Wazny Director of Community Development St. Lucie County 2300 Virginia Avenue Fort Pierce, Florida 34982-5652 Dear Mr. Wazny: SCANNED By ant, Lucia Count/ Recently we have discovered many unauthorized activities occurring within wetlands in the area platted as St. Lucie Gardens in St. Lucie County. Some of these unauthorized activities include such works as the placement of fill material, excavation of ponds and lakes, and mechanized land clearing. 50' Section 404-of the Clean Water Act makes it unlawful to discharge dredged or fill material into waters of the United States including wetlands unless authorized through a Department of the Army (DA) permit. Initiation of the activities described above without a permit could result in enforcement action. Receipt of a permit from the State or County_ does not obviate the requirement for obtaining a,DA permit. In order to determine if an activity will require a riermit, a wetland determination is necessary. Prior to construction, the Corps will conduct a wetland determination for a single-family residence at no cost. The Corps will require the submittal of a joint permit application form for any activity occurring within wetlands. The permit application booklet is a joint form used by both the Corps and the State. Application booklets may be obtained from the Vero Beach Regulatory Office and upon completion, should be mailed to the Vero'Beach Regulatory Office for review and processing. Permits for activities involving less than 3.0 acres of isolated wetland impacts are typically p:,;cessed within 60 days from the receipt of 'a complete application.
