SUBJECT: Laura Linscott - Request for Relief from Required Impact
Fees associated with Building Permits
Attached, you will find a copy of recent correspondence from Ms.
Laura Linscott requesting that this Board grant relief from the
impact fees associated with Ms. Linscott's anticipated submission
of a building permit for an approximately 5500 square foot kennel
for dogs and cats and a caretaker apartment operated by the tax-
exempt, not -for -profit Dogs & Cats Forever Inc.
The proposed location for this shelter is on Carleton Road. The
land use and zoning for this parcel is AG-5 (Agricultural, 5 acres
per 1 unit). The caretaker apartment at this time is proposed to be
attached to the kennel and would be occupied by a volunteer senior
citizen couple whose responsibility it would be to care for the
animals in the shelter.
The anticipated impact es rged by St. Lucie County would
consist of approximately $38.50 ro impact fees for the kennel
at $7 per 1000 fee , us $426 n road impact fees for the
apartment, and 425 i school im fees for the apartment for a
total of $889.5 a school impact fee can only be waived through
a petition to the St..Lucie County Schoolboard.
It is the petitioner's position that since the organization is tax-
exempt, has not -for -profit status, and is of a charitable nature,
it should be exempt from paying the various impact fees associated
with the building permit.
In reviewing Ms. Linscott's request, staff acknowledges that the
proposed kennel and caretaker apartment may not warrant a school
impact fee since the apartment will be occupied by senior citizens.
However, there are several trips per day associated with the
operation of an animal shelter such as trips by the caretakers,
feed delivery, and prospective adopters, and those new trips will

impact Carleton Road and the adjacent roadway network in addition
to already existing trips.
Staff recommends that the request for an impact fee waiver not be
granted.

Dogs & Cats Forever, Inc. is a tax-exempt, not for profit, local organization.
Its purpose is to build and maintain a facility where healthy animals will not
be put to sleep. The first priority will be to find them a loving and perman-
ent home. If this proves impossible, they will have a permanent home at the'
shelter. The number of animals in the later category will depend on the size
of the building. At the.present time, we expect to be able to house about 50
animals.
This organization is not connected with any other national or local society.
We have no paid officers and are not entitled to any public funds. The money
comes from dues, donations and fund raisers such as yard sales. Most of this
money has been held in escrow to run the shelter for the first year.
After over a year of writing letters and begging for land to be donated, I
bought 8.2 acres of land on Carleton Road, St. Lucie County. This is held in
a trust for the benefit of Dogs & Cats Forever, Inc. I had previously agreed
to donate $100,000 for the building. I am not a wealthy woman and this money
(which I earned and saved) is being taken from my retirement fund.
When this project was started we didn't realize the county would impose such
costly permit fees on a charitable organization. Our budget is so limited,
the fees are proving devastating. Would you possibly consider waving the impact
fee on the building so the project can continue?
The sooner the shelter is erected, the more money the county will save by not
having to care for so many animals.

organized in 1988 for the purpose of
building and maintaining a shelter for
homeless dogs and cats in Martin and
St. Lucie Counties
It will be built on 8.2 acres of land on
Carleton Road. This property is off
the Glades Cut -Off Road in St. Lucie
County, a couple of miles from Martin
County.
Our shelter, when completed, will be
founded on the principle of trying to
find good, adoptable and loving homes
for the animals.
Any health pet not adopted will have a
safe and permanent home at our
facility for the duration of its natural
life.
No animal at DOGS & CATS FOREVER,
INC. will ever be sold for research,
entertainment, or exploitation. We
strive to end animal abuse and
neglect.
This Charity is not connected with
any other Animal Society. It is a
not -for -profit, tax-exempt project,
totally dependent on donations and
endowments. Officers and members
are unpaid volunteers. All gifts are
used locally and are greatly
appreciated.

Enclosed is a copy of the letter sent to the St. Lucie County
Commissioners. Please read before continuing with this letter.
The County Commissioners have waived their part of the impact
fee that was estimated at over $2000. They said they could not
waive the portion, estimated at about $500., due the county
schools. This would have to be addressed to the school board.
There is a small one bedroom apartment attached to the shelter
for a senior citizen manager or a couple. No child will be
living here so will not present any hardship to the school
population.
At present, I pay taxes on my home, the lot next door plus the
8 acres for the shelter and have never had any children.
If you, as I often do, get the question why isn't something
being done for children, the answer is, I volunteered for over
10 years, one and two mornings a week at the high school.
As this shelter will in no way have any effect on the school's
budget expenses, I would appreciate your consideration in
waiving your part of the impact fee. It may make the difference
after years of hard work that the shelter can be built.

staff recommendation to

deny a waiver of impact fees associated
applications for a,shelter for dogs and cats and a caretaker
apartment.
Ms. Laura H. Linscott, Vice President and
Founder of the shelter,
the Board regarding
2180 Midtown Road, Port St, Lucie,•addressed
this request.
The Chairman submitted a letter from
Ms. Catheryn M. Libuha
Basilico for the record (see next page).
Com. Trefelner advised Ms. Linscott,
that all non-profit
organizations must pay impact fees and
the Board cannot place
itself in a difficult position.
Com. Culpepper asked if we had an exclusive agreement with the
other shelter and commented on the costs the County has encountered
and asked if there was anything that precluded the Board from
utilizing more than one shelter.
The County Attorney stated this budget year the Board could
contemplate utilizing more than one shelter.
The Board has acknowledged Ms. Linscott's request, no action was
taken.
Com. Culpepper stated that since the Board does not have a vehicle
that the Board not act on this request today, but that the Board
extend an invitation to Ms. Linscott to. participate in a manner
that the Board can give them remuneration for their activities once
they are up and operational.
It was moved by Com., Culpepper, seconded by Com. Trefelner, to
extend an invitation to Ms. Linscott to participate in the program
once the shelter is operational; and, upon roll, motiop carried
unanimously.
5. COUNTY ATTORNEY(1-2403)
A. Utility Transfer
The Board was asked to review the proposed Utility Transfer
Agreement between the City of Port St. Lucie and St. Lucie County.
The County Attorney reviewed the changes for the Board as well as
his memo.
It was moved by Com. Culpepper, seconded by Com. Trefelner to -
approve the Utility Transfer Agreement between the City of Port St.
Lucie and St. Lucie County, and authorized the Chairman to sign the
agreement; and, upon roll call, motion carried unanimously.
j B. Resolution Nos. 94-140 and 94-141((1-2779)
For consideration before the Board was Resolution No. 94-140, a .
resolution authorizing the issuance of Pollution Control Revenue
Refunding bonds Series 1994 B in a not to exceed amount of
$2.9,000,000. and delegating to the Chairman and Clerk of the Board
the authority to approve the final forms of documents and to
execute such documents.
