AN ORDER COUNTY LAND DEVELOPMENT CODENG A VARIANCE R NORTH FORK OF THE STOM SECTION (LU E RIVER
SHORELINE SET BACK REQUIREMENTS FOR RICHARD AND LORRAINE LEWIS

WHEREAS, the St. Lucie County Growth Management Director has m1iwed the
application for a Variance from Section 6.02.02(B)(2](a) and matle the following
determinations:
1. Richard and Lorraine Lewis, presented a petition for a variance from the
Provisions of Section 6.02.02(B)(2)(a), St. Lucie County Land Development Code
for the purpose of building a single family residence in the project known as Hidden
River Estates in St. Lucie County, Florida. The subject property is located on part of
Lot 1, Block 2, Hidden River Drive in Port SL Lucie, Florida
2. On May 11, 2006, the Growth Management Director and the Environmental
Resources Director reviewed the application requesting a variance from Section
- 6.02.02(B)(2)(a)3 St. Lucie County Land Development Code to permit the
development of one single-family residence that lacks a maldmum of 10 feet of the
minimum 60 foot rear setback from the mean high water line for lots of record
plattetl as of August 1, 1989, which are located along the North Fork of the St. Lucie
River.
3. After consideration Of the application presented, including staff comments and the
standards of review for granting variances set out in Section 10.01.30, SL Lucie
County Land Development Code, the Growth Management Director and the
Environmental Resources Director have made the following determinations:
1. The requested variance meets the standards Of review as set forth in
Section 10.01.30 of the St. Lucie County Land Development Code and is
not in conflict with the goals, objectives, and policies of the SL Lucie
County Comprehensive Plan.
2. The requested variance is necessary to allow development of the site
for a single family residence.
3. Grantingof this variance to allow for a 40 foot buffer will not adversely
affect the North Fork of the SL Lucie River.

4. The applicant shall replant the remaining forty feet of buffer with
appropriate native vegetation including ground cover, under story and
canopy. The plantings shall be approved by the Environmental Resources
Department and shall be Installed prior to release of the Certificate of
Occupancy for the property.
NOW, THEREFORE, BE IT ORDERED:
A. The petition for a Variance of 10 feet from the provisions of Section
6.02.02(B)(2)(a), St. Lucie County Land Development Code, North Fork of the St.
Lucie Rivershoreline setback standards, submitted by Richard and Lorrainetewis
for the purpose of building a single family residence in the Hidden River Estates
project, is granted for the property described below.

B. This variance shall not be valid for a period longer than twelve months from the date
of this Resolution —May 26, 2006 - unless a building permit or other applicable local
site development permit effecting the restoration of the effected shoreline area is
issued prior to the expiration of that twelve month period.
C. This Order shall become effective upon the date of approval indicated below.
Should the property owner, developer, or authorized agent wish to appeal any
condition described in Section A above, all such appeals must be filed in writing vrith
the County Administrator within 30 days of the rendering of this Order, as described
in Section 11.02.03(B), St. Lucie County Land Development Code. Should an
appeal to this Order be filed, no permitting reviews or further administrative action
shall take place on the processing of this development project until the appeal is
resolved.
D. This Order shall be recorded in the Public Records of St Lucie County.
