E. This Order shall become effective upon the date of approval indicated below.

condition described in Section A above, all such appeals must be filed in writing with
the County Administrator within 30 days of the rendering of this Order, as described
in Section 11.02.03(B), St. Lucie County Land Development Code. Should an
appeal to this Order be filed, no permitting reviews or further administrative action
shall take place on the processing of this development project until the appeal is
resolved.
F. The Certificate of capacity, attached as Exhibit A, shall be valid for the same period
as this order. If this order expires or otherwise terminates, the certificate of capacity
shall automatically terminate.
G. A copy of this Order shall be mailed, return receipt requested to the developer and

1019.11.10.2 Without smoke -protected assembly seat-
ing. The minimum clear width of aisles and other
means of egress shall provide sufficient capacity in
accordance with the following:
1. At least 0.3 inch (7.6 mm) of width for each per-
son served shall be provided on stairs having
riser heights 7 inches (178 mm) or less and tread
depths II inches (279 mm) or greater, measured
horizontally between tread nosings.
2. At least 0.005 inch (0.127 mm) of additional stair
width for each person shall be provided for each
0.10 inch (2.5 mm) of riser height above 7 inch-
es (178 mm).
3. Where egress requires stair descent, at least
0.075 inch (1.9 mm) of additional width for each
person shall be provided on those portions of
stair width having no handrail within a horizon-
tal distance of 30 inches (762 mm).
4. Level or ramped means of egress with slopes not
exceeding 1:10, shall have at least 0.2 inch (5.1
mm) of clear width for each person served.
Ramps with slopes exceeding 1:10 shall have at
least 0.22 inch (5.6 mm) of clear width per per-
son.
5. Doorways shall have at least 0.2 inch (5.1 mm)
of clear width per person served.
1019.11.10.3 Smoke -protected assembly seating. The
minimum clear width of aisles and other means of
egress for smoke -protected assembly seating shall pro-
vide sufficient capacity in accordance with the follow-
ing table. The number of seats specified shall be with-
in a single assembly space and interpolation shall be
permitted between the specific values shown.

1019.11.10.4 Outdoor smoke -protected assembly
seating. The minimum clear width of aisles and other
means of egress, in inches, shall be not less than the

total occupant load served by the egress element multi-
plied by 0.08 when the egress is by stairs and multi-
plied by 0.06 when the egress is by ramps, corridors,
tunnels or vomitories.
1019.11.11 Guardrails. Guardrails shall be located along _
open -sided walking surfaces and elevated seating facili-
ties which are located more than 30 inches (762 mm)
above the floor or ground below. Guardrails shall be not
less than 42 inches (1067 nun) in height measured verti-
cally above the leading edge of the tread, adjacent walk-
ing surface or adjacent seatboards.
Exception: Guardrails at the front row of seats, which
are not located at the end of an aisle and where there is
no cross aisle, may have a height of not less than 26
inches (660 mm).
1019.11.12 Bleacher footboards. Bleacher footboards
shall be provided for all rows of seats above the third row
or beginning at such a point where the seating plank is
more than 2 ft (610 ram) above the ground or floor below.
When the same platform is used for both seating and
footrests, footrests are not required, provided each level or
platform is not less than 24 inches (610 mutt) wide. When
projected on a horizontal plane, there shall be no horizon-
tal gaps exceeding 1/4 inch (6.4 mm) between footboards.

BUSINESS
1020.1 Single exit. A single exit is permitted in Group B
occupancies when meeting the following conditions:
1. Maximum two stories in height.
2. Each floor area served by that exit does not exceed
3,500 sq ft (325 m2).
3. There are no more than 40 persons above the street
floor as determined by Table 1003.1.
4. The maximum distance of travel to the exit does not
exceed 75 ft (23 m).
1020.2 Locking. A key locking device may be used from the
egress side on the main exterior exit doors on Group B, occu-
pancies subject to the following:
I. There is a readily visible durable sign on or adjacent to
the door stating: THIS EXIT TO REMAIN
UNLOCKED WHEN THIS BUILDING IS OCCU-
PIED. The sign shall be in letters no less than 1 inch
(25.4 mm) high on a contrasting background.
2. The locking device must be of a type that will be read-
ily distinguishable as locked.
3. The main exit door is a single door or one pair of doors.
4. When unlocked, the door or both leaves of the pair
must be free. The use of the key locking device may be
revoked by the building official for due cause.

704.2.2 Partition requirements by occupancy
704.2.2.1 Group I Restrained
704.2.2.1.1 Smoke barriers shall be constructed in
accordance with 704.2.1.5.
704.2.2.1.2 All interior partitions in Type I and Type
II construction shall be of noncombustible construc-
tion.
704.2.2.2 Group I Unrestrained. Smoke barriers shall
have a minimum 1-hour fire resistance rating and be
constructed in accordance with 704.2.1.5.
704.2.2.3 Group R Residential. Nonfire rated parti-
tions may be constructed within small residential
care/assisted living facilities (Group R4 Small
Facility), one and two family dwellings and within
individual dwelling units unless required by Table 600.
The tenant separation in a two family dwelling shall
comply with 704.3.
Exception: Shaft enclosures in Group R4 occupan-
cies shall be enclosed and protected in accordance
with the requirements of Table 705.1.2.
704.2.3 Partitions within tenant space
704.2.3.1 Partitions dividing portions of stores, offices
or similar places occupied by one tenant only, which do
not establish an exit access corridor serving an occu-
pant load of 30 persons or more, and partial partitions,
may be temporary or permanent and constructed in
accordance with 609 without fire resistance, provided
that:
1. Their location is restricted by their method of
construction or by means of permanent tracks,
guides or other approved methods.
2. Flammability shall be limited to materials having
an interior finish classification as set forth in
* Table 803.3 for rooms or areas.
704.2.4 Exit access corridors. Fire resistance rating of
exit access corridors shall be in accordance with Table
704.2.4.

titions not rated for fire resistance may be used to sep-
arate tenants provided no area between partitions rated
at I hour or more exceeds 3,000 sq ft (278.7 m2).
704.3.2 In buildings with usable crawl spaces, tenant sep-
aration walls required to have a fire resistance rating shall
extend from the underside of the floor to the ground
below. A suitable foundation shall be provided at grade
level.
Exception: The wall need not be extended when the
floor above the crawl space has a minimum 1-hour fire
resistance rating.
704.4 Townhouse fire separation
704.4.1 Each townhouse shall be considered a separate
building and shall be separated from adjoining townhous-
es by a party wall complying with 704.4.2 or by the use of
separate exterior walls meeting the requirements of Table
600 for zero clearance from property lines as required for
the type of construction. Separate exterior walls shall

WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on
the testimony and evidence, including, but not limited to the staff report, has made the
following determinations:
NDW, Holdings, LLC petitioned for a change in zoning from the IL (Industrial,
Light) Zoning District to the I (institutional) Zoning District for a 1.93 acre parcel
depicted on Exhibit "A" and described in Part A below.
2. On March 17, 2016, the St. Lucie County Planning and Zoning Commission held
a public hearing on the petition, after publishing notice at least 10 days prior to
the hearing and notifying by mail all owners of property within 500 feet of the
subject property, and recommended that the Board of County Commissioners
approved the change in zoning from the IL (Industrial, Light) Zoning District to
the I (Institutional) Zoning District.
3. On May 3, 2016, this Board held a public hearing on the petition, after publishing
notice at least 10 days prior to the hearing and notifying by mail all owners of
property within 500 feet of the subject property.
4. As outlined in the County staff memorandum, the proposed change in zoning has
not satisfied the requirements of Section 11.06.03 of the St. Lucie County Land
Development Code and is inconsistent with the goals, objectives, and policies of
the St. Lucie County Comprehensive Plan.
5. The proposed change in zoning is not consistent with the existing and proposed
industrial use of property in the surrounding area.
