This petition is for a request for a change in Zoning from I (Industfiialr Extraction) to AG-5
(Agricultural - idu/sac) to aliow the applicant to have a home on the subject 11.62 acre
parcel. The subject parcel is located on the east side of Trowbridge Road, approximately
1,380 feet south of Orange Avenue and is currently undeveloped.
The subject parcel is adjacent to IX (Industrial, Extraction) to the south IL (Industrial, Light)
to the north and AG-5 (Agricultural- 1du/5ac) Zoning to the east and west. The existing uses
surrounding the parcel include a tree nursery to the south, pastureland to the east and west
and industrial light, primarily agricultural related uses to the north along Orange Avenue.
Staff has determined that this petition is consistent with the goals, objectives, and policies of
the t_ Lucie County Comprehensive Plan and conforms to the standards of review as set
forth in Section 11,06.03 of the St. Lune County Land Development Code. A full analysis of
the standards of review can be found in the attached memo to the Planning and Zoning
Board, dated November 21, 2013.
At the November 21, 2013 public hearing on this matter, the 5L, Lucie County Planning and �
Zoning Commission recommended approval of the requested change in zoning by a vote of,6"
to 0 as the proposed zoning is compatible with the majority of the adjacent zoning districts
and the agricultural uses in the area. The applicant and the property owners representative
addressed the Board. No members of the public appeared at the hearing or responded to the
public notices.
PREVIOUS ACTION:
November 21, 101 - Planning and Zoning Commission recommended approval of the
petition by an unanimous vote (5-0).

Mr. & Mrs. Keeney have requested a

(Industrial, Extraction) Zoning District
to AG-5 (Agricultural-1 dul5ac)
Zoning District for an 11.6 acne lot
located on the east side of Trew-
bridge Road, 1.350 feet south of Or-
ange Avenue. The purpose of the
request is to allow a single family
home. The only permitted uses un-
der the existing IX Zoning District are
mining and mobile food vendors
The proposed change in zoning
would convert the parcel back to an
agricultural zoning district which ex-
isted on the parcel prior to a 19B9
change in zoning to IX (Industriei,
Extraction). Mining has never oc-
curred on the parcel, or the two IX
zoned parcels looaled to the south. A
tree farming operation is currently
located on the adjacent IX zoned
parcels. Other USES sufrounding the
subject parcel are mixed, i=luding
existing and proposed agricultural,
residential and industnal light uses.
The industrial, light uses are adja-
cent to the north and accessed from
Orange Avenue.

12 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based
13 on the testimony and evidence, including, but not limited to the staff report, has made
14 the following determinations,

16 1. Robert & Kimberly Keeney have requested an amendment to the Official
17 Zoning Atlas to Change the Zoning from the I (Industrial, Extraction) Zoning
18 District to the AO-5 (Agricultural -- idul5ac) Zoning District for an 11.6 acre
19 parcel, located approximately 1,380 feet south of Orange Avenue as depicted
20 on the attached map and described below.

22 2. On November 21, 2013_ the St. Lucie County Planning and Zoning Commission
23 held a public hearing on the petition, after publishing notice at least 10 days
4 prier to the hearing and notifying by mail all owners of property within 500 feet
5 of the subject property, and recommended that the Board of Counter

Avenue Zoned IL and 3 lots along Trowbridge zoned I, including the subject parcel.

STANDARDS OF REVIEW AS SET FORTH IN SECTION 11.06.03,
ST, LUCIE COUNTY LAND DEVELOPMENT CODE
In reviewing this application for a change in zoning, the Board of County Commissioners shall consider
and make the following determinations:
't. Whether the proposed rezoning is in conflict with any applicable portions of the St, Lucie
County Land Development Code;
The proposed AF-5 (Agricultural -- Idu/sac) Zoning District is consistent with the St. Lucie County Land
Development Code (LO ) and has met the standards of review for changes to the Official Zoning Atlas
set forth in Section 11.05.03 of the County`s Land Development Code. The proposed rezoning is
consistent with Section 11.09.02(A), Table 11-1 Land Use G ateg a rylZoni ng District compatibility chart
and the site meets the dimensional requirements set forth in Section 7.04.00 and Table 7-10 for the A-
5 Zoning Distract_
The applicant is seeking a change in zoning to allow for the building of a residential home. The only
permitted aases in the parcel's existing IBC Zoning are mining operations and mobile food venders. The
proposed agricultural zoning district is found on several parcels in the area will allow the proposed single
family homestead,
2, Whether the proposed amendment is consistent with all elements of the St. Lucie County
Comprehensive Plan;
The proposed change in zoning is consistent with the St. Lude Sunty Comprehensive Plan The Future
Land Use Element's Land Use Compatibility Chart allows AG-5� oning within the subject property's AO-
5 (Agricultural - 1dul5ac) Future Land Use Designation_
3, Whether and the extent tc which the proposed zoning Is inconsistent with the existing and
proposed land uses;
The proposed AG-5 (Agricultural - 1du15ac) Zoning District is consistent with the existing and proposed
agricultural uses surrounding the parcel and with sufficiently buffering can be compatible with the
adjacent light industrial land uses along Orange Avenue. Although an I (Industrial, Extraction) Zoning
is also on the parcels to the south, the IX zoned parcels have never been used for mining operations.
Given the small size of the IX parcel will not likely support a commercial mining operation in the future_ A
tree farm is currently operated on the IX parcels to the south,

4. Whether there have been changed conditions that require an amendment;
There have been no changes that require the proposed amendment.
S. Whether and the extent to which the proposed amendment would result in demands on
public facilities, and whether or to the extent to which the proposed amendment would exceed
the capacity of such public facilities, including but not limited to transportation facilities, sewage
facilities, water supply, parks, drainage, schools, solid waste, mass transit, and emergency
medical facilities;
Prior to the issuance of any final development order, the developer must remonstrate that all public
facilities are available to serve the parcel and obtain a Certificate of Capacity. The applicant has signed
the required Concurrency Deferral Affidavit recognizing this provision.
The proposed A-5 Zoning District represents a less intense zoning district with fewer potential impacts
on public infrastructure than the existing IC Zoning District.

adverse impacts on the natural environment:
The change in zoning is not expected to result in significant adverse impacts on the natural
environment. The Envrronmental Resources Department staff will conduct further review to ensure
compliance with the Land Development code during the site plan andlor building permit review process.
7. Whether and the extent to which the proposed amendment would result in an orderly and
logical development pattern specifically identifying any negative affects of such patterns;
The proposed change in zoning Js expected to result in art orderly and logical development pattern. The
proposed parcel is located within a rural area with existing agricultural uses surrounding the pafcef,
except for the IL zoned parcels along Ofange.Avenue. Future residential and agricultural uses on the
subject parcel can be located in a manner .sufficiently buffeted to reduce any potential negative
impacts from the existing and future industrial uses along Orange Avenue,

conditional uses allowed in this zoning district. If a change in zoning is approved, the applicant, by right.
would be allowrad to establish any of the uses Linder the Permitted Uses section. Any use under the
Accessory Uses section would be allowed only if one or more of the perrnittad uses exist on the subject
property. Any use undei the Conditional Uses section could only be allowed if it first receives approval
through the Board of County Commissioners.
RECOMMENDATION
Staff recommends that the Planning and Zoning Commission forward a reoornmendation of approval to
the Uc8rd of County Commissioners.

Backaround
The Environmental Resources Department (ERD) is in receipt of the September 18: 2013 Planning
and Development Services: date -stamped submittal. The applicant requests approval of a
rezoning from Industrial Extraction, (IX) to Agricultural-5 (AG-5) in order to build a homestead. The
11.6-acre project site is located along Trowbridge Road and currently consists of abandoned Oak
groves.
Findings
Environmental impacts will be influenced mote by specific site design; therefore environmental
issues will be addressed at the time of site plan andlor building permit application,
The Environmental resources Department (ERD) will conduct further review to ensure compliance
with the Land Development Cade during the site plan and/or building permit review process.
Recommendation
ERD supports approval of the rezoning

WHEREAS, the Board of County Commissioners of St_ Lucie County, Florida, based
on the testimony and evidence, including, but not limited to the staff report, has made
the fallowing determinations:
Robert & Kimberly Keeney have requested an amendment to the Official
Zoning Atlas to Change the Zoning from the IX (Industrial, Extraction) Zoning
District to the AG-5 (Agricultural — 1du15ac) Zoning District for an 11.6 acre
parcel, located approximately 1,380 feet south of Orange Avenue as depicted
on the attached map and described below_
2. On November 21, 2013r the St. Lucie County Planning and Zoning Commission
held a public hearing on the petition, after publishing notice at least 10 days
prior to the hearing and notifying by mail all owners of property within 500 feet
of the subject property, and recommended that the Board of County
Commissioners deny/approve the change in zoning from the IX (Industrial,
Extraction) Zoning District to the AO-5 (Agricultural — 1 dul5ac) Zoning [district,

The petitioners have requested a Change
.In zoning frorn the IX Zoning District to
the AG-5 Zoning District for an 11.6 acre
parcel on Trowbridge Road. The purpose
of the request is to allow a single family
homestead. The only permitted uses in
the existing IX Zoning District are mining
and mobile food vendors-
The Oange in zoning would convert the
Parcel back to an agricultural zoning dis-
trict which existed on the parcel prior to a
1989 change in zoning to IX for a mining
operation. Mining has never occurred on
the parcel, or adjacent IX Zoned parcels.
