AN ORDER GRANTING A MINOR SITE PLAN KNOWN AS.PHOENIX
METALS EXPANSION ON APPROXIMATELY 2.5 ACRES OF
PROPERTY LOCATED AT 3000 INDUSTRIAL AVENUE 3 IN ST. LUCIE
COUNTY, FLORIDA.
WHEREAS, the St. Lucie County Planning and Development Services Director has
reviewed the request for a Minor Site Plan submitted by Stephen Cooper, PE, on
behalf of St. Lucie County, evaluated the comments of the St. Lucie County
Development Review Committee on this application, and made the following
determinations:
On August 22, 2018, Stephen Cooper, PE, an agent for St. Lucie County, filed an
application requesting approval of a Minor Site Plan, known as Phoenix Metals
Expansion, to construct two (2) building additions totaling 8,200 square feet in
conjunction with improvements to site access, parking, landscaping, and
drainage. The petition site is approximately 2.5 acres, as described in Part B,
within the IL (Industrial Light) Zoning District, located at 3000 Industrial Avenue 3
as more particularly described in Part B below and depicted on Exhibit A.
2. The site features 13,380 sq. ft. of finished space, developed in 1976, currently
utilized for the manufacture of commercial aviation equipment. The Minor Site
Plan provides a 6,600 sq. ft. addition to the western structure, a 1,600 sq. ft.
expansion to the eastern structure, resulting in a total finished building area of
21,580 sq. ft.
3. The St. Lucie County Development Review Committee has reviewed the
proposed Minor Site Plan, as depicted on Exhibit C incorporated herein, and
found it to meet all technical requirements of the St. Lucie County Land
Development Code, consistent with the St. Lucie County Comprehensive Plan,
and to have satisfied the standards of review set forth in Section 11.02.07,
Standards for Site Plan Review, subject to the conditions set forth in Part A of
this Order.
4. The proposed project will not have an undue adverse effect on adjacent property,
the character of the neighborhood, traffic conditions, parking, utility facilities or
other matters affecting the public health, safety and general welfare.
5. All reasonable steps have been taken to minimize any adverse effect of the
proposed project on the immediate vicinity through building design, site design,
landscaping and screening.

6. The proposed project will be constructed, arranged and operated so as not to
interfere with the development and use of neighboring property, in accordance
with applicable district regulations.
Planning Staff has performed detailed analysis of the project and determined it to
be consistent with Section 11.02.07., Standards for Site Plan Review, of the St.
Lucie County Land Development Code. The analysis is found in the Staff Report
titled Phoenix Metals Expansion, dated September 26, 2018.
NOW, THEREFORE, BE IT ORDERED by the Planning and Development Services
Director of St. Lucie County, Florida:
A. Pursuant to Section 11.02.07 of the St. Lucie County Land Development Code, the
Minor Site Plan for the project known as Phoenix Metals Expansion is hereby
approved as shown on the site plan drawings for the project prepared by Stephen
Cooper, P.E. & Associates, Inc., dated August 16, 2018 and date stamped received
by the St. Lucie County Planning & Development Services Department on August
22, 2018, subject to the following conditions:

The appropriate traffic control devices such as signs and striping
implemented at the cross -access point proposed at the east property
prior to issuance of a Certificate of Occupancy.
A revocable license agreement for the existing advertising sign situ
within the right-of-way is established, a lease provision requiring ft
relocation of said sign is adopted, or said sign is relocated prior to issu
of a certificate of occupancy for the expansion.
Environmental Resources Department
Prior to the issuance of a Certificate of Occupancy, the applicant shall install
landscaping consistent with the August 29, 2018 approved landscape plan
created by the Environmental Resources Department.
2. The issuance of County development permit does not in any way create any
rights on the part of the applicant to obtain a permit from a state or federal
agency and does not create any liability on the part of the County if the
applicant fails to obtain requisite approvals or fulfill the obligations imposed
by a state or federal agency or undertakes actions that result in a violation of
state or federal law.

3. All other applicable state or federal permits must be obtained before

commencement of the development.

C.
The approvals granted by this administrative order shall expire on September 27,
17
2020, unless a building permit is issued or an extension is granted in accordance
18
with the provisions of Section 11.02.06 of the St. Lucie County Land Development
19
Code.

D.
The property owner, including any successors in interest, shall obtain all applicable
22
development permits and construction authorizations from the appropriate State and
23
Federal and local regulatory agencies including, but not limited to, the United States
24
Army Corps of Engineers, the Florida Department of Environmental Protection,
25
Florida Department of Transportation, South Florida Water Management District,
26
and the St. Lucie County Environmental Resources and Building Departments prior
27
to the commencement of any development activities on the property described in
28
Part B. Issuance of this permit by the County does not in any way create any rights
29
on the part of the developer to obtain a permit from a state or federal agency and
30
does not create any liability on the part of the. County for issuance of this permit if
31
the developer fails to obtain requisite approvals or fulfill the obligations imposed by a
32
state or federal agency or undertake actions that may result in a violation of state or
33
federal law.

E.
This Order shall become effective upon the date of approval indicated below.

Should the property owner, developer or authorized agent wish to appeal any
37
condition described in Part A above, all such appeals must be filed in writing with the
38
County Administrator within 30 days of the rendering of this Order, as described in
39
Section 11.02.03(B), St. Lucie County Land Development Code. Should an appeal
40
to this Order be filed, no permitting reviews or further administrative action shall take
41
place on the processing of this development project until the appeal is resolved.

F.
The conditions set forth in Part A are an integral non -severable part of the site plan
44
approval granted by this Order. If any condition set forth in Part A is determined to
45
be invalid or unenforceable for any reason and the developer declines to comply

voluntarily with that condition, the site plan approval granted by this order shall
become null and void.
G. The Certificate of Capacity issued on September 5)-, 2018 for this project, attached
as Exhibit B, shall be valid for the same period as this order. If this order expires or
otherwise terminates, the Certificate of Capacity shall automatically terminate.
H. This order shall be recorded irrthe Public Records of St. Lucie County.
I. A recorded copy of this Order shall be attached to the site. plan drawings described
in Part A, which plan shall be placed on file with the St. Lucie County Planning &
Development Services Department Director.
