Epoxy -Tire BET epoxy is a two -component, tow odor, 1:1 ratio, 100% solids epoxy -based adhesive for use as a high strength, non -shank anchor grouting material. Resin and hardener are dispensed and mixed Simultaneously through the mixing nozzle. SET meets the ASTMC•881.90 specification for Type 1, 11, IV and V. Grade 3, Class 6, C and 0. SET is the first material to meet IC60 AP58 standards. APPLICATION: • Surfaces to receive epoxy must be clean and dry surfaces. • Epoxy should not be Installed in or through standing water. • The base material temperature must be 40° F or above at the time of installation. For best results, material should be 700 - 80° F at The time of application. • Cartridges should not be immersed in water 10 facilitate warming. To warm cold material. the cartridges should be stored in a warm, uniformly heated area or storage container for a sufficient lime to allow epoxy to warm completely. • Mixed material in nozzle will harden in 7 to 10 minutes at a temperature of 40' F or above. Fill hole halfway, starting from the bottom of the hole to avoid air pockets. Withdraw nozzle as hole fills up. • Anchors must be clean and oil free. Activity Description. Theproject consists of the creation of a driveway associated with a single-family residence and consists of the following activities: (1) the deposition of clean fill on 2,526 sq. ft. (0.058 acres) of a mangrove slough, (2) the installation of a 24-in. culvert, (3) the creation of a mangrove mitigation area, and (4) the removal exotic and invasive vegetation from the site. Activity Location. The site is a private lot, parcel 25-29-343-0003-000/5, located at SR AIA, abutting the north side of St. Lucie Co. Middle Cove Park, Hutchinson Island (Class III waters of the state) and is located at the following coordinates: Section 29, Township 35S, Range 42E; Latitude 27a23'47"N, Longitude 80' 15'49"W. Proprietary Authorization. As staff to the Board of Trustees, the Department has reviewed the activity described above -and has determined that the activity qualifies fQ0.%xansent to use sovereign submerged lands as long as the work is located within the boundaries as described herein and is consistent with the terms and conditions herein. Therefore, consent is hereby granted, pursuant to Chapter 253.77, Florida Statutes, to perform the activity on the specified sovereign submerged lands. This permit constitutes certification of compliance with water quality standards under Section 404 of the Clean Water Act, 33 U.S.C. 1344, and constitutes a finding of consistency with Florida's Coastal Zone Managemedt Program, as required by Section 307 of the Coastal Management Act. All activities authorized by this permit shall be implemented as set forth in the plans, specifications and performance criteria as approved by this permit. Any deviation from the permitted activity and the conditions for undertaking that activity shall constitute a violation of this permit and Part IV, Chapter 373, F.S. 2. This permit or a copy thereof, complete with all conditions, attachments, exhibits, and modifications shall be kept at the work site of the permitted activity. The permittee shall notify the Department of the anticipated construction start date within 30 days of the date that this permit is issued. At least 48 hours prior to commencement of activity ri authorized by this permit, the permittee shall submit to the Department an "Environmental �y Resource Permit Construction Commencement' notice (Form No. 62-343.900(3), F.A.C.) indicating the actual start date and the expected completion date. 5. When the duration of construction will exceed one year, the permittee shall submit construction status reports to the Department on an annual basis utilizing an "Annual Status Report Form" (Form No. 62-343.900(4), F.A.C.). Status Report Forms shall be submitted the following June of each year. 6. Within 30 days after completion of construction of the permitted activity, the permittee shall submit a written statement of completion and certification by a registered professional engineer or other appropriate individual as authorized by law, utilizing the supplied "Environmental �n L Resource Permit As -Built Certification by a Registered Professional' (Form No. 62-343.900(5), F.A.C.). The statement of completion and certification shall be based on on -site observation of n construction or review of as -built drawings for the purpose of determining if the work was o �V. completed in compliance with permitted plans and specifications. This submittal shall serve to J�M i notify the Department that the system is ready for inspection. Additionally, if deviations from the approved drawings are discovered during the certification process, the certification must be' �y' +i accompanied by a copy of the approved permit drawings with deviations noted. Both the original v F lX and revised specifications must be clearly shown. The plans must be clearly labeled as "as -built' or "record" drawing. All surveyed dimensions and elevations shall be certified by a registered surveyor. `7 The operation phase of this permit shall not become effective: until the permittee has complied with the equiiements of condition (6) above, has subm-fftTr '"Request for Transfer of Environmental Resource Permit Construction Phase to Operation Phase" (Form No. 62- )43.900(7), F.A.C.); the Department determines the system to be in compliance with the permitted plans and specifications; and the entity approved by the Department in accordance with Sections 9.0 and 10.0 of the Basis of Review for Environmental Resource Permit Applications Within the South Florida Water Management District - August 1995, accepts Walter Benedikter Permit Number: ES 56-0 135248-00 1 Page 4 responsibility for operation and maintenance of the system. The permit shall not be transferred to such approved operation and maintenance entity until the operation phase of the permit becomes effective. Following inspection and approval of the permitted system by the Department, the permittee shall initiate transfer of the permit to the approved responsible operating entity if different from the permittee. Until the permit is transferred pursuant to Section 62-343.110(1)(d), F.A.C., the permittee shall be liable for compliance with the terms of the permit. 8. Each phase or independent portion of the permitted system must be completed in accordance with the permitted plans and permit conditions prior to the initiation of the permitted use of site infrastructure located within the area served by that portion or phase of the system. Each phase or independent portion of the system must be completed in accordance with the permitted plans and permit conditions prior to transfer of responsibility for operation and maintenance of the phase or portion of the system to a local government or other responsible entity. For those systems that will be operated or maintained by an entity that will require an easement or deed restriction in order to enable that entity to operate or maintain the system in conformance with this permit, such easement or deed restriction must be recorded in the public records and submitted to the Department along with any other final operation and maintenance documents required by sections 9.0 and 10.0 of the Basis of Review for Environmental Resource Permit Applications Within the South Florida Water Management District - August 1995, prior to lot or unit sales or prior to the completion of the system, whichever occurs first. Other documents concerning the establishment and authority of the operating entity must be filed with the Secretary of State where appropriate. For those systems which are proposed to be maintained by the county or municipal entities, final operation and maintenance documents must be received by the Department when maintenance and operation of the system is accepted by the local government entity. Failure to submit the appropriate final documents will result in the permittee remaining liable for carrying out maintenance and operation of the permitted system and any other permit conditions. 10. Should any other regulatory agency require changes to the permitted system, the permittee shall notify the Department in writing of the changes prior to implementation so that a determination can be made whether a permit modification is required. 11. This permit does not eliminate the necessity to obtain any required federal, state, local and special district authorizations prior to the start of any activity approved by this permit. This permit does not convey to the permittee or create in the permittee any property right, or any interest in real property, nor does it authorize any entrance upon or activities on property which is not owned or controlled by the permittee, or convey any rights or privileges other than those specified-tn Me permit and Chapter 40E-4 or Chapter 4DEP40 F.A.C. 12. The permittee is hereby advised that Section 253.77, F.S. states that a person may not commence any excavation, construction, or other activity involving the use of sovereign or other lands of the state, the title to which is vested in the Board of Trustees of the Internal Improvement Trust Fund without obtaining the required lease, license, easement, or other form of consent Walter Benedikter Permit Number: ES 56-0135248-001 Page 5 authorizing the proposed use. Therefore, the permittee is responsible for obtaining any necessary authorizations from the Board of Trustees prior to commencing activity on sovereign or other state-owned lands. 13. The permittee is advised that the rules of the South Florida Water Management District require the permittee to obtain a water use permit from the South Florida Water Management District prior to construction dewatering, unless the work qualifies for a general permit pursuant to subsection 40E-20.302(4), F.A.C., also known as the "No Notice" rule. 14. The permittee shall hold and save the Department harmless from any and all damages, claims, or liabilities which may arise by reason of the construction, alteration, operation, maintenance, removal, abandonment or use of any system authorized by the permit. . 15. Any delineation of the extent of a wetland or other surface water submitted as part of the permit application, including plans or other supporting documentation, shall not be considered binding unless a specific condition of this permit or a formal determination under section 373.42](2), F.S., provides otherwise. 16. The permittee shall notify the Department in writing within 30 days of any sale, conveyance, or other transfer of ownership or control of a permitted system or the real property on which the permitted system is located. All transfers of ownership or transfers of a permit are subject to the requirements of section 62-343.130, F.A.C. The permittee transferring the permit shall remain liable for corrective actions that may be required as a result of any violations prior to the sale, conveyance, or other transfer of the system. 17. Upon reasonable notice to the permittee, Department -authorized staff with proper identification shall have permission to enter, inspect, sample and test the system to ensure conformity with the plans and specifications approved by the permit. 18. If historical or archaeological artifacts are discovered at any time on the project site, the permittee shall immediately notify the appropriate Department office. 19. The permittee shall immediately notify the Department in writing of any previously submitted information that is later discovered to be inaccurate. General Consent Conditions: No activities other than those set forth in this permit are authorized. Any additional activities on sovereign submerged lands must receive further consent fre%;. ie Gdvernor and Cabinet, who sit as the Board of Trustees of the Internal Improvement Trust Fund (hereinafter the 'Board"), or their properly designated agent. Grantee agrees that all title and interest to all lands lying below the historical mean high water line or ordinary high water line are vested in the Board, and shall make no claim of title or interest in said lands by reason of the occupancy or use thereof. 3. Grantee agrees to use or occupy the subject premises for those purposes specified herein and Grantee shall not permit the premises or any part thereof to be used or occupied for any other purpose or knowingly permit or suffer any nuisances of illegal operations of any kind on the premises. 4. Grantee agrees to maintain the premises in good condition in the interest of public health, safety, and welfare. The premises are subject to an inspection by the Board, or its designated agent, at any reasonable time. 5. Grantee agrees to indemnify, defend, and hold harmless the Board and the State of Florida from all claims, actions, lawsuits and demands arising out of this consent. 6. No failure, or successive failures, on the part of the Board to enforce any provision, waiver, or successive waivers on the part of the Board of any provision herein, shall operate as a discharge thereof or render the same inoperative or impair the right of the Board to enforce the same in the event of subsequent breach. 7. Grantee binds itself and its successors and assigns to abide by the provisions and conditions set forth herein. In the event Grantee fails or refuses to comply with the provisions and conditions of this consent, the consent of use may be terminated by the Board after written notice to the Grantee. Upon receipt of such notice, the Grantee shall have 30 days in which to correct the violation. Failure to correct the violations within this period shall result in the automatic revocation of this letter of consent. a 8. All costs, including attorneys' fees, incurred by the Board in enforcing the terms and conditions of this consent shall be paid by the Grantee. Grantee agrees to accept service by certified mail of any notice required by Chapter 18-14, Florida Administrative Code, at the address shown on page one of this agreement and further agrees to notify the Board in writing of any change of address at least 10 days before the change becomes effective. 9. Grantee agrees to assume responsibility for all liabilities that accrue to the sovereign submerged land or to the improvements thereon, including any and all drainage or special assessments or taxes of every kind and description which are now or may be hereafter lawfully assessed and levied against the=operty during the effective period of this consgu, 10. Grantee agrees that any dispute arising from matters relating to this consent shall be governed by the laws of Florida and initiated only in Leon County, Florida. The consent associated with these General Consent Conditions as well as these conditions themselves are subject to modification after 5 years in order to reflect any applicable changes in statutes, rule or policies of the Board or its designated agent. 12. In the event that any part of the structure(s) consented to herein is determined by final adjudication issued by a court of competent jurisdiction to encroach on or interfere with adjacent riparian rights, Grantee agrees to either obtain written consent for the offending structure from the affected riparian owner or to remove the interference or encroachment within 60 days from the date of the adjudication. Failure to comply shall constitute a material breach of this consent and shall be grounds for its immediate termination. Specific Conditions: 1. Turbidity Controls. a. Prior to construction and during all operations that may degrade water quality in waters of the state, the permittee shall ensure that turbidity controls are practiced as necessary to prevent violations of the water quality standards outlined in Chapter 62-302, F.A.C. Any turbidity control devices used shall remain in place until turbidity —as measured in Nephelometric Turbidity Units (NTUs)—within controlled areas returns to within 29 NTUs above natural background levels. hkl ° b. As needed to control turbidity, the permittee shall ensure that turbidity curtains or silt screens surround the dredged and filled areas including all project -associated barges, all active wor s�d r . any previously worked sites that could continue to emit turbid discharge. I �F�s y c. The permittee shall ensure that turbidity monitoring equipment and personnel adequately trained to use the e quipmentt shall be at the work sites at all times during construction. d. The turbidity monitoring criteria outlined below in specific conditions 2 and 3 shall be optional except under the following conditions: 1. There becomes a visible plume of turbid discharge emanating from the work site. 2. Upon notification by Department personnel that turbidity monitoring is required. 2. Turbidity Monitoring. Water turbidity levels shall be monitored and recorded at least every 4 hours during dredging or filling or upon the occurrence of other circumstances that might create water .quality violations on -site. Samples shall be taken I ft. below the_.surrface.at monitoring stations which shall be located as follows: a. At least 100 ft. up -current of the work sites and clearly outside the influence of construction activities. (This shall serve as the natural background sample against which other turbidity readings shall be compared.) Walier Benedikter T Permit Number: ES 56-0135248-001 Page 8 b. Within 50 ft. down -current of the work sites and within the densest portion of any visible turbidity plume. (This sample shall serve as the compliance sample.) If at any time during construction, the turbidity level within a 50-ft. radius down -current of the turbidity screens exceeds 29 NTUs above natural background levels, the permittee or permittee's contractor shall take the following actions: (1) immediately cease the operations that cause the water quality violations, (2) notify the Department's Division of Environmental Resource Permitting within 24 hours after the time the violation was first detected, and (3) modify the work procedures that were responsible for the violation. 3. Turbidity Monitoring Reports. On a daily basis during construction, the permittee or permittee's contractor shall permanently attach to this permit a report containing the turbidity data gathered. The report shall contain the following information: a. permit number b. dates of sampling and analysis c. turbidity sampling results d. description of data collection methods e. a map indicating the sampling locations f. time of day profile was taken g. depth of water body h. weather conditions at times of sampling i. tidal stage and direction of flow j. wind direction and velocity k. water temperature a Further, each monitoring report shall include a statement by the individual responsible for implementation of the sampling program attesting to the authenticity, precision, limits of detection, and accuracy of the data. 4. Culvert. The culvert invert elevation shall match the elevation of the culvert in the adjacent Middle Cove Park. 5. Wetland Encroachment. Except as specified herein, this permit does not authorize the trimming of mangroves or any disturbance to the wetlands on site. All construction activities and staging areas will be confined to uplands or the footprint of the driveway. The permittee shall maintain a minimum 10-ft buffer between upland construction or the placement of structurii_st tt er temporary or permanent —and �r a the wetlands on site. `✓ 6. Exotic and Invasive Vegetation. The permittee shall maintain the wetlands and associated uplands on the property free from the invasion or establishment of the plants listed on The Florida Exotic Pest Plant Council's 1997 Category I Invasive Exotic Species list, a copy of which is attached. Many of the Walter Benedikter Permit Number: ES 56-0135248-001 Page 9 plants on the list are common landscape plants that are highly invasive to natural wetlands and are capable of being transmitted over water. Exotic vegetation removal shall be done in a manner that does not result in the deposition of vegetative debris or mulch in the wetlands or other waters on site. Equipment used for exotic control shall be kept out of the wetlands on site. 7. Mitigation. The permittee has agreed to mitigate for the filling of 2,526 sq. ft. of mangrove wetland and the fragmentation of a mangrove slough by performing the following activities:y A. Invasive Plant Removal Within 30 days after installation of the driveway culvert, the permittee will O kill and remove the exotic and invasive vegetation present on the entire ro erty. The species to be Lremoved consist mainly of Austra Ian pine and Brazilian pepper trees but may include all plants listed on �Al' ' The Florida Exotic Pest Plant Council's 1997 Category I Invasive Exotic Species list. B. Wetland Creation. Within 30 days after installation of the driveway culvert, the permittee will have created white and black mangrove habitat by scraping to wetland elevations 4,800 sq. ft. of uplands and jby planting the site with white and black mangroves. The scrapedown specifications will be in accordance with the attached drawings. The planting specifications will be in accordance with the attached mitigation proposal. The scrapedown site will abut the surveyed western property line. The scraped spoil will be removed and stored on uplands in a manner that prevents spoil or water from entering waters of the state. C. Monitoring Reports. Within 60 days after starting work on the mitigation wetlands, the permittee shall submit wetland reports that shall include the following information: (1) A baseline ("time zero") report that includes the date of scrape -down, finished elevation, a list of the species planted, the size, . . f� number and density of plants, and the date of the plantings. The report shall contain photographs, taken look from referenced locations, to represent the entire site. In addition, a drawing shall be included to show rici the location and direction of the camera. Subsequent monitoring reports shall be submitted every 180 }� days.(semiannually), the first report being due 90 days after the baseline report. The semiannual reports shall include the number of plants surviving from the initial planting, additional seedlings planted, and explanations if survivorship falls below 80 percent or if survivorship is trending toward 7ailure. The ViUN reports shall include photographs from the locations referenced in the baseline report. The reports shall include descriptions of invasive species control —of both wetlands and uplands on site including .. species present, degree of infestation, and control measures taken to maintain the site at least 95 percent free from cover by invasive species. The reports shall be sent to the Department's Environmental Resources Program, Southeast District Branch Office, Submerged Lands & Environmental Resources Program, Compliance and Enforcement Section, 1801 S.E. Hillmoor Drive, Ste. C 204, Port St. Lucie, FL 34952 (or current address). (3) A schedule for replacement planting procedures as necessary to maintain 80 percent survivorship. Minimal success criteria shall be in accordance with section 4.3.6 of the Department's -Basis of Review for Environmental Resource P%Naa epptications within the South Florida Water Management District, August 1995. / 8. Preconstruction Conference. After selecting the contractor to perform the authorized activities vl and before starting any work authorized by this permit, the permittee (or authorized agent) and the ,vOr3� contractor shall arrange and attend a pre -construction conference with a representative of the Walter Benedikter Permit Number: ES 56-0135248-001 Page 10 Department. The purpose of the conference will be to prevent secondary or unauthorized impacts by discussing the specifications and best management practices that will be used during construction. The project drawings, sheets I through 9, the Category I Invasive Exotic Species list, and DEP forms 62-343.900(3), (4), (5), and (7) are attached to and become part of this permit. 10. Compliance With General Conditions. The permittee shall be aware of and operate under the included general conditions. General conditions are binding upon the permittee and enforceable pursuant to Chapters 403 and 373 of the Florida Statutes. Rights of Affected Parties The Department's proposed agency action shall become final unless a timely petition for an administrative hearing is filed under sections 120.569 and 120.57 of the Florida Statutes before the deadline for filing a petition. The procedures for petitioning for a hearing are set forth below. A person whose substantial interests are affected by the Department's proposed permitting decision may petition for an administrative proceeding (hearing) under sections 120.569 and 120.57 of the Florida Statutes. The term "this office" refers to the appropriate district or division office of the Corps of Engineers having jurisdiction over the permitted activity or the appropriate official of that office acting under the authority of the commanding officer. You are authorized to perform work in accordance with the terms and conditions specified below. Project Description: To install a 15" equalizer culvert and place fill material over 0.058 acres of mangrove wetlands. The purpose of the project is to construct an access driveway for a single-family residence. The project is as shown and described on attached plans numbered 199800721(IP-TA) in 7 sheets, dated 18 May 1998. Project Location: The project is located along State Road AlA on Hutchinson Island in Section 29, Township 35 South, Range 41 East, St. Lucie County, Florida. Geographic Position: Permit Conditions: Latitude 27023145" Longitude 80°16100" General Conditions: North West 1. The time limit for completing the work authorized ends on 4 November 2003. If you find that you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least one month before the above date is reached. 2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and conditions of this permit. You are not relieved of this requirement if you PERMIT NUMBER: 199800721(IP-TA) PERMITTEE: MR. WALTER BENEDIKTER PAGE 2 of 7 abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of this permit from this office, which may require restoration of the area. 3. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by this permit, you must immediately notify this office of what you have found. .We will initiate the Federal and state coordination required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places. 4. If you sell the property associated with this permit, you must obtain the signature and mailing address of the new owner in the space provided and forward a copy of the permit to this office to validate the transfer of this authorization. 5. If a conditioned water certification has been issued for your project, you must comply with the conditions specified in the certification as special conditions to this permit. For your convenience, a copy of the certification is attached if it contains such conditions. 6. You must allow representatives from this office to inspect the authorized activity at any time deemed necessary to ensure that it is being or has been accomplished in accordance with the terms and conditions of your permit. Special Conditions:- 1. Within one year of the date of this permit, the permittee will create 0.11 acres of wetlands. The area and description of work is shown on pages 6-7 of the attached drawings. The mitigation site shall be planted with white and black mangroves in one -gallon pots. Plantings shall be conducted 4 ft. on center in 3-ft. rows. In addition, the permittee will remove all Brazilian pepper from the mitigation site and from the existing wetland. PERMIT NUMBER: PERMITTEE: MR PAGE 3 of 7 199800721(IP-TA) WALTER BENEDIKTER 2. Prior to scrapedown of the mitigation site, the jurisdictional line adjacent to the mitigation site shall be flagged and field verified by a Corps representative. 3. Upon completion of exotic removal and planting, but not later than 30 days following completion, the permittee shall submit an initial monitoring report. This report shall provide a post construction as -built topographic survey; a narrative of the planting work, including source of the plants, period of work, climatic conditions, and planting methods; and panoramic photographs, with reference points, of the completed work. 4. The work in the mitigation area shall be considered successful when the number of individual plants per unit area (the sum of survivors of those planted plus those recruited) equals 80% of the number of individuals planted and the planted vegetation shows evidence of normal growth and reproduction. 5. Within the mitigation area, exotic and nuisance vegetation shall not exceed 1-% cover. 6. The permittee shall subsequently submit five annual monitoring reports, the first not later than one year after the submission of the initial report. 7. Each monitoring report shall include a plan view describing the vegetative community; a list of species and their percent cover for each community; description of whether the planting or enhancement has met the success criteria; the percent cover of wetland and of exotic plant species; a description of any unusual climatic or other factors; a brief evaluation of the wetland functions (for example, wildlife utilization, growth and reproduction of vegetation, and condition of the site, including impacts from adjoining uses); and, panoramic photos from the same points as where the photos for the initial report. If the mitigation area has not reached the criteria for success, the monitoring report shall also include a plan of additional planting, excavation, monitoring, changes in control elevations, and/or other actions to achieve success. Reevaluation of Permit Decision. This office may reevaluate its -decision on this permit at any time the circumstances warrant. Circumstances that could require a reevaluation include, but are not limited to, the following: a. You fail to comply with the terms and conditions of this permit. b. The information provided by ,you in support of your permit application proves to have been false, incomplete, or inaccurate (see 4 above). C. Significant new information surfaces which this office did not consider in reaching the original public interest decision. The consent associated with these General Consent Conditions as well as these conditions themselves are subject to modification after 5 years in order to reflect any applicable changes in statutes, rule or policies of the Board or its designated agent. 12. In the event that any part of the structure(s) consented to herein is determined by final adjudication issued by a court of competent jurisdiction to encroach on or interfere with adjacent riparian rights, Grantee agrees to either obtain written consent for the offending structure from the affected riparian owner or to remove the interference or encroachment within 60 days from the date of the adjudication. Failure to comply shall constitute a material breach of this consent and shall be grounds for its immediate termination. Specific Conditions: 1. Turbidity Controls. a. Prior to construction and during all operations that may degrade water quality in waters ofthe state, the permittee shall ensure that turbidity controls are practiced as necessary to prevent violations of the water quality standards outlined in Chapter 62-302, F.A.C. Any turbidity control devices used shall remain in place until turbidity —as measured in Nephelometric Turbidity Units (NTUs)—within controlled areas returns to within 29 NTUs above natural background levels. b. As needed to control turbidity, the permittee shall ensure that turbidity curtains or silt screens surround the dredged and filled areas including all project -associated barges, all active work sites, and any previously worked sites that could continue to emit turbid discharge. c. The permittee shall ensure that turbidity monitoring equipment and personnel adequately trained to use the equipment shall be at the work sites at all times daring construction. d. The turbidity monitoring criteria outlined below in specific conditions 2 and 3 shall be optional except under the following conditions: There becomes a visible plume of turbid discharge emanating from the work site. 2. Upon notification by Department personnel that turbidity monitoring is required. 2. Turbidity Monitoring. Water turbidity levels shall be monitored and recorded at least every4 hours during dredging or filling or upon the occurrence of other circumstances that might create water quality violations onsite. Samples shall be taken 1 ft. below the surface at monitoring stations which shall be located as follows: a. At least 100 ft. up -current of the work sites and clearly outside the influence of construction activities. (This shall serve as the natural background sample against which other turbidity readings shall be compared) Walter Benedikter Permit Number: ES 56-0135248-001 Page 8 b. Within 50 ft. down -current of the work sites and within the densest portion of any visible turbidity plume. (This sample shall serve as the compliance sample.) If at any time during construction, the turbidity level within a 50-ft. radius down -current of the turbidity screens exceeds 29 NTUs above natural background levels, the permittee or permittee's contractor shall take the following actions: (1) immediately cease the operations that cause the water quality violations, (2) notify the Department's Division of Environmental Resource Permitting within 24 hours after the time the violation was first detected, and (3) modify the work procedures that were responsible for the violation. 3. Turbidity Monitoring Reports. On a daily basis during construction, the permittee or permittee's contractor shall permanently attach to this permit a report containing the turbidity data gathered. The report shall contain the following information: a. permit number b. dates of sampling and analysis c. turbidity sampling results d. description of data collection methods e. a map indicating the sampling locations f. time of day profile was taken g. depth of water body h. weather conditions at times of sampling i. tidal stage and direction of flow j. wind direction and velocity k. water temperature Further, each monitoring report shall include a statement by the individual responsible for implementation of the sampling program attesting to the authenticity, precision, limits of detection, and accuracy of the data. 41 Culvert. The culvert invert elevation shall match the elevation of the culvert in the adjacent Middle Cove Park. 5. Wetland Encroachment. Except as specified herein, this permit does not authorize the trimming of mangroves or any disturbance to the wetlands on site. All construction activities and staging areas will be confined to uplands or the footprint of the driveway. The permittee shall maintain a minimum 10-ft buffer between upland construction or the placement of structures—eit er temporary or permanent —and the wetlands on site. 6. Exotic and Invasive Vegetation. The permittee shall maintain the wetlands and associated uplands on the property free from the invasion or establishment of the plants listed on The Florida Exotic Pest Plant Council's 1997 Category I Invasive Exotic Species list, a copy of which is attached. Many of the Walter Benedikter Permit Number: ES 56-0135248-001 Page 9 plants on the list are common landscape plants that are highly invasive to natural wetlands and are capable of being transmitted over water. Exotic vegetation removal shall be done in a manner that does not result in the deposition of vegetative debris or mulch in the wetlands or other waters on site. Equipment used for exotic control shall be kept out of the wetlands on site. 7. Mitigation. The permittee has agreed to mitigate for the filling of 2,526 sq. ft. of mangrove wetland and the fragmentation of a mangrove slough by performing the following activities: A. Invasive Platrt Removal. Within 30 days after installation of the driveway culvert, the permittee will kill and remove the exotic and invasive vegetation present on the entire property. The species to be removed consist mainly of Australian pine and Brazilian pepper trees but may include all plants listed on The Florida Exotic Pest Plant Council's 1997 Category I Invasive Exotic Species list. B. Welland Creatiotr. Within 30 days after installation of the driveway culvert, the permittee will have created white and black mangrove habitat by scraping to wetland elevations 4,800 sq. ft. of uplands and by planting the site with white and black mangroves. The scrapedown specifications will be in accordance with the attached drawings. The planting specifications will be in accordance with the attached mitigation proposal. The scrapedown site will abut the surveyed western property line. The scraped spoil will be removed and stored on uplands in a manner that prevents spoil or water from entering waters of the state. C. Monitoring Reports. Within 60 days after starting work on the mitigation wetlands, the permittee shall submit wetland reports that shall include the following information: (1) A baseline ("time zero") report that includes the date of scrape -down, finished elevation, a list of the species planted, the size, number and density of plants, and the date of the plantings. The report shall contain photographs, taken from referenced locations, to represent the entire site. In addition, a drawing shall be included to show the location and direction of the camera. Subsequent monitoring reports shall be submitted every 180 days (semiannually), the first report being due 90 days after the baseline report. The semiannual reports shall include the number of plants surviving from the initial planting, additional seedlings planted, and explanations if survivorship falls below 80 percent or if survivorship is trending toward failure. The reports shall include photographs from the locations referenced in the baseline report. The reports shall include descriptions of invasive species control —of both wetlands and uplands on site including species present, degree of infestation, and control measures taken to maintain the site at least 95 percent free from cover by invasive species. The reports shall be sent to the Department's Environmental Resources Program, Southeast District Branch Office, Submerged Lands &: Environmental Resources Program, Compliance and Enforcement Section, 1801 S.E. Hillmoor Drive. Ste. C 204, Port St. Lucie, FL 34952 (or current address). (3) A schedule for replacement planting procedures as necessary to maintain 80 percent survivorship. Minimal success criteria shall be in accordance with section 4.3.6 of the Department's-Rasis of Review• for Environmental Resource P.aNuit.Ipphcations x•iihin the South Florida l6'ater ,Management District, August 1995. 8. Preconstruction Conference. After selecting the contractor to perform the authorized activities and before starting any work authorized by this permit, the permittee (or authorized agent) and the contractor shall arrange and attend a pre -construction conference with a representative of the Walter Benedikter Permit Number: ES 56-0135248-001 Page 10 Department. The purpose of the conference will be to prevent secondary or unauthorized impacts by discussing the specifications and best management practices that will be used during construction. To schedule a conference, the permittee shall contact the Department in writing at one of the following addresses: Department of Environmental Protection, Southeast District, Submerged Lands & Environmental Resources Program, Compliance/Enforcement Section, P.O. Box 15425, West Palm Beach, Florida 33416 [for projects in Palm Beach, Broward, Dade Counties] or Department of Environmental Protection, Southeast District Branch Office, Submerged Lands & Environmental Resources Program, Compliance/Enforcement Section, 1801 SE Hillmoor Drive, Ste. C 204, Port St. Lucie, FL 34952 [for projects in Martin, St. Lucie, Okeechobee Counties]. 9. Drawings. The project drawings, sheets I through 9, the Category I Invasive Exotic Species list, and DEP forms 62-343.900(3), (4), (5), and (7) are attached to and become part of this permit. 10. Compliance With General Conditions. The permittee shall be aware of and operate under the included general conditions. General conditions are binding upon the permittee and enforceable pursuant to Chapters 403 and 373 of the Florida Statutes. Rights of Affected Parties The Department's proposed agency action shall become final unless a timely petition for an administrative hearing is filed under sections 120.569 and 120.57 of the Florida Statutes before the deadline for filing a petition. The procedures for petitioning for a hearing are set forth below. A person whose substantial interests are affected by the Department's proposed permitting decision may Petition for an administrative proceeding (hearing) under sections 120.569 and 120.57 of the Florida Statutes. The petition must contain the information set forth below and must be filed (received by the clerk) in the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000. Petitions by the applicant or any of the parties listed below must be filed within fourteen days of receipt of this written notice. Petitions filed by any persons other than those entitled to written notice under section 120.60(3) of the Florida Statutes must be filed within fourteen days of publication of the notice or within fourteen days of receipt of the written notice, whichever occurs first. Under section 120.60(3) of the Florida Statutes, however, any person who has asked the Department for notice of agency action may file a petition within fourteen days of receipt of such notice, regardless of the date of publication. ` The petitioner shall mail a copy of the petition to the applicant ate aaddress indicated above at the time of filing. The failure of any person to file a petition or request for mediation within the appropriate time period shall constitute a waiver of that person's right to request an administrative determination (hearing) under sections 120.569 and 120.57 of the Florida Statutes. Any subsequent. intervention (in a proceeding initiated by another party) will be only at the discretion of the presiding officer upon the filing of a motion in compliance with rule 28-106 205 of the Florida Administrative Code. Any application for a department permit or other type of approval for an activity that effects marine turtles or their nests or habitat shell be subject to conditions and requirements for marine turtle protection as pert of the permitting or approval process, CONSTRUCTION TIMING The specific timing of all construction shall be included in the completed form. Construction or repair of any structure on the sea turtle nesting beach (e.g., dune walkovers, seawalls or other revetments, sandbags, groins or'jetties, piers, etc.) or any other activity requiring beach disturbance (e.g., placing fill, dune revegetation, excavation, etq.) is strongly discouraged during the main portion of the nesting season, May 1 to October 31 (in areas of known leatherback nesting, special conditions may be imposed beginning March 1). Proposals to conduct such activities during the nesting season will require extended review by Department Staff and are unlikely to be approved unless emergency circumstances are demonstrated. These proposals may also require the applicant to contract the services of an entity possessing a special marine turtle permit to perform work involving marine turtles. Projects which result in per modification of nesting habitat may require the evaluation of long- term (multi -year) impacts on nesting activity, Please Remember: Any construction activity that disrupts a nesting marine turtle, disrupts or destroys a sea turtle nest, or results in the injury or mortality of a marine turtle may subject the applicant to prosecution under the U.S. Endangered Species Act and Florida Statutes. LIGHTING General Information The negative effects of beachfront lighting on marine turtle hatchlings and nesting females are well documented. Hatchlings emerge during hours of darkness, allowing them to make their journey to the sea when sand temperatures are low and terrestrial, avian, and aquatic predators comparatively few. Proper hatchling orientation depends largely on a visual response to light. Under natural conditions, the ocean presents the brightest and most open horizon, and this serves as a cue to hatchlings in their' ocean -finding behavior. Artificial lights disrupt this behavior and attract hatchlings the cumulative as they emerge from their nests. Visible light sourceting froms and the reflection or."glow' resul -effects of coastal lights both contt'jbute to this problem. Instead hatchlings become misoriented and may wander extensivelof making their way to the ocean, that eventually reach the ocean, unnecessary wandering increases their vulnerability to predation and y on the beach. Even for those hatchlings expends limited energy stores. In addjtjor6 hatchlings may wander landward through beachfront property or across parking lots and highways toward light sources. Most die from desiccation, direct exposure to the morning sun, or contact with vehicles. Furthermore, beachfront lighting has been documented to negatively affect nesting females and often results in reduced or abnormal nesting ac- tivity. General Guidelines To prevent hatchling misorientation and adverse impacts to nesting lighting is strongly discouraged. If exterior lighting is proposed, the following be followed. Adherence to 'these turtles, installation of exterior guidelines will help in developing an accepableeneral glightingspanll However, in same cases, specific site conditions may warrant more stringent lighting restrictions. 1. Lights should not be placed on the seaward side of the subject property or in any location visible from the nesting beach. '2. lights positioned seaward of the landward toe of the dune (or its equivalent) are prohibited. OA 3. The light source or any reflective surface of the light fixture must not be visible from any point on the nesting beach. Illumination of any area of the netting' beach; either through direct illumination, reflective illumination, or cumulative illumination is prohibited. 4. Completely shielded downlights without interior reflective surfaces Iare preferred. All proposed fixtures shall be appropriately shielded, louvered, and/or recessed. S. Fixtures shall be low mounted through the use of low bollards, ground level fixtures, or low wall mounts. 6. Lights proposed for the seaward side of the subject property must incorporate either shielded Idw pressure sodium lamps or low wattage (i.e., 50W or less) 'bug" type bulbs. Exceptions may be granted for extremely low wattage bulbs (e.g., 5W), 7. Lights for purely decorative or accent purposes shall not be used on the seaward side of the subject property and, if proposed for the landward side shall be limited in number and intensity. The use of uplights is strongly discouraged and in most cases cannot be approved. 8. High intensity lighting, such as that proposed for roadways, shall utilize shielded,lbw pressure sodium lamps. The number of fixtures shall be kept to a minimum and shall be positioned and mounted in a manner such that the point source of light or any reflective surface of the fixture is not visible from any point on the nesting beach. Light emanating from these fixtures may not directly or indirectly illuminate the nesting beach. 9. Only low intensity lighting shall be utilized in parking areas that are visible from any point on the nesting beach. This lighting shall be set on a base which raises the source of light no higher than 48" off the ground and shall be positioned and shielded such that the point source of light or any reflective surface of the light fixture is not visible from any point on the nesting beach. The light emanating from such fixtures may not directly or indirectly illuminate the nesting beach. 10. Parking lots and roadways, including any paved or unpaved area upon which motorized vehicles will operate, should be designed or positioned such that vehicular headlights do not cast light toward or onto the nesting beach, Hedges, native dune vegetation, and/or other ground -level barriers should be utilized to meet this objective. 11. During construction, temporary security lighting during the main portion of the sea turtle nesting season (May 1 - October 31) is strongly discouraged. If absolutely necessary, these lights shall be limited to the fewest number necessary. Security lights shall be completely shielded and low -mounted. Low pressure sodium vapor lamps or low wattage yellow "bug" type bulbks shall be utilized. Under no -circumstances shall these lights directly or indirectly illuminate any area of the nesting beach: 12. Tinted glass or window film that meets a transmittance value of 45% or less (inside to outside transmittance) shall be utilized on all windows and glass doors visible from any point on the nesting beach. Application Requirements The applicant shall provide site plans (map view and profile view) plainly showing the location of all exterior lighting fixtures. Two copies of each site plan are required and all shall be drawn to scale and include a north arrow. For multiple story structures, a site plan is required for each floor. If each floor incorporates identical lighting plans, please indicate this and include only one site plan depicting a representative floor. Distinctive and clearly marked symbols shall be utilized to show the location of each type of proposed fixture. A detailed description of each fixture (cut sheet) shall be included.
