�p TERMS AND CONDITIONS
1. The Seller expressly reserves all contracto s, mechanics and material man's lien rights which may be asserted under any provision of law to secure payment of the contract price
and may assert and fiz the same lien upon the eel property upon which Installation is made.
2. In the event payment of this contract is enfo ed through aftorneyorby suit orin bankruptcy orprobate proceedings, the sellermay recoverand the purchaser hereby agrees to pay
reasonable attorney fees and costs of court.
3. As an Inducement forThe Porch Factory ld enter into this contract, the signer ceAlfies that the above legal owner and address are correct. It is also understood that there are no
verbal agreements and all items discussed arb covered by this written contract -this is a proposal until signed by an officer of the corporation at which time it becomes an executed
contract. Any additions to this contract shall be covered by a change order. Additional costs of change orders shall be due and payable upon acceptance by the customer.
Acceptance by the owner must be within 14 dgvs ofthepr000sal date orat the ontion of the seller. They buyer (customer) may cancel this contract within three(3)working days after
signing. Anychange orders must be in wntinyand received priorto final measurement.
4. Afull two year guarantee against defect in jrurchased assemblies, materials and workmanship goes into effect at completion of this contracted work covered by this contract and
any change orders in effect. Anywarrantywor necessary,however, shall not be done until such time as final pavment has been made to theseller
5. In the event that any work performed by lfl0 contractor Is wholly or partially destroyed or damaged due to fire, water, vandalism, or any other cause not under the control of the
contractor, the loss shall be sustained by the caner, and shall not be the responsibility of the contractor. The undersigned acknowledges receipt ofa true copy of this contract and
acknowledges that he/she has read and and rstand the contents thereof and accepts the same on the terms and conditions as stated herein. This contract shall be binding upon
parties hereto, their heirs, successors and ass gns. Note: The quoted price is based on dimensions shown in sketch. Any variance will be proportionately calculated. Ifmaterlal cost
increase greater than 10%the cost of material Will be added to this contract.
ACCORDING TO FLORIDWS CONSTRUCTION LIEN LAW (SECTIONS 713.001-713.37, FLORIDA STATUTES), THOSE WHO
WORK ON YOUR PROPERTY P, PROVIDE MATERIALS AND SERVICES AND ARE NOT PAID IN FULL NAVE A RIGHT TO
ENFORCE THEIR CLAIM FOR P YMENTAGAINST YOUR PROPERTY. THIS CLAIM IS KNOWN AS A CONSTRUCTION LIEN. IF
YOUR CONTRACTOR OR A UBCONTRACTOR FAILS TO PAY SUBCONTRACTORS, SUB -SUBCONTRACTORS, OR
MATERIAL SUPPLIERS, THOS PEOPLE WHO ARE OWED MONEY MAY LOOK TO YOUR PROPERTY FOR PAYMENT, EVEN IF
YOU HAVE ALREADY PAID YO R CONTRACTOR IN FULL. IF YOU FAIL TO PAY YOUR CONTRACTOR, YOUR CONTRACTOR
MAYALSOHAVEALIEN ONYO RPROPERTY. THIS MEANS IFALIEN ISFILED YOUR PROPERTY COULD BESOLD AGAINST
YOUR WILL TO PAY FOR LABO , MATERIALS, OR OTHER SERVICES THAT YOUR CONTRACTOR OR A SUBCONTRACTOR
MAY HAVE FAILED TO PAY. T PROTECT YOURSELF, YOU SHOULD STIPULATE IN THIS CONTRACT THAT BEFORE ANY
PAYMENT IS MADE, YOUR CO TRACTOR IS REQUIRED TO PROVIDE YOU WITH A WRITTEN RELEASE OF LIEN FROM ANY
PERSON OR COMPANY THAT AS PROVIDED TO YOU A "NOTICE TO OWNER." FLORIDRS CONSTRUCTION LIEN LAW IS
COMPLEX, AND IT ISRECOMM NDEDTHATYOUCONSULTANATTORNEY.
