The Department of Environmental Protection gives notice that the projects to construct a 175 sq.ft. irregular shaded
marginal dock on Lot 111 which shall connect to an existing dock on adjacent Lot 112; 2) install two mooring piles waterward of
the marginal dock off Lot 111; 3) construct a new 16 sq.ft. dock on Lot 112, consisting 12' x 8' (96 sq. ft.) marginal platform with
a 17' x 3' (50 sq. ft.) finger pier; and 4) install al boatlift off the adjacent Lot 112 have been determined to be exempt from
requirements to obtain an Environmental Resource Permit. The project is located in a manmade canal, Class III Waters, adjacent
to 10851 S. Ocean Drive, Windmill Village By-Th�-Sea Condominium, Lots 111 and 112, Jensen Beach (Section 11, Township
37 South, Range 41 East), in St. Lucie County (Latitude N 27' 15' 57.51", Longitude W 80' 12' 22.50").
A person whose substantial interests aee affected by the Department's action may petition for an administrative

party showing that the failure to file a request for all extension of time before the deadline was the result of excusable neglect, the
Department may also grant the requested extensionl of time.
The petitioner shall mail a copy of the petition to the applicant at the address indicated above at the time of filing. The
failure of any person to file a petition for an administrative hearing within the appropriate time period shall constitute a waiver of
that right. A petition that disputes the material acts on which the Department's action is based must contain the following

Under sections 120.569(2)(c) and (d) of Ithe Florida Statutes, a petition for administrative hearing shall be dismissed by
the agency if the petition does not substantially comply with the above requirements or is untimely filed.
