AN ORDER GRANTING A MINOR ADJUSTKItNT TO THE MAJOR
SITE PLAN FOR OUTDOOR RESORTS AT NETTLES ISLAND,
INC. RECREATION AREA LOCATED AT 9801 SOUTH OCEAN
DRIVE, JENSEN BEACH '
WHEREAS, the St. Lucie County Planning and Development Services Director has reviewed the
request for a Minor Adjustment to the Major Site Plan for Nettles Island Recreation Area and
reviewed the comments of the Development Review Committee and has made the following
determinations:
1. Nettles Island Property Owners Association (POA) requested a Minor Adjustment to the -
Major Site Plan for Outdoor Resorts at Nettles Island, Inc. Recreation Area to construct the
addition of pickle ball courts located at 9801 South Ocean Drive within the HIRD
(Hutchinson Island Residential District) zoning district.
2. On March 24, 1970, Outdoor Resorts at Nettles Island, Inc. was platted as recreational
campsite condominium.
3. On February 20, 1992 the County amended Land Development Code Section 7.10.16 —
Recreational Vehicle Parks to permit recreational vehicles, travel trailers, single family
residences and mobile homes within recreational vehicle parks on Hutchinson Island.
4. The Development Review Committee has reviewed the Minor Adjustment to the proposed
project pursuantto the Land Development Code (LDC), Section 11.02.05(E) and found it
to meet technical requirements and to be consistent with the general purpose, goals,
objectives, and standards of the St. Lucie County Comprehensive Plan. Planning staff has
performed a detailed analysis of the project and found it to be consistent with the St. Lucie
County Land Development Code and Comprehensive Plan. The analysis is found in the
Planning and Development Services memorandum titled Nettles Island Pickle Ball Courts,
dated November 15, 2016.
5. The project will not have an undue adverse effect on adjacent property, the character of
the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the
public health, safety, and general welfare.
6. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate surroundings through building design, site design, landscaping
and screening.
NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services Director of St.
Lucie County, Florida:
A. Pursuant to Section 11.02.04(C) of the St. Lucie County Land Development Code, the
Minor Adjustment is hereby approved as shown on the drawing prepared by Christian
Fenex and Associates, LLC, date stamped by the Planning & Development Services
Department on November 10. 2016 for the property described in Paragraph B below,

subject to the following conditions:
1) The issuance of a County development permit does not in anyway create any rights on
the part of the applicant to obtain a permit from a state or federal agency and does not
create any liability on the part of the County if the applicant fails to obtain requisite
approvals or fulfill the obligations imposed by a state or federal agency or undertakes
actions that result in a violation of state or federal law.
2) All other applicable state or federal permits must be obtained before commencement of
the development.
B. The property on which this MinorAdjustment to the Major Site Plan for Outdoor Resorts at
Nettles Island, Inc. Recreation Area approval is being granted is described as follows:
Nettles island Inc., A Condominium - Section II; that part of Tract T-1 lying east of
parcels 275 through 279, and lying south of parcels 280 through 289, and lying
west of parcels 291 through 304 per plat dedication dated 11/24/1970, as
recorded in plat book 16, pages 1 through 1j, public records of St. Lucie County,
Florida.

C. This Minor Adjustment to Outdoor Resorts at Nettles Island, Inc. Recreation Area shall
expire on November 15, 2018 unless a building permit is issued or an extension is granted
in accordance with the provisions of Land Development Code, Section 11.02.06.
D. The developer is advised as part of this MinorAdjustment approval for Nettles Island POA,
including any successors in interest, the developer shall obtain all applicable development
permits and construction authorizations from the appropriate state, federal and local
regulatory agencies including, but not limited to, the United States Army Corps of
Engineers, the Florida Department of Environmental Protection, South Florida Water
Management District, and the St. Lucie County Environmental Resources and Building
departments prior to the commencement of any development activities on the property
described in Part B. Issuance of this permit by the County does not in anyway create any"
rights on the part of the developer to obtain a permit from a state or federal agency and
does not create any liability on the part of the County for issuance of this permit if the
developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or
federal agency or undertake actions that may result in a violation of state or federal law.
E. A copy of this MinorAdjustment to Outdoor Resorts at Nettles Island, Inc. Recreation Area
shall be placed on file with the St. Lucie County Planning and Development Services
Director.
