H. DISCIPLINARY CASE: 1) AGAINST: Marshall Electrical Services Inc. Steven R. Marshall State # ER13013644 Complaint filed by: Xian G. Feng, property owner of 6008 Citrus Ave. Investigator: Monica Vargas Barrios First Notification to January 5, 2016 the Company: Follow-ups: Letters and phone calls. Violation: SLC CCL 10-67: Revocation or suspension of certificates of competency. Sub section: (4) Performs any act which assists a person or business in engaging in the unlicensed business of contracting, as defined herein, if the certificate holder knows or has reasonable grounds to know that the person or business is unlicensed. Sub section: (5) Conspires with an unlicensed person by allowing a certificate of competency to be used by the unlicensed person to evade the provisions of this division. When a certificate holder allows his certificate to be used by one or more business organizations without having any active participation in the operation, management or control of such business organization, such act shall constitute prima facie evidence of an intent to evade the provisions of this division. Sub section: (10) Commits fraud or deceit or other misconduct in the practice of contracting. Sub section: (15) Aids or abets any unlicensed person or business organization to evade any provision of this division. Staff To revoke the Certificate of Competency not to exceed one (1) Recommendation: year. It is further recommended that this case along with the copy of this Board's Order be prepared and sent to the Florida Construction Industry Licensing Board. Tatarowicz, property owners of 6311 Oleander Ave. Investigator: Monica Vargas Barrios First Notification to December 23, 2015 the Company: Follow-ups: Letters and phone calls. SLC CCL 10-23: Display of state registration and county certification numbers. SLC CCL 10-26 Prohibited Activities. Violation: Sub section: (8) — Fraudulently depart from, or disregard, plans or specifications in materials respect, without consent of the owner or his duly authorized representative. Sub section: (9) — Commit any willful, fraudulent act as a contractor as a result of which another is financially injured. Staff To suspend the Certificate of Competency for a period of 30 days.
