This NOA is being issued under the applicable rules and regulations governing the use of construction materials.
The documentation submitted has been reviewed by Miami -Dade County Product Control Division and accepted
by the Board of Rules and Appeals (BORA) to be used in Miami Dade County and other areas where allowed by
the Authority Having Jurisdiction (AHJ).
This NOA shall not be valid after the expiration date stated below. The Miami -Dade County Product Control
Division (In Miami Dade County) and/or the AHJ (in areas other than Miami Dade County) reserve the right to
have this product or material tested for quality assurance purposes. If this product or material fails to perform in
the accepted manner, the manufacturer will incur the expense of such testing and the AHD may immediately
revoke, modify, or suspend the use of such product or material within their jurisdiction. BORA reserves the right
to revoke this acceptance, if it is determined by Miami -Dade County Product Control Division that this product or
material fails to meet the requirements of the applicable building code.
This product is approved as described herein, and has been designed to comply with the Florida Building Code,
including the High Velocity Hurricane Zone.

Dear Mr. Lucas:
We completed the research for the above referenced property and have determined that it
is a nonconforming lot of record. The lot is nonconforming because it lacks the required
square footage and lot width. This requirement is waived and a single family dwelling
and permitted accessory structures may be constructed on this property subject to meeting
all applicable RS-4 zoning and building code requirements.
Please be aware that the front setback is based on a 60' wide road. Ave P is a 50' wide
road, so you need to add an extra 5' to the normal front setback of 25'.
A septic tank permit is required when submitting an application for a building permit,
therefore it is suggested that you contact the Health Department before making your final
development plans. We also suggest you contact St. Lucie County Environmental
Resource Department for vegetation removal and wetlands.

Any person who intends to remove or cause the death of any vegetation pursuant to any of the following
exemptions must first fill out Part I of this form The burden of proving entitlement to any particular
exemption shall lie, at all times, with the person or persons claiming the exemption. PLEASE, CHECK

1. The minimal removal of native vegetation necessary for the clearing of a path not to exceed 4'
in width, to provide physical access or view necessary to conduct a survey or site examination OR 10' in
width to provide vehicular access necessary to conduct soil percolation or soil bore tests, for the preparation
of bona fide site development plans or vegetation inventories; provided such clearing or removal is
conducted under the direction of a Florida registered surveyor or engineer. ($27.00)

A) Nothing in this exemption shall exempt any person from the landscaping requirements set
forth in Section 7.09.00 of this Code;
B) This exemption shall not be construed to allow the removal or alteration of any protected
vegetation without a Vegetation Removal Permit on any exempted lot or parcel of land by its
subdivider unless the subdivider intends in good faith to construct a residential unit or units
upon the lot or parcel of land prior to its sale. Advertisement or listing the lot or parcel of
land for sale without a residential unit shall create a presumption that the subdivider does not
intend to construct such a unit and that the intent is for a subsequent purchaser to develop the
lot or parcel.
C) No native vegetation twenty-four inches (24"), or greater, dbh shall be removed from any
residential parcel (including those in the AG-5, AG-2.5, AG-1, AR-1, RE-1, and R/C zoning
districts), regardless of parcel size, without an approved Vegetation Removal Permit and an
approved mitigation plan. The Environmental Resources Director, or his designee may reduce
the requirements for mitigation on individual residential lots 1h acre or less where a protected
tree 24" dbh or greater must be removed in order to provide for the reasonable use of the
property.

For construction associated with areas that are not vegetated or where no vegetation is to be impacted
_7. The following activities do not require the application of a Notice of Vegetation, however may
be required for Building Permit approval or other such authorization: ($0.00 Fee)
A) Preserve and Parks Management Activities. Vegetation removal activities associated with an adopted
management plan for government maintained parks, recreation areas, wildlife management areas,
conservation areas and preserves. The purpose of the vegetation removal activity shall be to protect and
preserve the natural values and functions of the ecological communities present, such as, clearing for
firebreaks, conducting prescribed bums, or construction offences. .
B) Existing Agricultural Operations. Vegetation removal associated with subsequent harvesting activities,
except within required preserve areas or deeded conservation easements, which are part of the on -going
activities of the existing operation shall not require a permit. Initial clearing of a site is not an exempt
activity. Bona fide agricultural activities include commercial nursery, tree faint, aquaculture, ranch, or
similar operation.
C) Routine landscape Maintenance. Trimu ing or pruning of vegetation which is not intended to result in
the eventual death of the vegetation, mowing of yards or lawns, or any other landscaping or gardening
activity which is commonly recognized as routine maintenance, replacement or relandscaping which
does not result in the eventual death of any vegetation, does not require the approval of a Notice of
Vegetation Removal.

PART II - VEGETATION REMOVAL PERMIT
Applicants removing vegetation, and who do not qualify for an exemption must till out Part II of this form.
Please complete ALL of the requested information. The Environmental Resources Director, or his
designee, shall issue a Vegetation Removal Permit only if sufficient evidence demonstrating that at least
one of the following criteria has been satisfied:
_ 4 1. The applicant for vegetation removal permit shall demonstrate why preservation of the existing
vegetation is not practically feasible and prevents thereasonable development of the site.
_ �L2. The removal of the native vegetation is the minimum necessary in order to implement a Final
Development Order (i.e.; approved site plan or approved building permit).
_ �L3. A Final Development Order has not been issued, or is not required by this Code for the intended
non-agricultural use of the land and vegetation is the minimum necessary to allow for the construction of
the intended use or improvement.
SUBMITTAL. RFQUIRFMFNTS FOR VEGETATION REMOVAL PERMITS:
1. Vegetationfrree Survey - For individual single-family or duplex development lots, the site vegetation
survey may be a sketch provided that the sketch accurately and completely depicts the areas of vegetation
removal and protection. For any residential development activity which requires the submittal of a site plan
approval, or any non-residential development activity, the site vegetation survey must accurately depict the
location of all proposed buildings, structures, driveways, septic tanks, and other improvements drawn to
scale; and the existing vegetative conditions on the project site, including an identification of what areas
will be impacted by the proposed development activity and what areas are proposed for
protection/preservation. The individual locations of all County -protected trees, measuring the minimum
sizes outlined in Table 1 of Section 6.00.05, that are located within all areas of proposed improvement and
within twenty (20) feet of all proposed improvement areas shall be shown on the plan. For the purposes of
this requirement, improvement areas shall include all subdivision lot lines and maximum buildable areas, as
identified in Section 11.02.10 (A)(3)(d). _

operating and bona fide commercial nursery, tree farm, agricultural operation,
ranch, or similar operation, provided that the removal or alteration is performed
on land owned or lawfully occupied by the person conduction the above operation
and is performed pursuant to that operation. When the removal or alteration of
protected vegetation, other than routine maintenance, has been performed under
this exemption no development order shall be approved for any other use or
improvement on the same land within either.
A) Two years from the date of completion of such vegetation removal or
alteration provided that an agricultural classification has been granted for that
land by the St. Lucie County Property Appraiser, or,
B) Eight years from the completion of such vegetation removal or
alteration if no agricultural classification has been granted land by the St.
Lucie County Property Appraiser.
4. The removal of protected vegetation which has been destroyed or damaged
beyond saving by natural causes or causes not covered by other sections of this
Chapter or by which constitutes an immediate peril to life, property, or other trees.
5. The removal or alteration of protected vegetation upon any detached single
family residential lot or parcel of land having an area of one acre or less. This
