LUCIE COUNTY GRANTING APPROVAL FOR MINOR SITE PLAN TO BE KNOWN AS FAMILY DOLLAR WHEREAS, the St. Lucie County Planning & Development Services Director has reviewed the request for a Minor Site Plan submitted by VAZ, Inc. on behalf of Family Dollar and made the following determinations: VAZ Inc., on behalf of Family Dollar requested a Minor Site Plan for a 8,593 square foot discount retail store. The subject 1.10 acre property is located at the southwest comer of Lennard Road and Melaleuca Boulevard.. The Future Land Use is IND (Industrial) and the underlying Zoning District is CG (Commercial General). Water and wastewater service will be provided by the City of Port St. Lucie Utilities. 2. On February 4, 2014 the Board of County Commissioners through Resolution No. 14-018 approved a Zoning Atlas Amendment from IL, Industrial Light to CG, Commercial General. 3. The Development Review Committee has reviewed the Minor Site Plan for the proposed project pursuant to Section 11.02.03 and found it to meet technical requirements of Section 11.02.07 of the Land Development Code and to be consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan. 4. Planning staff has performed a detailed analysis of the project and determined it to be consistent with the St. Lucie County Land Development Code and Comprehensive Plan. The analysis is found in the Planning and Development Services Department Memorandum entitled Family Dollar - Minor Site Plan dated November 26, 2014. 5. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 6. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 7. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 8. The applicant has applied for and received a Certificate of Capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the Minor Site Plan to be known as Family Dollar is hereby approved as shown on the Minor Site Plan drawings prepared by The Velcon Group Inc. dated September 17, 2014 and received by the St. Lucie County Planning & Development Services Department on November 18, 2014 for the property described in Paragraph B subject to the following conditions: 1. Prior to the issuance of a building permit, all plans (including architectural elevations and signage) shall be reviewed and approved by the City of Port St. Lucie Planning Department for consistency with Community Redevelopment Agency (CRA) guidelines. 2. Within 60 days after receiving Minor Site Plan approval, the 26-footwide north -south cross access easement as shown on the Minor Site Plan shall be recorded with the St. Lucie County Clerk of Courts. B. The approvals granted by this administrative order shall expire on December 1, 2016 unless building permits are issued or an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The developer is advised as part of this Minor Site Plan approval for VAZ, Inc. on behalf of Family Dollar, including any successors in interest, the developer shall obtain all applicable development permits and construction authorizations from the appropriate State and Federal and local regulatory agencies including, but not limited to, the United States Army Corps of Engineers, the Florida Department of Environmental Protection, South .Florida Water Management District, Port St. Lucie Utility Systems Department and the St. Lucie County Environmental Resources and Building Departments prior to the commencement of any development activities on the property described in Part B. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Planning & Development Services Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. F. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. G. This order shall be recorded in the Public Records of St. Lucie County.
