A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
ST. LUCIE COUNTY, GRANTING A CONDITIONAL USE PERMIT FOR A
RETAIL LIQUOR STORE KNOWN AS CB LIQUOR LLC WITHIN THE CG
COMMERCIAL, GENERAL) ZONING DISTRICT FOR A PROPERTY
LOCATED IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
testimony and evidence, including but not limited to the staff report, has made the following
determinations:
Claufene Belizaire, CB Liquor LLC, presented a petition for a Conditional Use Permit to
allow a retail liquor store with no onsite consumption, within the CG (Commercial, General)
Zoning District for the property located at 10800 South US Highway 1, Port St. Lucie, as
legally described in Paragraph "B" and depicted on the attached map as Exhibit "A".
2. On June 17, 2021, the St. Lucie County Planning and Zoning Commission held a public
hearing on the petition after publishing notice in the St. Lucie News Tribune at least 10
days prior to the hearing, installing a sign on the property and notifying by mail all owners
of property within five hundred (500) feet of the subject property, and recommended that
the Board of County Commissioners approve the request for a Conditional Use Permit.
On July 6, 2021, the Board of County Commissioners held a public hearing on the petition,
after publishing notice in the St. Lucie News Tribune at least 10 days prior to the hearing,
installing a sign on the property and notifying by mail all owners of property within 500 feet
of the subject property, at which all interested persons were given an opportunity to be
heard.
4. The proposed Conditional Use will not have an undue adverse effect on adjacent property,
the character of the neighborhood, traffic conditions, parking, utility facilities, or other
matters affecting the public health, safety, and general welfare.
5. The proposed Conditional Use will be serviced by adequate public facilities and services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
A. Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, a
Conditional Use Permit for CB Liquor LLC, that allows a retail liquor store with no onsite
consumption within the CG (Commercial, General) Zoning District is hereby approved. For
the property described below, subject to the following conditions:

The hours of operations shall comply with the Code of Ordinances of St. Lucie County
and State of Florida Statutes, Chapter 561 (Beverage Law: Administration).
2. A Minor Adjustment to the Conditional Use is required for a change in business name
and/or ownership before a Zoning Compliance Certificate is issued.
B. The subject property is described as follows:

A PORTION OF LOT 15, BLOCK 4, SECTION 12, TOWNSHIP 37 SOUTH, RANGE 40
EAST OF ST. LUCIE GARDENS, AS RECORDED IN PLAT BOOK 1, PAGE 35, ST.
LUCIE COUNTY, FLORIDA, PUBLIC RECORDS, MORE PARTICULARLY DESCRIBED
AS FOLLOWS:
COMMENCING AT THE POINT OF INTERSECTION OF THE NORTH LINE OF SAID
LOT 15 WITH THE WEST LINE OF LENNARD ROAD WHICH SAID POINT IS 25 FEET
WESTERLY (MEASURED ON SAID LOT LINE) FROM THE NORTHEAST CORNER OF
SAID LOT 15, THENCE SOUTH ALONG THE WEST LINE OF LENNARD ROAD FOR A
DISTANCE OF 145.10 FEET TO THE POINT OF BEGINNING; THENCE WESTERLY
215.20 FEET TO A POINT ON THE EAST RIGHT-OF-WAY LINE OF U.S. HIGHWAY #1
SAID POINT BEING 200 FEET SOUTH (AS MEASURED ALONG SAID EAST RIGHT-
OF-WAY LINE) OF THE INTERSECTION OF THE NORTH LINE OF SAID LOT 15 WITH
THE EAST RIGHT-OF-WAY LINE OF U.S. HIGHWAY #1; THENCE NORTHWESTERLY
ALONG SAID RIGHT-OF-WAY LINE A DISTANCE OF 125.00 FEET; THENCE
EASTERLY A DISTANCE OF 274.12 FEET TO A POINT ON THE WEST LINE OF
LENNARD ROAD SAID POINT BEING 26.48 FEET SOUTH OF THE NORTH LINE OF
SAID LOT 15; THENCE SOUTH ALONG THE WEST LINE OF LENNARD ROAD FOR A
DISTANCE OF 118.62 FEET TO THE POINT AND PLACE OF BEGINNING.

C. The approvals and authorizations granted by this Resolution are for the purpose of
obtaining a Building Permit or Zoning Compliance from St. Lucie County, and are not
assigned to any other party or institution. Should the petitioners choose or decide to assign
this business to another entity or individual, a minor adjustment to the Conditional Use
Permit shall be required.
D. Pursuant to Section 11.07.05(I) of the St. Lucie County Land Development Code,
approvals and authorizations granted by this Resolution shall expire after twelve (12)
months from the date of approval, unless a Certificate of Zoning Compliance is obtained
for the uses described in Paragraph "A" above, or an extension has been granted in
accordance with Section 11.07.05(F).

E. The St. Lucie County Planning and Development Services Director is hereby authorized
and directed to cause the notation of this resolution to be made on the Official Zoning Map
of St. Lucie County, Florida, and to make notation of reference to the date of adoption of
this resolution.
F. A copy of this Resolution shall be mailed to the owner and agent of record as identified on
the application.
G. This Resolution shall be recorded in the Public Records.
