LUCIE COUNTY, FLORIDA WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: Leydi Hernandez petitioned for a Variance from the Provisions of Section 7.04.01 and Table 7-10 Lot Size and Dimensional Requirements of the St. Lucie County Land Development Code to permit the construction of a single family home which proposes a lot coverage by building of 3,366 square feet, thereby exceeding by 3.7 percent (366 sq. ft.) of the maximum 30 percent lot coverage by building required in the RS-4 (Residential, Single-Family-4 dulac) Zoning District. 2. On October 23, 2019, this Board held a public hearing on the petition, after publishing a notice of such hearing in the St. Lucie News Tribune, installing a sign on property and notifying by mail all owners of property within 5W feet of the subject property. 3. After consideration of the petitiori•and testimony presented during the public hearing, including staff comments, exhibits, and the standards of review for granting variances set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made the following determinations: The requested variance meets the standards of review as set forth in Section 10,01.02, St. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because: 1) The variance will not negatively impact the Indian River Estates Community or the adjacent neighbors, and 2) The requested variance will not increase traffic, endanger public safety, nor adversely affect drainage. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County, Florida: A. Leydi Hernandez petitioned for a variance to permit the development of a single-family residence to permit the construction of a single family home which proposes a lot coverage by building of 3,366 square feet, thereby exceeding by 3.7 percent (366 sq. ft.) of the maximum 30 percent lot coverage by building, for the property as depicted on Exhibit "A" and described below; as depicted on the boundary survey by Bennett Surveying, Inc., submitted to the Planning and Development Services Department and date stamped on September 17, 2019 as depicted on Exhibit'B": Fib No. aA 820192657 BOA ResolWon No. 19-014 Page 1 I.. Address: 5402 Hickory Drive, Fort Pierce, FL. 34982 Parcel Identification Number. 340&609-0220-000-0 B. Based on the evidence presented, the requested variance to exceed the 30 percent maximum lot coverage by 3.7 percent is approved. C. This Order shall become effective upon the date indicated below. An appeal from the Board of Adjustment's action must be filed with the courts of the State of Florida within thirty (30) days following the rendition of the decision of this order in accordance with Section 10.01.07, of the St. Lucie County Land Development Code. D. This variance shall expire twelve months from the date of adoption unless a building permit is approved, or an extension is granted in accordance with Section 10.01.06 of the St. Lucie County Land Development Code. E. This Order shall be recorded in the public records of St. Lucie County.
