Dear Mr. Salerno,
On April 25, 2016 the Florida Department of Health (Department) acknowledged receipt of the operating
permit application for the swimming pool with the receipt of an application and plans. Currently the swimming pool
application is incomplete pending receipt of the information requested in the acknowledgement letter and
construction. Since receiving the application the Department has reviewed the plans for both the swimming pool
and the spa pool provided noting issues that will need to be resolved prior to issuance of the operating permits.
These issues include the following:

Pool shell free of designs which interfere with detection of human(s) in distress, algae, sediment, or
other objects in pool. (Note: Sheet 2 of 5 shows a highlighted area on the top step. The area
does not appear to be defined. Is this a mosaic or logo?)

Lap lanes and targets on non -competition pools to meet code. (Note: The plans have a note that
the lap lane is to be 4 foot from the wall. However, the plans show the lap lane at only 3 foot
based on the scale provided.)

All pool walls (except steps and spa coves) have minimum 15' clearance perpendicular to a tangent to
the wall. (Interior step protrusion does not exceed 6') / Benches do not protrude into the 15' clearance
requirement. (Note: This issue is associated with the distance between the wall and the bench
seat in the stair area. The distance from the pool edge (top of stairs) to the bench seat appears
to be less than 15 feet based on the scale provided.)

Comers shall be a minimum 90 degree angle. (Note: This is in the area of the stairs.)

Symmetrical pool designs with deep point at center have dual markings indicating depth at wall and at
the deep point, followed by FEET or INCHES. (Note: Not indicated on the drawings.)

Handrails shall extend between 28" and 40" above the step or deck. (Note. Sheet 3 of 5 specifies
the minimum height but not the maximum height for the stairs.)

Ladder treads are slip -resistant and the clearance between the ladder and pool wall is 3 to 6". Ladder
bottom braces have end caps. Top rung is at or below water level on open gutter pools and max. 12"
below deck/curb top on all others. (Note: Sheet 2 of 5 shows the tread detail with an open gutter.)

Structures located inside pool perimeter are additional part of the recirculation system and are not
located less than 15' from any pool wall and are not located within the diving bowl area. (Note: Issue
deals with the interior wall within the pool and Item 3. Will the wall be above the water level?)

A collector tank with an effective capacity of at least 1 minute of the design flow is provided. (Notes:
Sheet 5 of 5 shows "A" as the main drain at 6 inches and X" as the therapy main drain at 8
inches but the detail shows "A" on the therapy tank. Sheet 3 of 5 calls for two 6 inch lines.
Without detailed elevations and drawdown calculations, sufficient flow into the Therapy Tank
cannot be validated by the Department at this time.)

Pool is surrounded by min. 48' high fence with self -closing, self -latching, lockable gates opening away
from pool. Latch is 54" above bottom of gate or min. 3" below the top of the gate on the pool side.
Fence does not allow passage of 4" diameter sphere. Locks, if self-locking, may be 34 — 48 above
floor or ground. (Note: Plans show the fence ending at the edge of the water which does not
provide a sufficient barrier. The Department has required the fence to extend into the water.)
Please note that many of the issues can be resolved during the initial inspections, others may have been
addressed in the specifications just not found by the Department and others may require a variance if they cannot

Dear Mr. Salerno:
The Advisory Review Board for Swimming Pools and Bathing Places reviewed your application for variance
on March 8, 2017. When a variance is requested, the Advisory Review Board considers whether the
hardship was caused intentionally, whether a reasonable alternative exists, and whether the health and
safety of pool patrons are at risk.
The Board recommended approval of your variance application request for the following:
The applicant has constructed a pool with the bottom step riser height of 9 inches at one end and
11.4 inches at the other end. This is a violation of section 454.1.2.5.3 of the Florida Building Code:
Maximum riser height of 10 inches (254 mm).
Based upon the information submitted, I concur with the Advisory Review Board's recommendation to
approve the above variance as requested.
This variance, as approved, applies only to the sections of the Florida Building Code for which the variance
was requested. This variance in no way exempts compliance with other state and local regulations. Should
you disagree with this decision, a notice of rights is enclosed for your use. If you have any questions

This is to acknowledge receipt of an application for an operating permit for the above referenced public
swimming pool on April 20, 2016. You have met the preliminary submittal requirements of Chapter 514.03(1),
Florida Statutes (FS), and may file an application for a public pool construction permit with your local building
authority.
The Florida Department of Health (FDOH) will review your application for completeness and notify you and the
local building authority of any issues found in your proposal that must be addressed before an operating permit
can be issued. The FDOH may request additional information within 30 days.
After construction is completed and prior to opening, FDOH must conduct an initial inspection. Please provide
notice to us at least 5 working days prior to the requested inspection date. Prior to issuing your operating permit
allowing you to open to the public we will require:
1. A final set of plans and specifications as approved for construction by the local building authority;
2. A copy of the final inspection from the local building authority as defined in section 553.71, FS.,
3. Revised application, if needed, reflecting any changes or corrections as a result of the Building
Department.
