Ordinance 08-0025 allows us to approve handicap ramps into the setback if it is 50% or less without an administrative variance., see (1) in our lot size requirement table 7.10. no roof cover allowed for all residential districts. This approval needs to be based on documents of a physician to be approved. This ordinance is not applicable for HIRD zoning. To be able to do a ramp or anything structural in the side setback an administrative variance is required if it is 50% or less ( chapter 10.01.14 )and if over 50 % the variance by the BOA. That being said, the administrative variance can be used for handicap ramps, additions etc. and doesn't have the limitation of roof cover not being allowed. I In the situation 526 Nettles Blvd they will need to do a,In amendment to the original PDS approval to allow the steps on both sides and the roof cover. Hope this makes it clear. I will re -review the Zoning part, and next week the comments will be send to the contractor. As far as the plans show, the shed in the rear closest to the 0' lot line shows it is setback 1.7' from the 0' lot line with a 0.5' overhang. The overhang should be within property lines. Next week the plans examiner will review the plans as well, and I will ask him to double check this. The steps and deck in the 8' side setback were approved based on St Lucie County Land Development Code Chapter 10.01.14 (A) administrative variance. The approval allows for a 4'x12' deck with steps on one side. The proposed plans are not matching with the variance approval. They will need to submit an amendment to the PDS order applying for the second set of steps and the roof cover. The permit will not be issued until all pr aZms and requirements have been met.
