In response to your May 7, 2003 correspondence please consider the following:
• Sufficient water and wastewater capacity exists for your proposed project.
Reservation of the capacity will require execution of a developer's agreement with
St. Lucie County and payment of all current applicable rates, fees and charges.
Building permits will, not be issued for the project until a developer's agreement
is entered into and all rates, fees and charges paid in full.
Reclaimed water is available to the project and sufficient irrigation will need to be
provided to dispose of reclaimed water in an amount equal to the wastewater
flows for the project.
This project is currently located within a Municipal Service Benefit Unit (MSBU) and additional
Equivalent Residential Connections will need to be assessed to the property consistent with the
density for the project. The MSBU was created to construct a central lift station and gravity
sewer lines to 'serve properties in the immediate area of your project. THE attached memorandum
from our MSBU Coordiantor indicates that the property is currently assessed for 56 ERC's for
the off -site utility improvements. The proposed density of your project will require an additional
87 ERC's to be assessed to the property consistent with the methodology adopted for the MSBU.

9 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
10 testimony and evidence, including but not limited to the staff report, has made the following
11 determinations:

13 1. Oceanique Development Company, through Agent Clayton Bennett, has applied for
14 major site plan approval for the project to be known as Oceanique Oceanfront, A
15 Condominium consisting of 144 residential units in two buildings for property located
16 on the east and west sides of North SR A-1-A, to the northeast of Regal Road and
17 east of Queens Cove Subdivision in the HIRD (Hutchinson Island Residential
18 District) Zoning District for the property described in Part B.

20 2. The Development Review Committee has reviewed the site plan for the proposed
21 project and found it to meet minimum technical requirements of the St. Lucie County
22 Land Development Code and to be consistent with the future land use maps from
23 the St. Lucie County Comprehensive Plan.

25 3. The proposed project is consistent with the general purpose, goals, objectives, and
26 standards of the St. Lucie County Land Development Code, the St. Lucie County
27 Comprehensive Plan, and the Code of Ordinances of St. Lucie County.

29 4. The proposed project will not have an undue adverse effect on adjacent property, the
30 character of the neighborhood, traffic conditions, parking, utility facilities, or other

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
A. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the site
plan for the project known as Oceanique Oceanfront, A Condominium, is hereby approved as
shown on the site plan drawings for the project prepared by Bennett & Fleis, Inc. dated January
23, 2004, and date stamped received by the St. Lucie County Community Development Director
on January 26, 2004, for the property described below, subject to the following conditions:
Pursuant to Section 3.01.03(AA)(7)(A) of the St. Lucie County Land Development
Code, the first thirty-nine (39) units of this project will be subject to only the
standard road impact fee for the type of proposed construction. The remaining
one -hundred and five (105) units will be subject to the Alternate Development Fee
of $2,336 per dwelling unit, which includes the required road impact fee. All 144
units will be subject to all other required impact fees and any other fee or
assessment that St. Lucie County may lawfully assess.
Z All gopher tortoises found on site shall be relocated by the applicant's
representative, in accordance with all applicable state regulations. The gopher
tortoises shall not be subject to an incidental take permit unless a permit for
onsite relocation is denied and the gopher tortoises test positive for Upper
Respiratory Tract Disease (URTD). Copes of all correspondence and permits shall
be provided to the St. Lucie County Environmental Resources Division.

C. The approvals and authorizations granted by this Resolution for the purpose of obtaining
building permits on this property, shall expire on May 11, 2005, unless building permits have been
issued or an extension in accordance with Section 11.07.05(F) of the St. Lucie County Land
Development Code has been granted.
D. The Final Site Plan approval granted under this resolution is specifically conditioned to the
requirement that the petitioner, Oceanique Development Company, Inc., including any successors in
interest, shall obtain all necessary development permits and construction authorizations from the
appropriate State and Federal regulatory authorities, including but not limited to; the United States
Army Corps of Engineers, the Florida Department of Environmental Protection, and the South
Florida Water Management District, prior to the issuance of any local building permits of

E. A copy of this resolution shall be attached to the site plan drawings described in Part A,
which plan shall be placed on file with the St. Lucie County Growth Management Director.
F. The certificate of capacity, attached as Exhibit A, shall be valid for the same period as this
order. If this order expires or otherwise terminates, the certificate of capacity shall automatically
terminate.
G. A copy of this Order shall be mailed, return receipt requested to the developer and agent of
record as identified on the site plan applications.
H. A copy of this Order shall be attached to the site plan drawings described in Section A, which
plan shall be on file with the St. Lucie County Growth Management Director.
This Order shall be recorded in the Public Records of St. Lucie County.

OBSERVATIONS
Observed concrete pour of elevated tennis court and tie -beams at stairwells above parking garage. The tennis court &
stairwell tie -beams were poured with 420+/- cu. yds. of 4,000p.s.i. concrete, mix #771501, with #57 coarse aggregate
and high range water reducer additive. The slab was poured to a thickness of 7". Concrete finishers used 7" chair rail
measuring stick to determine slab thickness during concrete placement. All concrete was placed within 90 minutes from
time batched. Any water added to concrete mix at job site was done so by Tarmac supervisory personnel on site.
Observed Universal Engineering field technician test concrete slump for each 50cu. yds. of design mix placed and cast 5
test cylinders. Concrete for slump testing was taken from truck chute. Concrete slump range was 5-1/2" to 8-1/2" with a
average concrete temperature of 88 degrees. Concrete was placed using a 5"/61m concrete pump and consolidated during
placement using a 1-3/4" mechanical vibrator.

spread footer that had already been poured. Bars were appropriate length to allow proper lap for the next lift and were
located in the cells as per the structural drawings. Concrete was to be placed using a 2" pump for later in the day.

I am in receipt of your faxed letter dated August 25, 2005 regarding the above permit.
Please be assured that we are processing this as quickly as possible. This permit was
submitted to St. Lucie County Permitting on May 14, 2004 and was reviewed by the
Building Department and on November 29, 2004 it was sent to St. Lucie County Fire
Department for their review. This permit was returned from the Fire Department on
August 18, 2005 and was forwarded to the Zoning Department on this same date.
The Zoning Department has had this permit for 5 business days and this is not an
inordinate amount of time for a review on commercial construction for an approved Site
Plan. Please note that the Fire Department has held your plans from November 2004
until August of 2005. The Fire Department review is a separate review and they are a
State Agency, separate from St. Lucie County Building Department.
The Zoning Department will need the following items in order to issue the above permit.

The review and processing of the above permit application seems to be taking an
inordinate amount of time. We submitted changes to the plans in June and for
whatever reasons we do not have a permit yet.
As you are aware we have been monitoring the progress of our application
regularly and in our conversation of today you checked on the status of our
application and said that it should be ready by mid next week. You also
mentioned that there were a few issues that needed resolve, and as I understood
you did not think they were with us, but rather within the County system.
We need to start this building in conjunction with other onsite construction so as
not to incur costly time delays. Therefore it is with this in mind that we request
your assistance in the progress of our permit application so that we indeed may
pick up this permit by no later than mid next week.
