It depends on the waterway it is in (if it's within an aquatic preserve or not), and if it is on state lands or not. We have
different regulations on roofs over docks depending on those things. Also, if the tiki but roofing overhangs the footprint
of the dock we have to consider that additional overwater square footage that would get added to the dock square
footage when looking at it for review purposes.

Good morning Jason,
We have a permit in for a Tiki but on an existing dock. The dock is there for years and had a dock extension approved in
2010. Since there is no modification to the dock they would not need to have approval from FDEP for this tiki but
correct? Would you be able to answer that question and if not do you maybe have a contact person for me to use for
questions like this?

If your proposed tiki but is not on state lands, or over an aquatic preserve, it seems like it would
meet the exemption below:
(5) Dock, Pier, Boat Ramp and Other Boating -related Work -
(b) Installation of private docks, piers, and recreational docking facilities, and installation of
local governmental piers and recreational docking facilities, in accordance with section
403.813(1)(b), F.S. This includes associated structures such as boat shelters, boat lifts, and roofs,
provided:
1. The cumulative square footage of the dock or pier and all associated structures located over
wetlands and other surface waters does not exceed the limitations in section 403.813(1)(b), F.S.;
2. No structure is enclosed on more than three sides with walls and doors;
3. Structures are not used for residential habitation or commercial purposes, or storage of
materials other than those associated with water dependent recreational use; and

Good afternoon Emily,
I left you a voice message yesterday regarding a question from SLC building and zoning for a
tiki but I plan to build over an existing dock at 914 Jackson way ,Hutchinson Island 34949. In
response to your comments, we aren't in an aquatic preserve or on state lands and the actual tiki
but will not extend past the footprint of the existing dock. So if there is no criteria that would
require me to get a FDEP permit, could you please reply to this email stating that no permit is
required. Thank you in advance for your prompt attention in this matter.
