This letter responds to your January 21, 1994, request to
modify the Department of the Army permit (88IP-20142) that was
issued to "Harbour Cove Development, Inc." on July 19, 1988. You
have asked to extend the existing 810-foot pier e, distance of
81-feet, construct four finger piers, and install eight pilings.
The new work will establish six additional boat slips which will
be used by power boats.
Your request for modification was coordinated with the U.S.
Fish and Wildlife Service. Since you have proposed to abandon
construction of your previously authorized eight slip marina at
this site (Army permit 89IP-20125), the impacts from your
modification have been determined to be minimal. In addition,
the current configuration of the 810-foot pier, with the
associated unauthorized pilings that were the subject of our
November 4, 1992, Notice of Noncompliance, has been reviewed.

rescinded and approval is given for your permit to be modified

With this letter, Department of the Army permit 89IP-20125 is
abandoned and no work may proceed under its authority. You are
also advised that Department of"fhe Army permit 88IP-20142 is
conditioned as follows:
Within 30 days from the construction of the proposed pier
extension, the permittee will install an additional three
manatee warning signs along the pier. These signs, as well
as the sign originally required under the issued permit, must
be prominently displayed on the pier, clearly visible and
legible from a distance of at least 100 feet, and maintained
to ensure legibility.

The three new signs will be positioned to face waterward from
the pier and will be placed approximately 100 feet apart
beginning at the western most end of the pier. Each sign
must be mounted on a structure that will allow it to be
viewed from the water and not obstructed by docked vessels.
Within 7 days from installation of the signs, the permittee
will submit photographic documentation that the signs have
been installed (including the sign originally required.)
This documentation will include a drawing indicating the
location of the signs.
You are reminded that Department of the Army permit 89IP-
20142 expires on August 29, 1994. The authorized works must be
completed by this date. In addition, if the property associated
with the authorized work is ever transferred or sold, this permit
MUST be transferred to the new owner(s) and notification
submitted to this office. Although the construction window under
this permit is finite, the permit itself, with all conditions and
liabilities, does not expire.
You must attach this letter and the enclosed revised project
plans to the original permit. Thank you for your cooperation
with our permit program.
