LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to findings in the staff report, has made the following determinations: Tattoo Yachts, LLC presented a petition for a Conditional Use Permit to allow for the manufacturing of boats 45 feet or more in length within approximately 26,000 s.f. of existing buildings in the IL (Industrial, Light) Zoning District for the property depicted on the attached map in F-xhibit "A° and described in Part B below. 2. On April 20, 2017, the St. Lucie County Planning and Zoning Commission held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners approve the hereinafter described Conditional Use Permit in the IL (Industrial, Light) Zoning District for the property described in Part B. 3. On May 2, 2017, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property. 4. On February 14, 1989 the Board of County Commissioners through Resolution 89-45 granted a Major Adjustment to the Sun Citrus Corporation Site Plan for 6,000 s.f. of building improvements on the 10.4 acre parcel. 5. On August 25, 1987 the Board of County Commissioners through Resolution 87- 164 granted a Major Adjustment to the Sun Citrus Corporation Site Plan for a 24,000 s.f. fruit packing facility on an adjacent 3.4 acre parcel. 6. On February 12, 1985 the Board of County Commissioners through Resolution 85-35 granted Site Plan approval for the project known as Sun Citrus Corporation on a 10.4 acre parcel. The Conditional Use Permit, with the conditions therein, is consistent with the goals, objectives and policies of the St. Lucie County Comprehensive Plan and has satisfied the requirements of Section 11.07.03 of the St. Lucie County Land Development Code. 8. With conditions therein, the project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, a Conditional Use Permit that allows for the manufacturing of boats 45 feet or more in length on the property described below is hereby approved subject to the following conditions: Planninq and Development Services, Planninq Division Prior to a Certificate of Completion, all off-street parking stalls shall be painted or striped so as to be clearly defined and visible, and an additional handicap parking stall shall be provided in accordance with Land Development Code, Section 7.06 — Off -Street Parking. 2. All manufacturing activities shall occur within an enclosed structure. Environmental Resources Department 3. Within three (3) years or at such time adjacent parcels are developed, whichever occurs first, landscaping shall be installed in accordance with the ERD approved landscape plan provided by the applicant. 4. The issuance of County development permit does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. 5. BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCE AT THE NORTHEAST CORNER OF THE SOUTHWEST 'Y4 OF SAID SECTION 30; THENCE SOUTH ALONG THE EAST LINE OF THE SAID SOUTHWEST 114, 445.00 FEET; THENCE SOUTH 8947'08" WEST. 1.993.56 FEET TO THE POINT OF BEGINNING; THENCE CONTINUE SOUTH 89" 47 08" WEST, 350.00 FEET; THENCE NORTH 00"02'52" WEST, 400.10 FEET; THENCE NORTH 89" 47'08" EAST, ALONG THE SOUTH LINE OF THE FORT PIERCE FARMS DRAINAGE DISTRICT CANAL No. 25. 350.00 FEET; THENCE SOUTH 00002'52" EAST 400.10 FEET TO THE POINT OF BEGINNING CONTAINING 3.21 ACRES, MORE OR LESS. TOGETHER WITH EASEMENT FOR INGRESS AND EGRESS AS DESCRIBED IN EASEMENT DEED RECORDED IN OFFICIAL RECORDS BOOK 609, PAGE 2437, PAGE 2437, PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. PARCEL IDENTIFICATION NUMBER: 1430-322-0001-010-3 C. The approvals and authorizations granted by this Resolution are for the purpose of obtaining a Building Permit or Zoning Compliance from St. Lucie County, and are not assigned to any other party or institution. Should the petitioners choose or decide to assign this business to another entity or individual, a minor adjustment to the Conditional Use Permit shall be required. D. The approvals and authorizations granted by this Resolution shall expire on May 2, 2018, unless a Building Permit or Certificate of Zoning Compliance is obtained for the uses described in Part A above, or an extension has been granted in accordance with Section 11.07.05(F), St. Lucie County Land Development Code.
