Paragraph 1 points out that any inconsistency between the Addendum and the provisions of the Declaration of Covenants and Restrictions of Harbour Ridge relating to single family residential shall be determined and resolved by the Architectural Review Board. That was in 1992. We have no knowledge, or way of knowing if the HOA has modified this restriction over the past 19 years. This is partially why it is almost impossible for St. Lucie County to monitor the implementation of the HOA documents on a case -by -case basis. The ARB has reviewed and approved the request of the property owner on 11/11/11. It references "...Except for the Custom Homes..." throughout the document. An electronic search of the document for "accessory structures" did not yield any matches. Typically when we approve a PUD, we do require the developer to create and record HOA/POA documents. However, it has always been my understanding, under advisement of the County Attorney's Office, that St. Lucie County does not enforce the HOA/POA documents; it is a civil matter. They have a Board of Directors and usually an Architectural Review Board that reviews and approves modifications that home owners want to make. The Reserve also had similar questions in the past. Mr. Wattlee provided the copy of the HOA approval letter and he described to me that there are several other gazebos and bath houses in the neighborhood. Sec. 8.00.03 of the LDC states that these are permitted accessory structures in Planned Unit Developments. In my humble opinion, based on the` -.jched letter, and based upon past policiE.; . ,,;d practices of the Department, the Planning Department should have no objection to the building permit. The other buildings are units and they are allowed screen rooms and pools. I do not think they have any other types of accessory buildings. Harbour Ridge is about a 20 year old site plan. I cannot remember the last building permit for Harbour Ridge other than generators and gas tanks. Most of them are the same, except for this one in River Pointe Village. Lots A thru G are only for the Custom Homes. Paula's recollection was that accessory structures are not permitted but she did not want to go on memory. So the question is, is an accessory structure permitted in the subdivision of Harbor Ridge. Paula would have gone to the laze fiche but hers is not working. So Kristen if you would research this and provide an answer it would be appreciated. Thanks Robin D.
