Chester,
County and city building departments cannot ask for documentation to show that mobile homes will
X maintain certain temperatures. The home manufacturer designed the home's thermal and HVAC duct
requirements, an engineering company approved the plans and the manufacturer put all pertinent
information on the data sheet located inside the home — all to the federal requirements. All information is
on the data sheet for the HVAC contractor to size the heating/air conditioning system. The home
manufacturer built the home to approved plans and the state of Florida's in plant inspectors made sure all
aspects of thehomewere correct.
Since mobile homes are regulated and preempted by the federal government, local building departments
cannot ask for construction information. Everything has already been done. Two references may help you
and they are found in the Florida Statutes and the Florida Building Code.

(9) The following buildings, structures, and facilities are exempt from the Florida Building Code as provided
by law, and any further exemptions shall be as determined by the Legislature and provided by law:
(a) Buildings and structures specifically regulated and preempted by the Federal Government.

102.2 Building.
The provisions of the Florida Building Code shall apply to the construction, erection, alteration, modification,
repair, equipment, use and occupancy, location, maintenance, removal and demolition of every public and
private building, structure or facility or floating residential structure, or any appurtenances connected or
attached to such buildings, structures or facilities. Additions, alterations, repairs and changes of use or
occupancy group in all buildings and structures shall comply with the provisions provided in Chapter 34 of
this code. The following buildings, structures and facilities are exempt from the Florida Building Code as
provided by law, and any further exemptions shall be as determined by the legislature and provided by law:
(a) Buildino and structures specifically regulated and preempted by the federal government.
