I am working with John Jacobs Construction to complete a permit for a sign that we would like to
install at our West entry. We lease the area where the sign will be added. For that reason we provided
a $1500.00 check and the Documentation of the sign and the area to the Railway for review. They
reviewed it and approved it. For further Due Diligence I met with Tom Cullen as is mentioned below.
He is a railway employee who had no issue with the plans as we presented.
Please let me know if there is any further information or clarification required to move forward.

I apologize for the delay and I appreciate your patience. But I now have all of the necessary Engineering approvals in
place for you to advance your proposed sign on the Railway's property.
Follow the typical Florida Sunshine requirements (call 1-800-432-4770) to locate utilities prior to any excavation, your
contractor needs to be aware there may be subgrade railway signal equipment in the area that is not listed with
Sunshine and requires a separate locate. Therefore, prior to any excavation or subgrade work, your contractor must
contact FECR Engineering and schedule a signal cable locate (1-800-342-1131 Ext. 2377; select option 1 to "Schedule a
Signal Cable Locate".
To ensure that this work is completed in accordance with Railway guidelines, I would strongly suggest that you or your
contractor meet with one of our Field Superintendents in advance for in -field guidance. My field supervisor Tom Cullen
will be able to discuss these requirements in more detail when you meet onsite and answer any remaining questions
you may have should you wish to utilize him as a resource? His contact number is 954-258-9970.

Diane:
I am in receipt of your attached letter requesting to install a sign on Florida East Coast Railway
(FECR) property. Unfortunately the letter was addressed to FECR at the wrong address in St.
Augustine and it appears your contact information isn't current, differing from when I spoke with
Erin from your organization back in the spring. For some historical background, in December 2007
Florida East Coast Railway conveyed the property subject to the Lease, and assigned its interest in the
lease to its affiliate, FDG ROW Holdings LLC, (FDGRH) which is a subsidiary of Florida East Coast
Industries (FECI) and sister company to the Railroad. In December 20o9, FDGRH was merged into
FDG Flagler Station II (FDGFSII), another subsidiary of FECI and the current Lessor. In 2013,
FDGFSII appointed PI Real Estate Services LLC ("Parallel Infrastructure"), also a subsidiary of FECI
to serve as its exclusive real estate management agent, which includes responsibility to administer the
lease. Going forward please insure all correspondence is to our attention concerning your agreement.
Pursuant to your request any improvements to the Leased Premises would need to be approved by
Railway Engineering before installation. What will be needed is a site plan drawing and $1500 Plan
Review Fee made out to the Florida East Coast Railway. Plan would include a detailed description of
the sign and configuration you would like (some of which you have provided but there is no angle
listed, location, or type of materials included), should electricity be provided then the sign company
should reference how it would get there, providing dimensions of the sign, electrical lines, and
distance from the tracks.
Leases within 250 feet of an at -grade crossing are subject to height restrictions due to visibility. As
such any improvement over 2.5 in height has to be reviewed and approved. Please let me know if you
have any questions? Should you wish to move forward please submit the necessary information to my
attention below and I will advance for approval.

If the sign is on the RR property, County can't issue a License Agreement that it is ok to have it there. But, if you need to
permit the sign, you may need to have PDA show you they have RR permission to put the sign on RR property???

See attached aerial and site plan map. We have a sign that is going into the little median close to Cut -off -Road. It falls
outside the Reserve DRI. Do they need a County license agreement to be in the ROW? And if so, do you have an
agreement?
