36 6. On April 15, 2014, the Planning and Development Services Director through PDS Order
37 14-021 in accordance with adopted Ordinance 2013-43 amending the text of the Land
38 Development Code to allow a two year administrative extension of approved site plans
39 granted an extension and provided a new date of expiration of December 31, 2015.

8 WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for site
9 plan approval submitted by Knight, McGuire & Associates, Inc., reviewed the comments of the St.
lo Lucie County Development Review Committee on this application, and made the following
11 determinations:

13 1 . Ocean Palms is a proposed 15-unit residential condominium consisting of 2
14 buildings located on the east side of North SR A-1-A in the HIRD (Hutchinson Island
15 Residential District) Zoning District.

17 2. The Development Review Committee has reviewed the site plan for the proposed
is project and found it to meet technical requirements of the Land Development Code
19 and to be consistent with the St. Lucie County Comprehensive Plan.

21 3. The project is consistent with the general purpose, goals, objectives, and standards
22 of the St. Lucie County Comprehensive Plan and the St. Lucie County Land
23 Development Code.

25 4. The projectwill not have an undue adverse effect on adjacent property, the character
26 of the neighborhood, traffic conditions, parking, utility facilities, or other matters
27 affecting the public health, safety, and general welfare.

29 5. All reasonable steps have been taken to minimize any adverse effect of the
30 proposed project on the immediate vicinity through building design, site design,
31 landscaping, and screening.

33 6. The project will be constructed, arranged, and operated so as not to interfere with
34 the development and use of neighboring property, in accordance with applicable
35 district regulations.

37 7. The project is to be served by adequate public facilities and services.

39 8. The applicant has applied for and received a Certificate of Capacity, a copy of which
40 is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County

A. Pursuant to Section 11.02.03 (D) of the St. Lucie County Land Development Code, the
proposed minor site plan to be known as Ocean Palms, is hereby approved as shown on
the site plan drawings for the project prepared by Knight, McGuire & Associates, Inc.,
November 15, 2005, and received bythe St. Lucie County Growth Management Director on
November 15, 2005, on the property described below, subject to the following conditions:
Prior to the issuance of a Vegetation Removal Permit, an executed (signed)
copy of the easement document shall be provided to the St. Lucie County
Environmental Resources Department. Within 60 days of the issuance of a
Vegetation Removal Permit, a recorded copy of the easement document
shall be required to be provided.
2. Prior to the issuance of a Vegetation Removal Permilt, a pro -construction
meeting (or "Contractor Sensitivity Training") with the environmental
consultant and the construction personnel (Plant Manager, Project
Manager, Project Supervisors and all Field Supervisors) be conducted to
cover the preserve area locations and barricadesiprotections during
construction and gopher tortoise identification and protocol should any be
observed during construction since they inhabited the site as recent as
2004.
B. The property on which this minor site plan is being approved is described as follows:

D. The Final Site Plan approval granted under this resolution is specifically conditioned to the
requirement that the petitioners, David Huck, ODI, LLC., including any successors in
interest, shall obtain all necessary development permits and construction authorizations from
the appropriate State and Federal regulatory authorities including, but not limited to; the
United States Army Corps of Engineers, the Florida Department of Environmental
Protection, and the South Florida Water Management District, prior to the issuance of any
local building permits of authorizations to commence development activities on the property
described in Part A.
E. A copy of this Order shall be attached to the site plan drawings described in Part A, which
plan shall be placed on file with the St. Lucie County Growth Management Director and
mailed, return receipt requested to the developer and agent of record as identified on the
site plan applications.
F. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this
order. If this order expires or otherwise terminates, the certificate of capacity shall
automatically terminate.
G. This order shall be recorded in the Public Records of St. Lucie County.
ORDER effective the 15' day of February 2006.
