Modification of Antenna Facilities
Dear Sir/Madam:
SCANNED
BY
St. Lucie County
T-Mobile South LLC, as successor in interest to Omnipoint Holdings, d/b/a T-Mobile (Tenant") and
subsequently, assigned to MD7 Capital Three, LLC ("Owner") entered into a certain PCS Site Agreement
("the Lease") on May 2, 2002, for the building located at 9650 South Ocean Drive, Jeason Beach FL
34957 (the "Premises"), upon which T-Mobile operates wireless antenna facilities.
Pursuant to the Agreement, T-Mobile has the right to alter, replace, expand, enhance, modify or
upgrade the antenna facilities at any time during the term of the Lease with Landlord's approval, which
cannot be unreasonably withheld, conditioned or delayed.
T-Mobile needs to expand the antenna facilities by installing three new/additional antennas and three
RRUs described in attached Plans.
To confirm your approval of the proposed modifications to the antenna facilities, please sign and date
both counterparts of this letter, keep one for your records and return the other to T-Mobile in the
enclosed envelope.
If you have any questions, please contact Dan Ault at 2329-776-5884. Thank you for your cooperation
and attention to this matter.
I have enclosed a paid FedEx return for your convenience.
Sincere
Dan Ault

Ref. T-MOBILE
7-31-2014
letter dated 12-8- 2014 and drawings dated
1. We should have a meeting prior to any work being done. We
need to remind them the person at the last meeting that was
to run the last project no longer worked for T Mobile the next
day.
2. They need to assure us that they have or will remove all
antennas no longer in use and the parapet wall will be
repaired to insure a weather tight condition.
3. They need to provide us with a letter from a structural
engineer registered in the state of Florida, that these
antennas as designed and secured to our building, are
capable of withstanding hurricanes and all other forces, and
that these forces will not impose any damage to our building.
4. They need to provide us with a letter stating that any and
all damage to our building as a result of their antennas
and all other equipment will be their responsibility to correct;
including any damage to other people's property.
This letter should be reviewed by our attorney to confirm that
we are protected in all ways.
5. Given the past performance of their workers and `
subcontractors not adhering to what was agreed
to at our meetings, we should request a security deposit.
Again, let's consult with our attorney
6. We need to receive from them, a list of all sub -contractors
they intend to use, and require that all these
contractors, including T Mobile, submit certificates of
insurance listing the Princess as co-insured.
7. T-Mobile needs to understand that their work can not
interfere with the ongoing work being done by Carey
Construction .
