SUBJECT: St. Lucie Gardens - 3414 501 1106 100/9 (subject parcel) NtI/
3414 501 1106 150/4 (parcel to south)
We currently have a single family home and detached garage located at the above -referenced parcel
under review for Land Development Code compliance for issuance of a building permit. Unfortunately, the
parcel which is located in the AR-1 zoning district was determined to be not a non -conforming lot of record
in 1997. In 1984, the parcel to the south and the subject parcel were under the same ownership. In 2000,
St. Lucie County purchased the parcel to the south for a road (drainage) that is in the Long Range Plan. As
a result, the owners are left without the remedy of purchasing the parcel to the south.
I have discussed this situation with Heather Young, Assistant County Attorney III, and we discussed
options for the owners. The property meets the requirements of area and width for the AR-1 zoning district.
This situation is unique in that the parcel to the south is in public ownership. As a result, only one
dwelling can. be built on both parcels if we allow the applicants to move forward. The applicable ordinance,
Section 10.00.04 requires that only one house be built on the two parcels because it is considered an
undivided parcel for purposes of the code.
Section 10.00.04.E provides:
If two (2) or more lots or combinations of lots are contiguous to other lots were of single ownership and were
of record on July 1, 1984, and if all or part of the lots do not meet the requirements established for lot width,
area or frontage, the lands involved shall be considered to be an undivided parcel for purposes of this Code
provided however, that lots separated by an ingress/egress, access or roadway easement that was of record
on July 1, 1984, but specifically excluding any easement, limited to utilities, drainage or other non -access
purpose, shall not be considered an undivided parcel for the purpose of this section.
One option is a memo to the file allowing the applicant to move forward based on these unique
circumstances and the fact that only one home will be built on both parcels thereby meeting the intent of
Section 10.00.04, or we could direct them to move forward with a variance from the requirement of frontage
in the ARA zoning district. If we take the second route, perhaps a waiver of the fees would be in order due
to the fact that we purchased the other half of the "undivided parcel'. Please advise.
