WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the request for development order extension timely submitted and in accordance with the provisions of Chapter 2011-142, Laws of Florida on behalf of Home Dynamics Sedona, LLC.and has made the following determinations: 1. On, October 17, 2006, the St. Lucie County Board of County Commissioners granted approval through Resolution No. 06-295, to the petition of Home Dynamics Sedona LLC, for the Final Planned Unit Development Site Plan for the project known as Sedona PUD, on property located at the southwest comer of Edwards Road and South 25th Street. 2. On October 7, 2008, the Board granted a 12-month extension to the Final Planned Unit Development through Resolution 08-230 w ) ith the new date of expiration being October 17,2009. 3. On December 6, 2009, the Board granted an additional 12-month extension to the Final Planned Unit Development through Resolution 09-213with the new date of expiration being October 17, 2010. 4. On January 22, 2010, the Planning and Development Services Director granted through GM Order 10-003 an extension for two years pursuant to Chapter 2009-96, Laws of Florida from its date of scheduled expiration, September 15, 2011, With the new date of expiration being October 17, 2012. 5. On December 3, 2010 the Planning and Development Services Director granted through PDS Order No. 10-028 an extension for two years pursuant to Chapter 2010-147, Laws of Florida with the new date of expiration being October 17, 2014. 5. On, June 13, �01 1, Florida Governor Rick Scott, Issued Executive Order (EO) No. 11 - 128 (as extended by EO Nos. 11-172 and 11-202) declaring a State of Emergency for Florida due to significant drought and wildfire conditions. 7. Section 252.363 Florida Statutes provides that any local government issued File No.: BCC 120124391 PDS Order No. 12-0`13 January 27, 2012 Page 1 development order or permit may be extendedfrom the period remaining for the duration of the emergency declaration plus six months. 8. The Act requires that a specific written notice be filed with the issuing authority within ninety days after the termination of the declaration of emergency. The deadline to file the requisite Notice is February 1, 2012. 9. The applicant applied for an extension on January 24, 2012. NOW, THEREFORE, BE IT ORDERED by the St. Lucie County Planning and Development Services Director: A. Pursuant to the provisions of the State of Emergency Act the Planned Unit Development Site Plan approval for the project known as Sedona PUD has been found to be eligible for an additional extension such that the approval granted under PDS Order No. 10-028 is extended for ten months, and twenty-two days and is now scheduled to expire September 8, 2015. B. All terms and conditions of Resolution No. 06-295, shall continue to remain in full force and effect unless otherwise amended. C. The property on which this development order extension is being granted is described as follows: LEGAL DESCRIPTION: A PORTION OF THE NORTHEAST QUARTER (NE 1/4) OF THE NORTHEAST QUARTER (NE 1/4) OF SECTION 29, TOWNSHIP 35 SOUTH, RANGE 40 EAST, DESCRIBED AS FOLLOWS: COMMENCE AT THE NORTHEAST CORNER OF SAID SECTION 29; THENCE SOUTH 89 DEGREES 59'07" WEST,ALONG THE NORTH LINE OF SAID SECTION 29, A -DISTANCE OF 80.00 FEET; THENCE SOUTH 00 DEGREES 06'36' EAST, A DISTANCE OF 60.00 FEET, TO THE POINT OF BEGINNING; THE FOLLOWING FIVE (5) COURSES ARE ALONG THE WEST RIGHT-OF-WAY LINE OF HAWLEY ROAD (SOUTH 25th STREET): THENCE CONTINUE SOUTH 00 DEGREES 06'36' EAST, A DISTANCE OF 479.64 FEET; THENCE SOUTH 07 DEGREES 56-16" WEST, A DISTANCE OF 75.76 FEET; THENCE SOUTH 00 DEGREES 37'50" EAST, A DISTANCE OF 57.42 FEET, THENCE SOUTH 11 DEGREES 56'23- EAST, A DISTANCE OF 49.19 FEET; THENCE SOUTH DO DEGREES 06'35" EAST, A DISTANCE OF 668.04 FEET; THENCE SOUTH 89 DEGREES 19'2U'WEST, ALONG THE SOUTH LINE OF THE NORTHEAST QUARTER (NE 1/4) OF THE NORTHEAST QUARTER (NE 1/4) OF SAID SECTION 29, A DISTANCE OF 1221.26 FEET; THENCE NORTH 00 DEGREES OT41" EAST, ALONG THE EAST RIGHT-OF-WAY OF THE NORTH ST. Parcel ID# 2429-111-0001-000/1, 2429-111-0003-000/5, and 2429-111-0002- 000/8. D. The conditions set forth in Part B are an integral non severable part of the site plan approval granted by Resolution No. 06-295. If any condition set forth in Part B is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, this development order extension approval granted by this resolution shall become null and void.
