LUCIE COUNTY GRANTING A CHANGE IN ZONING FROM THE IX 6 (INDUSTRIAL, EXTRACTION) ZONING DISTRICT TO THE AG-5 7 (AGRICULTURAL – 1DU/5AC) ZONING DISTRICT FOR A PARCEL 8 LOCATED IN ST. LUCIE COUNTY, FLORIDA. 9 10 11 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based 12 on the testimony and evidence, including, but not limi ted to the staff report, has made 13 the following determinations: 14 15 1. Robert & Kimberly Keeney have requested an amendment to the Official 16 Zoning Atlas to Change the Zoning from the IX (Industrial, Extraction) Zoning 17 District to the AG-5 (Agricultural – 1du/5ac) Zoning District for an 11.6 acre 18 parcel, located approximately 1,380 feet south of Orange Avenue as depicted 19 on the attached map and described below. 20 21 2. On November 21, 2013, the St. Lucie County Planning and Zoning Commission 22 held a public hearing on the petition, after publishing notice at least 10 days 23 prior to the hearing and notifying by mail all owners of property within 500 feet 24 of the subject property, and recommended that the Board of County 25 Commissioners approve the change in zoning from the IX (Industrial, 26 Extraction) Zoning District to the AG-5 (Agricultural – 1 du/5ac) Zoning District. 27 28 3. On January 7, 2014, this Board held a public hearing on the petition, after 29 publishing notice at least 10 days prior to the hearing and notifying by mail all 30 owners of property within 500 feet of the subject property. 31 32 4. Planning Staff has performed a detailed analysis of the project and determined 33 it to be consistent with the St. Lucie County Land Development Code and 34 Comprehensive Plan. The analysis is found in the Planning and Zoning Board 35 memorandum for Robert and Kimberly Keeney for a Change in Zoning from IX 36 to AG-5 – East side of Trowbridge Road, 1,380 feet south of Orange Avenue 37 and dated November 8, 2013 . 38 39 January 7, 2014 Resolution No. Page 2 RZ 920134672 5. The proposed change in zoning is consistent with the existing and proposed 1 use of property in the surrounding area. 2 6. A Concurrency Deferral Affidavit, a copy which is attached to this Resolution, 3 was signed by the applicant on September 5, 2013. 4 5 6 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of 7 St. Lucie County, Florida: 8 9 A. The proposed amendment to the Official Zoning Atlas from the IX (Industrial, 10 Extraction) Zoning District to the AG-5 (Agricultural – 1 du/5ac) Zoning District 11 for that property depicted on the attached map and described below is 12 approved. 13 14 Legal Description: 15 16 LOT 5, ORANGE AVENUE AG PARK, ACCORDING TO THE PLAT 17 THEREOF AS RECORDED IN PLAT BOOK 33, PAGES 11, 11A, 18 THROUGH 11B, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. 19 20 Location: Trowbridge Road, approximately 1,380 feet south of Orange 21 Avenue. 22 23 Parcel ID: 2212-800-0005-0008 24 25 B. The Planning and Development Services Director is hereby authorized and 26 directed to cause the change to be made on the Official Zoning Map of St. 27 Lucie County, Florida, and to make notation of reference to the date of adoption 28 of this Resolution. 29 30 C. A copy of this Resolution shall be mailed, return receipt requested, to the owner 31 and agent of record as identified on the application. 32 33 D.
