Our team is cu rrentlyengaged in review of Building Permit Application 1812 0252 for5721 Sterling lake
Drive/PID#1312-50101420D0-6, for theconstructionof a screened room addition tothe rear of the
existingSF home, built in 2003. The SF Home, perthe provi dedsurvey, failsto meetthe required 6ft.
side yard (setback) required ofthe Portofino PUD.The home, and accompanying patio, were
constructed via Building Perm it#23080505. The contentsofPermit#23D80505 inaccessible, precluding
the abi lityto pinpoint the placementof the hom ewithin theform board survey orfinal inspections The
current property owneracquired th estructure in 2017.
In the absence ofcontentsforPermit##23080505, and notationwithin Codeview that the home and
patiowere inspected and issued a CO, and have been maintainedforover 10 year, theSF Home, or main
structure on the property, isconsidered to lawfully exist despite notconplying with all ofthe
provisionsof this Code. In accordance with LDC Section 10.00.03 C. the proposed
expansion/addition to the home maybe allowed into that minimum yard (6ft., to 5.1 ft.) However, no
such expansion shollbeullowed if u2 results in a greaterdimensionol nonconformity than that which
previouslyexisted.
In summary,theproposedscreen enclosure maybe permittedwith a minimum sideyardof5.1 ft. or
greater, however it may not be reduced further (to accommodate the patio footprint). The review shall
e nsu re the structure meets all other required dime nsionsstan dardssuch as rear setbacks, height, lot
coverage, open space, etc
Although ourreviewisexdusiveofthatofan Home Own er'sAssociation (HOA), Ihave Inquiredwith the
applicant as to any approval issued bythe HOA for the su bj ectaddition. twill provide any updates
accordingly.

10.O0.03.-NonconformingStructures.
C. Expansions. Any expansion of a nonconforming structure shall be in conformance with the provisions
of this Code. This shall not prevent expansion as long as the nonconfommity is not increased. In the
event that a structure is nonconforming due to the fact that there is encroachment into a required
minimum yard, as defined in Section 7.04.00, expansion of the structure shall be allowed into that
minimum yard. However, no such expansion shall be allaxed if it results in a greater dimensional
nonconformity than that which previously existed.

Benjamin,
The letter is correct, if that letter was dated 12/5/18. If you recall you had put in an
application for a fence back on 11/30/17 you had been sent a letter giving "Conditional
Approval to begin the fence project". That was the first part of the process of an
application. Then when you have completed the project it is the owners responsibility to
contact the office to state that you have completed it.
The second step is for the ACE, Committee to come out and inspect your project to confirm
that it was done as stated. They then instruct me to send a letter as I did on 12/05/18 (see
the Status area in bold in the center of the letter). "Status: FINAL INSPECTION HAS
BEEN COMPLETED, AND PROJECT IS APPROVED".. That letter was for the fence
completion.
In regards to your Concrete Patio and Screen Room -
On 12/11/18 the committee noted in their minutes that there was a "Modification of a
previous application, for a Concrete Patio and Screen Room conditionally approved
by the ACB at its August 7, 2018 meeting. This is acknowledgment of receipt on
12/3/18 of a Change in Contractor for this project to The Porch Factory at a new
cost of $12,975.00. All other items within the conditional approval remain
unchanged".
The above notes were added to your original application which we have on file awaiting the
completion of your project. When you complete the project and advise the office, then the
committee will come out to do their final inspection and then you will be sent the FINAL
letter that will contain the notes indicating the change to the contractor. I hope this
explains your questions.
