ROBERT C. SCHWEBICE and JUDITH A. SCHWEBICE, husband and wife, (hereinafter
"Grantor"), and PLANAR, INC.; a Florida corporation, whose post office address is 1401
Highway AIA, Suite 203, Vero Beach, Indian River County, Florida, (hereinafter "Grantee").
Witnesseth: That the Grantor, for and in consideration of the sum of $10.00 and other good
and valuable consideration to Grantor in hand paid by Grantee, the receipt whereof is hereby
acknowledged, has granted, bargained and sold to the said Grantee and Grantee's heirs and assigns
forever, the following described land, situate, lying and being in the County of St. Lucie, State of
Florida, to wit:
The North 308.54 feet of the South 2,608.54 feet of Government Lot 1 lying East
of the Easterly right-of-way of State Road A-1-A in the North 1/2 of Section 23,
Township 34 South, Range 40 East, as measured at right angles to the South
line of said Government Lot 1 as shown on a plat of survey of said Section 23,
recorded in Plat Book 8, Page 21, of the Public Records of St. Lucie County,
Florida, LESS AND EXCEPT the right-of-way for State Road A-1-A
(hereinafter "Property").
Subject to restrictions, reservations and easements of record, if any, which are not
reimposed hereby, and real estate taxes subsequent to December 31, 2000;
Reserving unto Grantor a non-exclusive perpetual pedestrian ingress and egress
access easement over, across and through the -South 10 feet ofthe Property conveyed
herein, for purposes of beach access for the use and benefit of the Grantor and the
Grantor's successors in interest in and to the following described "Dominant Parcel".
To wit:
The North 308.54 feet of the South. 2,608.54 feet of Government Lot 1 lying
West of the Westerly right-of-way of State Road A-1-A in the North 1/2 of
Section 23, Township 34 South, Range 40 East, as measured at right angles to
the South line of said Government Lot 1 as shown on a plat of survey of said
Section 23, recorded in Plat Book 8i Page 21,,of the Public Records of St. Lucie.
County, Florida, LESS AND EXCEPT the.right-of-way for State Road A-1-A.
(hereinafter "Dominant Parcel")
Grantee, at Grantee's expense, shall construct a fence along the South line of the
Property and shall provide separately metered electricity and irrigation water
connections to the. Easement. Grantee, at Grantee's expense, shall ft rther,provide
locking gates at both the westerly and easterly ends- of the. Easement between the
fence on the South'Property line and the south wall of any improvements which
Grantee constructs on the Property: The purpose of the gates shall be to prevent the
general public from utilizing the Easement. Keys to the locking gates shall be
provided to Grantor so that the Easement may be utilized by Grantor and successor
parties having an interest in the Dominant Parcel. Grantee shall further obtain

permitting for, and shall construct, at Grantee's expense and within two (2) years of
the date of this Deed, a dune cross -over at the easterly end of the Easement to the
easterly edge ofthe vegetation and dune line, provided however that Grantor shall pay
such actual and reasonable cost of construction in excess of $7,000.00. Both
Grantor and Grantee (together with their respective successors in interest to the
Property and Dominant Parcel) may utilize the dune cross -over. Said Easement shall
run with the Dominant Parcel and the rights, privileges and obligations herein shall
inure and be binding on the successors of the Grantee and the Grantor to the Property
and the Dominant Parcel respectively.
