The Seller expressly reserves all contractors, mechanics and material man's Ilan rights which maybe asserted underany provision of law to secure payment of the contract price and mayassertand fix the same lien upon the real property upon which Installation is made. 2. In the event paymenlof this contract is enforced through attorney orbysuit or in bankruptcy orprobate proceedings, the sellermay mooverand the purchaser herebyagrees to pay reasonable attorney fees and costs of court. 3. As an Inducement for The Porch Factory to enter into this contract, the signer certifies that the above legal owner and address are correct. It Is also understood that there are no verbal agreements and all items discussed are covered by this written contract - this is a proposal until signed by an officer of the corporation at which time it becomes an executed contract. Any additions to this contract shall be covered by a change order. Additional costs of change orders shall be due and payable upon acceptance by the customer. Acceptance by the owner must be within l4 days oflhe proposal date prat the option of the seller,They buyer (customer) may cancel this contract within three(3) working days after signing. Any change orders must be in writing and received priortofinal measurement. 4. Afull two year guarantee against defect in purchased assemblies, materials and workmanship goes Into effect at completion of this contracted work covered by this contract and any change orders in effect. Anywarrantywork necessary, however, shall not be done until such time asfinal payment has been made to the seller, 5. In the event that any work performed by the contractor is wholly or partially destroyed or damaged due to fire, water, vandalism, or any other cause not under the control of the contractor, the loss shall be sustained by the owner, and shall not be the responsibility of the contractor. The undersigned acknowledges receipt of a true copy of this contract and acknowledges that he/she has read and understand the contents thereof and accepts the same on the terms and conditions as stated herein. This contract shall be binding upon parties hereto, their heirs, successors and assigns. Note: The quoted price is based on dimensions shown in sketch. Any variance will be proportionately calculated. Ifmaterialcost increase greaterthan 10%the costof material will be added to this contract. ACCORDING TO FLORIDA'S CONSTRUCTION LIEN LAW (SECTIONS 713.001-713.37, FLORIDA STATUTES), THOSE WHO WORK ON -YOUR PROPERTY OR PROVIDE MATERIALS AND SERVICES AND ARE NOT PAID IN FULL HAVE A RIGHT TO ENFORCE THEIR CLAIM FOR PAYMENT AGAINST YOUR PROPERTY. THIS CLAIM IS KNOWN AS A CONSTRUCTION LIEN. IF YOUR CONTRACTOR OR A SUBCONTRACTOR FAILS TO PAY SUBCONTRACTORS, SUB -SUBCONTRACTORS, OR MATERIAL SUPPLIERS, THOSE PEOPLE WHO ARE OWED MONEY MAY LOOK TO YOUR PROPERTY FOR PAYMENT, EVEN IF V, YOU HAVE ALREADY PAID YOUR CONTRACTOR IN FULL. IF YOU FAIL TO PAY YOUR CONTRACTOR, YOUR CONTRACTOR MAYALSO HAVE A LIEN ON YOUR PROPERTY. THIS MEANS IF A LIEN IS FILED YOUR PROPERTY COULD BE SOLD AGAINST YOUR WILL TO PAY FOR LABOR, MATERIALS, OR OTHER SERVICES THAT YOUR CONTRACTOR OR SUBCONTRACTOR MAY HAVE FAILED TO PAY. TO PROTECT YOURSELF, YOU SHOULD STIPULATE IN THIS CONTRACT THAT BEFORE ANY PAYMENT IS MADE, YOUR CONTRACTOR IS REQUIRED TO PROVIDE YOU WITH A WRITTEN RELEASE OF LIEN FROM ANY PERSON OR COMPANY THAT HAS PROVIDED TO YOU A "NOTICE TO OWNER."
