After our conversation on July 20, 2018 please see the attached document I'm sunding aif die, firfox, n
needed for a variance request, please see attached email below from Bethany Grubbs. If there are any questions
on the variance process please contact Bethany Grubbs at 772-462-1687. She will be more than happy to help
with the process. Below is what will need to be addressed if you decide not to do the variance. Please let me
know how you would like me to proceed.
I have attached the Land Development Code section 7.10.16 please see the requirements for the rear setbacks to
800 Osprey Ct...
The shed will not require a permit. However the deck / foundation the shed is attached too will need to be
permitted. The deck / foundation must also be designed to meet the wind load requirements of the 2017 Florida
Building Code.
A separate permit will be required for the proposed deck.
The dock permit will need to have the boat lift added to permit number 1802-0611. The unpermitted boat lift is
not addressed on the FDEP self -certification. This will need to be revised on the submitted FDEP self -
certification. Or a new FDEP self -certification will be required for the unpermitted boat lift, with the product
information sheet, revised drawings showing the location, and details for the electrical requirements.
The height requirement for the deck / foundation must be no higher than the minimum requirements of code
section:
R311.7.5.1 Risers of (The riser height shall be not more than 7 3/4 inches (196 mm). The riser shall be
measured vertically between leading edges of the adjacent treads.).
The additional deck that you plan to construct from the seawall to the existing RN concrete slab will need to be
constructed from natural grade to no higher than 7 3/4 of an inch. The proposed deck must be constructed on the
landward side of the seawall and not over the top of the seawall. The top of the proposed deck to the top of the
seawall cannot exceed the height requirements of sections R311.3.2 or R311.7.5.1 of the 2017 Florida Building
Code.
The proposed deck and the unpermitted dock must also be designed to meet the wind load requirements of the
2017 Florida Building Code with the unpermitted dock no higher than 7 % from the top of the seawall.
Photos supplied to me by code enforcement show the dock is constructed on top of the seawall with 2" x 8"
pressure treated lumber with V composite decking. As a result, would put the elevation of the dock at a +8.25
or 8 1/4" from the top of the seawall. The dock exceeds the height requirements of section R311.7.5.1 of the
2017 Florida Building Code.

Attached is the application and supplement for a variance application. At time of application submittal we require a
boundary survey showing all existing and proposed improvements, a warranty deed, a legal description in Word format,
any photos they feel will help, and if they are located within an HOA we need the HOA's approval letter. All of these
documents should be scanned on a CD with 5 hard copies. The fee to accept the application is $850.00.
Review
Planning and the County Surveyor review the variance submittal for compliance with the Code. If anything is missing, or
incorrect, we forward our comments to the applicant to have their surveyor make the corrections. After the documents
are reviewed for completeness, we set a date for a hearing before the Board of Adjustment. They meet on the 4th
Wednesday of the month at 9:30 am. Planning sends the applicant sign content to get with a sign company (we provide
a list) and have a public notice sign installed on their property. This is a fee paid to the sign company at their going rate.
Next, planning mails notices to all property owners within 500 feet of the subject property and requests reimbursement
from the applicant for postage at 0.50 cents per mail out. Planning staff advertises the public hearing in a news ad in the
Tribune. Planning will request reimbursement for this news ad, which is typically $200-300. All fees must be paid prior to
the Board meeting.
The Board
The Board of Adjustment is a 5 member panel of representatives. Planning analyses the variance request and makes a
recommendation to the Board based on whether or not the variance requested qualifies as a hardship as defined by the
Code; however, the approval is ultimately up to them. The Board takes several factors into consideration, including if the
immediate neighbor objects to the request.

I left a message for you the other day once I was able to recharge my phone. Needless
to say, I am trying to get some movement forward on this permitting process. You and I
spoke at length about the height of the step onto the platform (deck/dock). The only
place that this creates an issue is at the northwest side of the structure where it meets
the seawall. From the seawall landward about 1-2' is the step greater than the allowed
7.75". Further south of the seawall the ground slopes up so it does not exceed this
measurement. Since this is a concern, could I construct a small railing to prevent
anyone from stepping onto the structure where the rise height is greater than 7.75"?
I understand that a deck permit would also be required since you mentioned that decks
are over land and docks are over water. Is that application something I can download
off your website? Or if not, could one be emailed to me?

built. This work was done prior to dep approval and without a permit from us. We would like clarification on the dep
approval as to what the self -certification covers as the area is in an environmental protected area. The deck which
attaches to the landward side of the seawall also extends into the water area. I have attached pictures of the dock and
deck which was constructed. In the picture the dock and deck in question is on the left side. We would appreciate any
help you can give us to understand what he has been self -certified to construct. Thanks

Hi again Monica. I do have one question. You said his application said dock replacement however this is a new dock
that was built, not a replacement. I checked our aerials and the latest one for 2016 does not show a dock for this
location nor do we have a permit previously for this location. Therefore it is a code case for construction without a
permit. The applicant purchased the property in January 2017 and the dock was built after that date. The permit is on
hold because of Zoning issues with the deck portion that goes across the seawall and onto the property. Even though
his application states dock replacement, will the self -certification still be ok for the new dock that has been built?

Hi Irvie,
The applicant completed a self -certification for an exempt dock replacement on 2/21/18. Self-certs are not reviewed by
staff at the DEP; it is basically a bunch of drop -downs and the applicant checking or certifying that they are meeting
certain criteria for themselves. I have attached the auto -generated letter they received for the self -certification. It does
not have any plans attached to it as those are not required for that process. There are just criteria they must meet and
that they stated they are meeting. Take a look and let me know if you have anymore questions. If there is a question of
it being valid, please get in touch with John Renfranz, the ERP compliance manager copied here.

Hey Irvie,
The permit allows for the construction of a dock of an area no greater than 500 square feet. As long as his dock fits this
bound, it is in the clear. It should be noted that the dock should be measured from the wet face of the seawall and not
from where it joins the house as that part would not be over water. Looking at the pictures and from my experience
inspecting these things, it looks like it would fall well below that limit.
In terms of location, these are outlying Florida waters, which essentially only dictates the size of the dock
permittable. This body of water is adjacent to but not within the aquatic preserve so construction is ok.
Technically the permit should be obtained before construction, but in this case they eventually did get the permit and
didn't wait for any sort of complaint to initiate that process, so I don't see any big issues.

The applicant completed a self -certification for an exempt dock replacement on 2/21/18. Self-certs are not reviewed by
staff at the DEP; it is basically a bunch of drop -downs and the applicant checking or certifying that they are meeting
certain criteria for themselves. I have attached the auto -generated letter they received for the self -certification. It does
not have any plans attached to it as those are not required for that process. There are just criteria they must meet and
that they stated they are meeting. Take a look and let me know if you have anymore questions. If there is a question of
it being valid, please get in touch with John Renfranz, the ERP compliance manager copied here.

Hi again Monica. I do have one question. You said his application said dock replacement however this is a new dock
that was built, not a replacement. I checked our aerials and the latest one for 2016 does not show a dock for this
location nor do we have a permit previously for this location. Therefore it is a code case for construction without a
permit. The applicant purchased the property in January 2017 and the dock was built after that date. The permit is on
hold because of Zoning issues with the deck portion that goes across the seawall and onto the property. Even though
his application states dock replacement, will the self -certification still be ok for the new dock that has been built?
