Pursuant to your request, I have reviewed the proposed lot split on Coker Road.
I apologize for the delay in my response. In your memorandum to the County Attorney,
you indicated that Coker Road was not a dedicated right-of-way but was maintained by
the County. Section 11.03.04.D.2 of the Land Development Code requires that each
potential lot in a proposed lot split abut a public or private street for the minimum required
'road frontage for the zoning district. If a lot abuts a street right-of-way which does not
conform to design specifications, the owner must dedicate one-half (1/2) the right-of-way
iwidth necessary to meet these specification. See Section 11.03.04.D.3. The definition
of "street' in Section 2.00.00 does not require public dedication and includes a right-of-
iway which has become public through prescriptive use. This would appear to be the
i case with Coker Road. Therefore, it would appear that frontage on Coker Road may be
used to meet the frontage requirements for the proposed lot split. It may be necessary,
however, for the property owner to dedicate property to meet the right-of-way width
requirements.

Property Appraiser Map 23/08S identifies Coker Road in the area of
NSLWMD Canal No. 52 from Orange Avenue south to the south line of
Section..0, Township 35, Range 39.
The owner of the property highlighted on the attached map has
submitted an application for a proposed lot split, as indicated,
that would require road frontage on Coker Road to comply with AG
2.5 zoning requirements. The Right -of -Way Division has advised
that Coker Road is maintained by the county however, is not a
dedicated right- of -way.
i Would the fact that it is maintained by the county qualify it as
road frontage?
