What is the purpose of the proposed variance and the intended development of the subject
property if the variance is granted:
On November 3rd, 2017, the State of Florida Department of Health approved and issued to owner septic tank permit #56-
SF-1798314 for the proposed project. The St. Lucie County ERD has subsequently halted the building permit process citing the
proposed system and is requesting owner to install an alternative ATU (aerobic treatment unit) septic system. Therefore appeal
for variance is made to allow installation of a standard (anaerobic) septic system at a minimum of 197 feet from the Mean High
Water Line of the St. Lucie River to accommodate the proposed construction of a single story single family residence.
2. State the specific hardship imposed on the owner? Describe how denial of the Variance
Request would result in a hardship for the applicant (versus a mere inconvenience) such as,
but not limited to, severe property loss or damaae and unsafe conditions.
Meeting the requirements for the Zone B 300 feet setback for shoreline buffer, would render the entire (unified) property
unbuildable, as only 1305 sq. ft. of the parcel lies outside the setback and that area is completely within a 75 foot radius of a
neighboring well. Locating the septic system on the RS-4 zoned portion of the subject property will entail connecting the septic
system across a 6 foot wide utility easement (currently occupied with existing utilities) however, the owner accepts the liability as a
compromise for the fruition of the project. The impact of substantially higher capital cost of an aerobic system (upwards of $20,000)
and the perpetual annual permitting would ultimately result in termination of the entire project for the owner.
3. State reasons why this hardship is unique to the owner and explain how the conditions
warranting a variance were created by circumstances beyond the, applicant's control.
In 2013 a Pre -Application meeting was requested by the current owners with the St. Lucie County staff. There, an exhibit
showing the proposed location of a single family residence oriented to the 611 feet of river frontage was presented and a
consensus was given that the location would be acceptable. The current owners then purchased the property. As
requested by the county, the owners filed a Unity of Title, and moved forward with the responsibilities and costs of
Page 2 of 4 surveying, engineering, architectural plans, soil borings, and utilities connection. A contract with a reputable builder is
currently pending, and as mentioned, a septic tank permit was granted. The proposed septic system location is an attempt
to satisfy both the county's latest requests and the reasons the property was purchased.
4. Provide physical findings and how the variance will not adversely affect adjacent shorelines or
other property and/or shorelines in the vicinity in which the subject property is located. Please
Note: Facts provided by other interested parties and the public will be given equal
consideration.
The Zone B 300 foot setback line for the proposed septic system lies (as does the proposed 197 foot setback) beyond the
limits of many existing septic systems in the neighborhood, particularly those immediately adjacent to the subject
property. The natural slope to the south (where county stormdrains empty) will be maintained, thus not directly
impacting the river by erosion. The current river shoreline exists in its natural vegetative state, which the owner will
contine to protect from exotics. A single family residence with a dock exists on the neighboring shoreline to the north and
will not be impacted.
5. State reasons why granting the variance will not adversely affect water quality or contribute to
erosion or siltation of the adjacent waterbody and shorelines.
As shown on the site plan, the proposed 197 feet from the Mean High Water Line (MHWL) of the St. Lucie River to the septic
tank and drainfield area (located on the eastern (R-4 zoned) lot of the property) is far beyond the Conservation Setback of 75
feet. The observed 75 feet setback from neighbors' wells protects the drinking water quality of adjacent homeowners. The
proposed 197 feet is a distance 2.6 times greater than that required from any potable (drinking) water wells, indicating the
quality of water that might affect the river. Additionally, the efficacy of ATU's is hotly debated in many municipalities as is the
maintenance permitting process required with the system. Erosion is addressed in question 4.
6. State reasons why this variance will not increase boat traffic, the danger of erosion, or impair
property values in the neighborhood in which the subject property is located.
The proposed variance will not in any way affect boat traffic. Shoreline and erosion, are addressed in questions 4 & S.
The proposed residence will be an asset to neighborhood property values, as it has been designed to "blend in" with the
architectural style and scale of surrounding homes and yet exceed standard current construction materials and methods.
The mere occupation of the property would eliminate the problems of unhindered exotic vegetation growth, dumping,
vagrancy, and vandalism previously impacting the neighborhood.
7. State why this variance is the minimum variance that will make possible a reasonable use of
the land, building and structures.
The proposed placement of the septic area is on the naturally high open and sandy area of the property. It is as far away
from the river as possible without impacting surrounding water wells or utility equipment. Locating the septic system
abutting the eastern edge of the existing 6 foot wide utility easement satisfies the requests of the SLCo ERD and keeps the
system on the R-4 zoned property, as requested by the SLCo Planning Department. It is a responsible response to the
unique conditions of this special property.
8. Is this variance request located within a Homeowners or Property Owners Association? NO

Association, a letter from that Association is required stating their position regarding the
variance request.
