MJSP 1120165078 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY GRANTING MAJOR SITE PLAN APPROVAL FOR THE CONSTRUCTION OF A SELF STORAGE FACILITY ON APPROXIMATELY 4.85 ACRES OF PROPERTY LOCATED IN ST. LUCIE COUNTY. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Advantage Development LLC, presented a petition for a Major Site Plan to be known as Advantage Self Storage for the construction of a 99,150 s.f. self storage facility in the CG (Commercial, General) zoning district on approximately 4.85 acres of land as described in Part A. 2. On May 2, 2017, this Board held a public meeting on the petition. 3. The St. Lucie County Development Review Committee has reviewed the Major Site Plan for the project and found it to meet all technical requirements and to be consistent with the Future Land Use Map of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part B of this Resolution. 4. The proposed project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan and the Code of Ordinances of St. Lucie County. 5. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety and general welfare. 6. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 7. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. The property on which the Major Site Plan is being granted is described as follows: 5 6 TRACT "A" OF THE PLAT OF "KITTERMAN", ACCORDING TO THE PLAT 7 THEREOF AS RECORDED IN PLAT BOOK 55, PAGE 32, PUBLIC RECORDS OF 8 ST. LUCIE COUNTY, FLORIDA. 9 10 CONTAINING 211,346.81 SQAURE FEET OR 4.852 ACRES MORE OR LESS. 11 12 PARCEL IDENTIFICATION NUMBER: 3415-707-0001-000-0 13 14 B. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the 15 Major Site Plan for the project known as Advantage Self Storage is hereby approved 16 as shown on the site plan drawings for the project prepared by Keen Engineering, 17 Inc. dated May 2, 2017 and date stamped received by the St. Lucie County Planning 18 & Development Services Department on May 8, 2017, subject to the following 19 conditions: 20 21 Planning and Development Services — Planning Division 22 23 1. Wall signage on the buildings shall consist of individual channel letters and shall 24 be reviewed by Planning Division staff prior to the issuance of a building permit. 25 26 Environmental Resources Department 27 28 1. Prior to issuance of a Certificate of Occupancy all Category I listed invasive 29 species shall be eradicated from the site. 30 31 2. The issuance of County development permit does not in any way create any 32 rights on the part of the applicant to obtain a permit from a state or federal agency 33 and does not create any liability on the part of the County if the applicant fails tc 34 obtain requisite approvals or fulfill the obligations imposed by a state or federal 35 agency or undertakes actions that result in a violation of state or federal law. 36 37 3. All other applicable state or federal permits must be obtained before 38 commencement of the development. 39 40 C. The approvals and authorizations granted by this Resolution shall expire on May 2, 41 2019 unless a building permit is secured or a site plan extension is granted in 42 accordance with Section 11.02.06(B)(2), St. Lucie County Land Development Code. 43 44 D. Issuance of this permit by the County does not in any way create any rights on the part of the developer to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of this permit if the developer fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertake actions that may result in a violation of state or federal law. E. The conditions set forth in Part B are an integral non -severable part of the site plan approval granted by this Resolution. If any condition set forth in Part B is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this resolution shall become null and void. F. A Certificate of Capacity, a copy of which is attached hereto as Exhibit B and made a part hereof the Resolution, was granted by the Planning & Development Services Department Director on May 2, 2017. G. A recorded copy of this Resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Planning & Development Services Department Director. SELF STORAGE FACILITY IN THE CG, (COMMERCIAL GENERAL) ZONING DISTRICT FOR CERTAIN PROPERTY LOCATED IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to findings in the staff report, has made the following determinations: 1. Advantage Development LLC, presented a petition for a Conditional Use Permit to allow for the construction of a 99,150 s.f. self storage facility in the CG (Commercial, General) Zoning District for the property depicted on the attached map in Exhibit "A° and described in Part B below. 2. On March 16, 2017, the St. Lucie County Planning and Zoning Commission held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within _500 feet of the subject property, and recommended that the Board of County Commissioners approve the hereinafter described Conditional Use Permit in the CG (Commercial, General) Zoning District for the property described in Part B. 3. On May 2, 2017, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 9 feet of the subject property. 4. The Conditional Use Permit, with the conditions therein, is consistent with the goals, objectives and policies of the St. Lucie County Comprehensive Plan and has satisfied the requirements of Section 11.07.03 of the St. Lucie County Land Development Code. 5. With conditions therein, the project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare. Pursuant to Section 11.07.03 of the St Lucie County Land Development Code, a Conditional Use Permit that allows for the construction of a self storage facility on the property described below is hereby approved subject to the following conditions: 1. The conditional use improvements and operational areas shall be consistent with Resolution No. 17-XXX authorizing Major Site Plan approval on the drawings prepared by Keen. Engineering, Inc. date stamped received by the St. Lucie County Planning Division on _, .2017. Adjustments to the site plan or conditional use permit may be made consistent with the St. Lucie County Land Development Code. 2. The storage units shall be utilized solely for storage purposes and no other use. 3. The outdoor vehicular storage area as noted on the site plan drawings shall be restricted only to recreational vehicles, campers, motor vehicles, trailers and boats. All vehicles shall be currently licensed and operable. 4. Prior to issuance of a Certificate of Occupancy all Category I listed invasive species shall be eradicated from the site. 5. The issuance of County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 6. All other applicable state or federal permits must be obtained before commencement of the development. B. The subject property is described as follows: TRACT "A" OF THE PLAT OF "KETTERMAN", ACCORDING TO THE PLAT THEREOF AS RECORDED IN PLAT BOOK 55, PAGE 32, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. CONTAINING 211,346.81 SQUARE FEET OR 4.852 ACRES MORE OR LESS. PARCEL IDENTIFICATION NUMBER: 3415-707-0001-000-0 C. The approvals and authorizations granted by this Resolution are for the purpose of obtaining a Building Permit or Zoning Compliance from St. Lucie County, and are not assigned to any other party or institution.
