HomeMy WebLinkAboutPDS ORDERPDS ORDER 19-014 SCANNED FILE NO.: MH 2201915487 BY St. Lucie County AN ORDER GRANTING APPROVAL FOR A CLASS A MOBILE HOME IN THE AG-5 (AGRICULTURAL — 5 DWELLING UNIT (20.9 ACRES) ZONING DISTRICT LOCATED ON CARLTON ROAD, ST. LUCIE COUNTY, FL WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request of Erica & Michael Crouse and made the following determinations: 1. Erica & Michael Crouse requested a Class A Mobile Home Permit to be defined as a detached single family dwelling unit in the AG-5 (Agricultural — 5 du/20.9 acres) Zoning District for the property described below and depicted on Exhibit A. 2. On March 13, 2019, mail notices were sent to all owners of property within 500 feet of the subject property. Within (14) calendar days of mailing the notification, no written objections were received by the Planning Department. 3. Staff has performed a detailed analysis of the request and determined it to be consistent with Section 11.05.02. — Class A Mobile Home Permits, of St. Lucie County Land Development Code. The analysis is found in the Planning and Development Services Director Memorandum entitled Crouse, Erica & Michael — Class A Mobile Home Permit dated April 12, 2019. NOW, THEREFORE, BE IT ORDERED: , A. The St. Lucie County Planning and Development Services Director hereby approves the request of Erica & Michael Crouse to define a Class A Mobile Home as a detached single family dwelling unit, on the property described in Part B, subjectto the following conditions of approval: 1. Prior to any improvements from Carlton Road onto to the subject property for access, the applicant will be required to submit for a driveway permit to the Water Quality Division. An application and fee shall be provided along with a site plan demonstrating the access and proposed improvements. 2. The applicant will be responsible for assuring adequate drainage so that the immediate community will not be adversely effected. No impediments to the existing pass through drainage from offsite properties are allowed without providing an analysis and obtaining County acceptance of the drainage that would be affected. 3. The development of a pond for the use of fill shall be in accordance with the Land Development Code and demonstrated on the building permit application plan. File No.: MH 2201915487 PDS Order 19-014 Page 1 4. Within 180 days of the Class A Mobile Home approval, all Category I invasive plant species shall be eradicated from the parcel. 5. The issuance of County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. B. The property on which this Class A Mobile Home Permit is being granted is described as follows: Legal Description: THE SOUTH HALF OF THE NORTHWEST ''Y4 OF THE NORTHWEST % SECTION 3, TOWNSHIP 37 SOUTH, RANGE 38 EAST, ST. LUCIE COUNTY, FLORIDA, LESS AND EXCEPT THE WEST 100 FEET FOR PUBLIC ROADS AND DRAINAGE. Parcel I D#: 4203-223-0001-000/7 C. The developer is advised as part of this Class A Mobile Home approval for Erica & Michael Crouse, including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate state and federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and South Florida Water Management District, and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developerto obtain a permit from a state orfederal agency and does not create any liability on the, part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. D. A copy of this Order shall be attached to the building permit, which shall be placed on file with the St. Lucie County Planning and Development Services Director.
