This cause coming on to be heard on the 12th day of Jecember, A. D. 1924. aud tho Peti-
tioner, the State ~oad >>epartment of 1"lorida. being pres:mt in Court and represented by its
;. ttorneys. rl. A. L:8ginness, ~'. L. hemmings and .:jlackwell, ooDDell ~ JJo;';ra~ken, end the defend-
ants W. H. Turner and A.T. ;>helfer being in Court, and the defendant H.H. Turner being repre-
gented by his Attorney, l/alter R. i'ayne, and the defendant A. T. ;jhelfer being represented by
his attorneys, :eitner & Leitner, and none of the other defendants in this cause appearing and
being pepresented at tho trial thereof, wld it appearIng to the Court thst due and legal ser-
vioe had boen hod upon all the defendants, and due and legal notice had been given to each

of twelve men to be impaneled to try what compensativn shall be made to the defendants for the
