Lessor (as successor by conversion to American Tower Systems, Inc.) owns certain portion of real property described and/or depicted in Attachment "A" ("Premises') attached hereto. Lessor's fee simple ownership in interest on the Premises is evidenced by the Fee Simple Deed dated October 3, 1997, between Paxson Communications of Ft. Pierce-34, Inc., as the Grantor, and American Tower Systems, Inc., as the Grantee, which is recorded in OR Book IIIS, page 1983 of the Public Records of St. Lucie County, Florida. 2. Lessor and Lessee entered into an Amended and Restated Lease Supplement dated S,! .i O 2008 (the "Agreement") for the purpose of installing, operating, 'and maintaining telecommunications equipment and other improvements on a portion of the Premises. The Agreement shall automatically be extended for three (3) additional five (5) year terms unless Lessee notifies Lessor in writing at least 6 months prior to the end of the then current term that Lessee elects not to renew the Agreement. 5. The portion of the Premises being licensed to Lessee is described and/or depicted in Attachment KB" ("Site Layout Plan', and includes certain rights of access and utilities as provided in the Agreement (which may or may not be depicted on Attachment "B"). 6. An original copy of the Agreement is located in the offices of Lessor and the Lessee, at the addresses set forth above. 7. The purpose of this Memorandum is to give record notice of the Agreement and of the rights created thereby, all of which are hereby confirmed.
