AN ORDER GRANTING APPROVAL FOR A MINOR ADJUSTMENT
TO A FINAL PLANNED UNIT DEVELOPMENT SITE PLAN KNOWN
AS TROPICAL ISLES PUD
8 WHEREAS, the St. Lucie County Planning and Development Services Director has
9 reviewed the application for a Minor Adjustment to the Final Planned Unit
10 Development (PUD) Site Plan submitted by Tropical Isles Co-op, Inc., and the
11 comments of the St. Lucie County Planning and Development Services Department,
12 Planning Division staff on this application and made the following determinations.

14 1. Tropical Isles Co-op, Inc. requested a Minor Adjustment to the Final Planned
15 Unit Development (PUD) Site Plan to allow for accessible handicap structures
16 to encroach a maximu of 15,feetantio the required, runt and`stree_ Is 7eeard
17 setbacks of 25 feet for ski gie family residential lots. The subject 75.13 acre
18 PUD consists of 334 single family residential lots and is located approximately
19 213 mile south of Midway Road, on the east side of U.S. Highway No. 1 as
20 described in Part B below.

22 1. The Planning and Development Services Department, Planning Division staff
23 reviewed the site plan for the proposed project and found it to meet the
24 technical requirements of the St. Luce County Land Development Code and
25 to be consistent with the St. Lucie County Comprehensive Plan. Section 7.04
261r;: of the St. Lucie County Land Development Code allows for reductions in
27 required yard setbacks for accessible handicap structures.

29 2. The improvements allowed per this site plan adjustment will not increase the
30 dimension of any structure by more than 25 percent, alter any structure by
31 more than 100 feet, nor increase residential density, change any circulation
32 element, reduce any common open space and should have no impact to
33 minimum landscaping requirements.

35 3. The project will not have an undue adverse effect on adjacent property, the
38 character of the neighborhood, traffic conditions, parking, utility facilities, or
37 other matters affecting the public health, safety and general welfare.

39 4. All reasonable steps have been taken to minimize any adverse effect of the
40 proposed project on the immediate vicinity through building design, site
41 design, landscaping and screening.

38 Should the property owner, developer or authorized agent wish to appeal any
39 condition described above, all such appeals must be filed in writing to the
40 Board of Adjustment within 30 days of the rendering of this Order, as
41 described in Section 11.02.033, St. Lucie County Land Development Code.
42 Should an appeal to this Order be filed, no permitting reviews or further

administrative action shall take place on the processing of this development
project until the appeal is resolved.
D. A copy of this Order shall be attached to the site plan drawings on file with the
St. Lucie County Planning and Development Services Director and mailed,
return receipt requested, to the developer and agent of record as identified on
the site plan application.
E. This Order shall be recorded in the Public Records of St. Lucie County.
