Final Location of pier(s) is subject to field conditions. Proposal assumes footings are no more than 2' below grade, 8" from foundation wall or 16" thick, if not additional charges will occur through a change order, unless otherwise noted. If cracked footings are observed during underpinning,additional piers or steel plates may be necessary and handled as a change order. Contractor to coordinate utilities locating service and take responsibility for repairing any damage occurring to a private utility line during installation. Install PolyLEVEL as indicated on job drawing. Fill drilled holes for poly injection ports with concrete. Poly Mobilization,setup,delivery,installation charge Contractor Will 1.) Notify customer of any overages prior to continuing on jobsite. 2.) Record Benchmarks. 3.) All work will be completed in a workmanlike manner in according to the standard practices of the industry. Customer Will 1.) Remove and replace any landscaping that is in the work area. 2.) Provide proper dedicated electrical outlets for all pumps,dehumidifiers and other electrical devices to be installed and or removed. A dedicated 20 amp 2 receptacle outlet is required for a dehumidifier 3.) Remove all items from work area prior to installation date.Customer is responsible for removal and replacement of all pool pumps,filters,heaters,A/C unit(s) and utility lines in work area prior to installation date. 4.) Pay for job upon completion to foreman. Customer acknowledges that the final invoice may be subject to customer approved change orders not included on this contract. 5.) Notify contractor of any changes to property prior to installation date. 6.) Make contractor aware of any septic systems,underground pipes,drains,drainage systems in work area(s). Contractor not responsible for damaged or effected areas. Additional Notes This agreement" is made under, and for all purposes shall be construed and enforced in accordance with and governed by the laws of the State of FL, excluding its conflict of laws provisions. By signing this Proposal, the customer agrees that this agreement may be amended only by a writing signed by each of the parties, may not be assigned by me/us without your consent and contains the entire agreement of the parties with respect to the transactions contemplated hereby and supersedes all prior written and oral agreements. Concrete removal to access the pile/pier location is an additional charge unless otherwise noted. N Square inc. reserves the right to choose the type of pier that is used based on soil conditions noted in the soil boring report at no additional cost to the customer. If the soil boring report shows any signs of a potential sink hole or if a sinkhole problem has been identified in the past at the property, N Square inc. reserves the rights to terminate this contract. Customer agrees that any additional permitting/soil boring costs that are deemed necessary by the proper building authorities are the responsibility of the customer. Customer also understands the permit plans are for permitting the work in this agreement, the plans in no way constitute that an engineering inspection has or will occur, unless specifically noted in this agreement. N Square inc will drive all piers to the loads stated on the permit plans with no additional depth charges. ("Contractor") to the customer ("Customer"). There are no other verbal or written warranties. There are no warranties which extend beyond the description on the face hereof, and NO WARRANTIES OF EXPRESS OR IMPLIED MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. General Terms - For the applicable time periods indicated below, this Warranty is transferable at no charge to future owners of the structure on which the work specified in this Contract is completed. This Warranty is in effect if the job specified in this Contract is completed and paid in full and, alternatively, is null and void if full payment is not received. Contractor does not warrant products not mentioned below, but some of such products may be covered by a manufacturer's warranty. Exclusions From This Warranty - This Warranty does not cover and Contractor specifically disclaims liability for: 1) exterior waterproofing; 2) system damage caused by Customer's negligence, misuse, abuse, or alteration; 3) dust incidental to installation; 4) damage to personal property of any type; 5) utility line breakage; 6) damage caused by mold; 7) failure or delay in performance or damage caused by acts of God (flood, fire, storm, methane gas, etc.), acts of civil or military authority, or any other cause outside of its control; 8) damage done during a lifting operation; 9) basement water seepage;10) heave or any damages caused by it; and 11) damage caused by lateral movements and forces of hillside creep, land sliding or slumping of fill soils of deep embankments. Foundation Piers - Helical & Push Piers, Pin Plies Items for which the Customer is responsible: Customer is responsible for any finish carpentry repairs, painting repairs, stucco repairs, drywall repairs, concrete slab repairs, flooring repairs, paver repairs, coping repairs, pool piping repairs or any underground utilities repairs, etc. that may be necessary after Contractor's Foundation Pier work is finished unless stated in writing in the Contract. When trenching or excavating is required, Contractor will backfill and tamp dirt to the best of its ability, however, Customer may need to add additional soil at a later date if the area excavated settles. Customer is also responsible for any landscaping, reseeding and resodding unless stated in writing in the Contract. Customer is responsible for marking any private utility lines such as electric lines, cable lines, plumbing lines, satellite dish cables, propane lines, sprinkler system lines, etc. Customer assumes all responsibility for damages due to breakage of any utility lines if the utilities insurance waiver is signed, though Contractor will do its best to avoid such damage. Foundation Piers Warranty: Contractor warrants that the foundation piers will stabilize the existing foundation against further appreciable vertical settlement in the areas were work was performed for seventy five (75) years from the date of installation, or else the Contractor will provide the labor and materials, at no cost to the Customer, to correct the problem with the foundation piers. Contractor does not warrant lifting, leveling, to close cracks, to render doors and windows operational or to move walls back to their original position, but will do its best to achieve positive results in this regard. Customer should also know that the possibility of further damages exists during a lifting operation, and that Contractor is not responsible for such issues. Customer is responsible for any finish carpentry repairs, painting repairs, stucco repairs, drywall repairs, concrete slab repairs, flooring repairs, paver repairs, coping repairs, pool piping repairs or any underground utilities repairs, etc. that may be necessary after Contractor's foundation pier work is finished unless stated in writing in the Contract. PoIyLEVEL® Contractor warrants that the PoIyLEVEL® product will stabilize the existing concrete slab against further appreciable vertical settlement (more than''W) in the areas were work was performed for five (5) years or else N Square, Inc. will provide labor and materials, at no cost to the Customer, to re -inject Poly Level in those areas. Customer is responsible for any supplemental repairs associated with re -injection of PoIyLEVEL®. Contractor does not represent that PoIyLEVEL®will lift the Customer's slab to meet any criteria of levelness, but instead that it will lift the slab as much as practical. Customer should know that the possibility of further damages exists during a lifting operation. Customer is responsible for any finish carpentry repairs, painting repairs, stucco repairs, drywall repairs, concrete slab repairs, flooring repairs, paver repairs, etc, that may be necessary after Contractor's PoIyLEVEL® injection work is finished unless stated in writing in the Contract. Joint and Crack Sealant - For areas where Contractor has installed NexusProO Joint Sealant— ("Sealant"), Contractor warrants that Sealant will remain intact for a period of 1 year from the original date of installation. If Sealant does not stay intact, Contractor will re -apply Sealant to the area at no additional cost to Customer. Concrete Protection System - For areas where Contractor has installed Concrete Protection (exterior or garage), Contractor warrants that the concrete will not experience settlement that causes a trip hazard of more than %inch and Sealant will remain intact for a period of 5 years from the original date of installation. If the concrete settles and causes a trip hazard of more than % inch and/or Sealant does not stay intact, Contractor will repair the area at no additional cost to Customer. Items For Which Customer Is Responsible -Customer is responsible for: 1) making full payment to the crew leader upon completion of the work; 2) preparing the work area for installation; 3) any finish carpentry, painting, paneling, landscaping, etc. that maybe necessary after Contractor's work is finished; 4) marking any private lines such as satellite cables, propane lines, sprinkler system lines, etc.; 5) maintaining positive drainage away from the repaired wall(s); 6) keeping gutters clean and in good working order; 7) directing downspouts a sufficient distance away from the repaired wall(s); 8) maintaining proper expansion joints in concrete slabs that are adjacent to the repaired wall(s); and 9) any items mentioned in this Contract under "Customer Will" or "Additional Notes." Crawl Space Items for which the Customer is responsible: Customer is responsible for periodic inspections of installed equipment and for maintenance of equipment per manufacturer's recommendations. Customer is responsible for any flooding in the crawl space either from a storm event or a rise of the water table inside the crawl space. Customer is responsible for any finish carpentry repairs, painting repairs, stucco repairs, drywall repairs, concrete slab repairs, flooring repairs, or any underground utilities repairs, etc. that may be necessary after Contractor's Crawl Space work is finished unless stated in writing in the Contract. Clean Space Contractor warrants the "Clean Space Encapsulation System" will isolate the home from the earth in the areas in which the system is installed for a period of twenty-five (25) years from the date of installation, or else the Contractor will provide the labor and materials, at no cost to the Customer, to correct the problem with the "Clean Space" installation. The Clean Space Encapsulation system will lower the humidity level in the air, reducing moisture needed for mold growth, however the encapsulation system does not claim to be a mold mitigation system. For maximum benefit the entire crawl space must be encapsulated. Wet crawl spaces require a drainage system and a sump system to remedy the problem with water below the Clean Space liner. THIS WARRANTY DOES NOT COVER, AND THE CONTRACTOR SPECIFICALLY DISCLAIMS LIABILITY FOR WATER DAMAGE TO FLOOR COVERINGS,FURNITURE, STORED ITEMS, FINISHED WALLS AND OTHER OBJECTS INSIDE THE CRAWL SPACE. Wood Framing Repairs The proposed work includes the installation of framing members in the crawlspace. (i.e. joist repairs, ledger installation, beam repair) The new framing members are for the repairs to the existing framing inside of a crawlspace. The installation of the crawlspace framing members will not change the attitude (i.e. level) of the existing floor framing structure unless stated in writing in the job proposal. Contractor warrants the wood framing repairs in the areas were work was performed for a period of ten (10) years from the date of installation, or else the Contractor will provide the labor and materials, at no cost to the Customer, to correct the problem with the wood framing repair. Pass-Thru Warranties Contractor assigns and passes through to the Customer the manufacturer's warranties for installed equipment (i.e. sump pumps, dehumidifiers, etc.). The only warranty on these items by the Contractor is limited solely to their being installed in accordance with the manufacturer's instructions.
