) V°, 5 " _ TERMS AND CONDITIONS
1. The Seller expressly reserves all contractors, mechanics and material man's lien rights which may be asserted under any provision of law to secure payment ofthe contract price
and may assert and fix the same lien upon the real property upon which Installation is made.
2. In the event payment of this contract is enforced through aftomeyorby suit orin bankmptcyorprobate proceedings, the sellermay recoverand the purchaserherebyagrees to pay
reasonable attomeyfees and costs of court.
3. As an Inducement forThe Porch Factory to enter into this contract, the signer certifies that the above legal owner and address are correct. It is also understood that there are no
verbal agreements and all items discussed are covered by this written contract -this Is a proposal unfit signed by an officer of the corporation atwhich time it becomes an executed
contract. Anyaddibons to this contract shall be covered by a change order. Additional costs of change orders shall be due and payable upon acceptance by the customer.
Acceptance bythe ownermust be within 14days ofthe proposal date oratthe option ofthe seller. They buyer(customer) maycancel this contraclwithin three(3)working daysafter
signing. Anychange orders must be in writing and received priorto final measurement.
4. Afull two year guarantee against defect in purchased assemblies, materials and workmanship goes into effect at completion of this contracted work covered by this contract and
any change orders In effect. Anywarrantywork necessary, however, shall notbe done until such time asfinal Payment has been made to the seller.
5. In the event that any work performed by the contractor ls.wholly or partially destroyed or damaged due to fire, water, vandalism, or any other cause not under the control of the
contractor, the loss shall be sustained by the owner, and shall not be the responsibility of the contractor. The undersigned acknowledges receipt of a true copyofthis contract and
acknowledges, that helshe has read and understand the contents thereof and accepts the same on the terms and conditions as stated herein. This contract shall be binding upon
parties hereto, theirheirs, successors and assigns. Note: The quoted price is based on dimensions shown in sketch. Anyvar nce will be proportionatelycalculated. Ifmaterialcost
Increase greaterthan 10%the costof material will be added to this contract.
ACCORDING TO FLORIDA'S CONSTRUCTION LIEN LAW (SECTIONS 713.001-713.37, FLORIDA STATUTES), THOSE WHO
WORK ON YOUR PROPERTY OR PROVIDE MATERIALS AND SERVICES AND ARE NOT PAID IN FULL HAVE A RIGHT TO
ENFORCE THEIR CLAIM FOR PAYMENT AGAINST YOUR PROPERTY. THIS CLAIM IS KNOWN AS A CONSTRUCTION LIEN. IF
YOUR CONTRACTOR OR A SUBCONTRACTOR FAILS TO PAY SUBCONTRACTORS, SUB -SUBCONTRACTORS, OR
MATERIAL SUPPLIERS, THOSE PEOPLE WHO ARE OWED MONEY MAY LOOK TO YOUR PROPERTY FOR PAYMENT, EVEN IF
YOU HAVE ALREADY PAID YOUR CONTRACTOR IN FULL. IF YOU FAIL TO PAY YOUR CONTRACTOR, YOUR CONTRACTOR
MAYALSO HAVE A LIEN ON YOUR PROPERTY. THIS MEANS IF A LIEN IS FILED YOUR PROPERTY COULD BE SOLDAGAINST
YOUR WILL TO PAY FOR LABOR, MATERIALS, OR OTHER SERVICES THAT YOUR CONTRACTOR OR A SUBCONTRACTOR
MAY HAVE FAILED TO PAY. TO PROTECT YOURSELF, YOU SHOULD STIPULATE IN THIS CONTRACT THAT BEFORE ANY
PAYMENT IS MADE, YOUR CONTRACTOR IS REQUIRED TO PROVIDE YOU WITH A WRITTEN RELEASE OF LIEN FROM ANY
PERSON OR COMPANY THAT HAS PROVIDED TO YOU A "NOTICE TO OWNER." FLORIDA'S CONSTRUCTION LIEN LAW IS
COMPLEX, AND IT IS RECOMMENDED THATYOU CONSULTANATTORNEY.
