For and in consideration of development permits or approvals provided, or to be provided,
by St. Lucie County, or by other governmental entities having jurisdiction, WHEELS LEASING
LLC, a New Mexico limited liability company registered to do business in the State of Florida
(“Declarant”), whose address is 2590 North Kings Highway, Fort Pierce, Florida, 34951, hereby
declares, to wit:
WITNESSETH:
WHEREAS, Declarant is the owner of two contiguous parcels of real property more fully
described on Exhibit “A” hereto (“Parcel #1”) and on Composite Exhibit “B” hereto. pages 1 and
2 (“Parcel #2"), pursuant, respectively, to Warranty Deed from ATLANTIC TRUSS GROUP,
L.L.C. recorded in Official Records Book 4499, Page 151, and Fee Simple Deed from JOHN C.
BYERS and ELAINE C. BYERS recorded in Official Records Book _______, Page ________; and
WHEREAS, the two parcels of property of Declarant are assessed on the tax roll of St. Lucie
County, Florida under two separate and distinct parcel identification numbers, to wit:
1336-231-0001-000-2 and 1336-240-0001-000-0;
WHEREAS, Declarant wishes to conjoin both the Exhibit “A” Parcel #1 and Composite
Exhibit “B” Parcel #2 as a single separate and distinct Property for development purposes by this
Declaration.
NOW, THEREFORE, in consideration of the premises above set forth, including the
development approvals requiring this Declaration, Declarant hereby agrees and declares to restrict
its Property in the following manner:
1.All of the Parcel #1 Exhibit “A” and the Parcel #2 Composite Exhibit “B” property
shall hereafter be considered as one plot or parcel of land such that no portion thereof shall be sold,
transferred, devised, or assigned separately and distinct from the entire parcel of the Property as more

fully delineated and described by boundary and topographic survey prepared by EDC
ENGINEERING AND SURVEYORS #20-381, appended hereto as Composite Exhibit “C”, pages
1 through 3.
2.Declarant further agrees and declares that this unity of title condition, restriction and
limitation shall be deemed a covenant running with the land at law, and in equity, and the same shall
remain in full force and effect and be binding upon the Declarant, and its successors and assigns,
until such time as the same may be released by recordable instrument given by St. Lucie County, a
political subdivision of the State of Florida, or any governmental agency having jurisdiction.
3.Declarant agrees that this instrument shall be spread upon the Public Records of St.
Lucie County, Florida.
