovenants
and agreements to be performed b~ the ~8rty of the second part as hareinafter Bet forth, does
assign, transfer, and stt over unto the said ~arty of the seoond part, his heirs and assigns,
all the right, title and interest which said party of the first part has In and to the said
oo1ltraot between the said Charle8 D. Oook and the said Deerfie1d Groves Company, 8'10. in and
to the lands therein described, conditioned. however. upon the saId party of the second part
perfonning the agreements and covenants hereinafter set fotth.

ment; and said party of the second part also agrees to assume and pay to said Charlee B. Cook
all moneys provided in said contraot to be paid by the said Deedfield Groves Company, and also

3. The said party of the second part further covo:lnants and agrees tha t he w11l im-
mediately. acquire from said Charlae B. Cook~ and immediately thereafter convey by good and
suffioient warranty de~d. free from all enoumb~ances, to the said party of the seoond part the
fOllowing desoribed traot of land situated in St. Lucie Coun~t Florida:
Beginning 9.60 chains East of the Northwest corner of Seotlon 26. Township 31 South
of Range 39 East. thence run East to the Northeast corner of the Horthwest Quarter o~ the
Northwest Quarter of said Section 26. 'roW11shlp 31 South of Range 39 East; thence run South
11 chains; thence run West to a point due South of the point o-r beginning; thence run Uorth
11 chaine to point 01' b~ginning.
4. The party of the oecond part further oovenants and agrees to clear ani grade a
road along the whole East boundary line ?f the tract 01' land above described. and eKtending
North to the North line of the South half of Seotion 23, TownB~lp S1 S. R~ 39 East. Said
r<8d to be ootDplettd, on or before July 1, 1924. The said party of the seoond part further cov-
8n8ntS and agrees to leave and maintain a Dermanent wind brQk4 26 feet in width along the
entire East side of the foregoing described road. The party of the second part further cove-
nants and agrees that tho proviaions of this paragraph shall be embodied in the deed of convey-
ance to the party of the first part for the tract of land heretofore provided to be conveyed
to the party of the first part, or in such other instrument of writing as the party af the
first part may require.
This agreement shall be binding_on and enure to the benefit of the heirs, successors.
legal representatives and aesigns of the respeotive parties hereto.
