Danie arin Alpha Design Contractor LLC SCANNED BY St. Lucie County This AGREEMENT is made this 2 day of September, 2016 by and between SEGUNDO MALDONADO hereinafter (OWNER Adress 5407 S. Indian River Dr. Fort Pierce <FI 34982) to RENOVATION a single family house located in 4905 Paml Dr. Fort Pierce. FL 34982, and Alpha Design Contractor LLC (CBC License # 1256205) located in 1492 SE Belcrest St. Port Saint Lucie, FL 34952. (General Contractor hereinafter Contractor). The Owner and Contractor agree as set follows: 6CANNED BY 1: Description of Services. Work and Insurance: >t. Lucie County Beginning on 2 day of September, 2016 the Contractor will provide the following services: Construction administration to build a single family home according to the State of Florida Laws and Codes and permits from the City of Port Saint Lucie at the address above described. The work will begin promptly after both parties sign and agrees with this Contract and all permits have been issued and it will be completed within a reasonable time frame according to inspections. Contractor shall maintain at Contractor's own expense, all necessary workers' compensation and liability insurance required for construction laws to protect Contractor from claims for damages because of bodily injury, including death, and for damages to property that may arise both out of and during operations under this contract. A copy of Contractor's license and all respective insurances are attached as Exhibit B. BUILD RISK INSURANCE: provide for L & M Project. Contractor Must have in good standing before the beginning of the job, all the necessary and valid Insurances require by Federal and local Laws and shall give proof to the Company. The work shall be done substantially in conformance with the plans and specifications that have initialed or signed by each party in this contract. If a conflict exits between plans and specifications, the plans shall govern. These plans and specifications are attached to this contract and incorporated into it as Exhibit A. 2: Payment for Services: Company will pay to the Contractor (who is fully licensed and insured) for the services in the amount of $ 15,500 (Fifteen Thousand Five Hundred dollars) . This fee is to be paid in advance to pull the necessary permits for construction under company's name, license and responsibility and full management control. V Contractor will visit the jobsite three times a week or when its necessary and Must to keep his license as a General Contractor with all insurances in good standing until finish the work described in number (1). Materials provided for the owner, the current contract price is for labor only. 3: Supervision: Both parties agree that the supervision of the work performed under this Agreement is under the exclusive direction of the Developer/Owner, and supervising by the Project Manager. Contractor shall have control over construction means, methods, techniques, sequences and procedures and for coordinating all portions of the work. All the work shall be done by Subcontractors under General contractor and Project Manager supervision as well. Subcontractors must be hire by Developer/Owner's discretion according to the Florida Law. 4.- Company's Obligations: Company shall (a) furnish all surveys describing the physical characteristics and utility locations for the residence and (b) secure and pay for easements necessary for the completion of the work. Company shall furnish information and services under their control to Contractor promptly to avoid delay. Company shall provide and pay for all permits, drawings, engineering labor, materials, equipment, tools, construction equipment and machinery, transportation, dumpsters, debris hauling, portable sanitary, facilities and other services necessary for the proper execution and completion of the residence. S: Drawings. Permits and Fees: Owner shall be responsible for all fees and permits. 6: Iniuries• The Contractor waives any rights to recovery from the Company for any injuries that the Contractor (and /or Contractor's employees) may sustain while performing services under this Agreement and that are a result of the negligence of the Contractor or the Contractor's employees. Contractor shall provide to the Company with all insurance information to perform his job. 7: Indemnification: The Contractor agrees to indemnify and hold harmless the Company from all claims, losses, expenses, fees including attorney fees, costs and judgements that may be asserted against the Company that result from the acts or omissions of the Contractor, the Contractor's employees if any. 8: No right to Act as.an agent or Supervisor: The Contractor has no right to act as an agent, supervisor or on behalf of the Company at all. 9: Termination: This agreement will terminate automatically when the job have been performed satisfactorily according to this agreement and to the Florida Laws unless Contractor fails to supply proper materials and skilled workers; disregards ordinances, regulations, or orders of a public authority; or fails to materially comply with the provisions of the contract, Company may give Contractor written notice to terminate. After seven (7) days if Contractor has failed to remedy the breach of contract, Company can give a second notice to terminate. If Contractor still fails to cure the breach within three (3) days after the second notice, Company may terminate the contract and act according to the Florida Law. 10: Governing Law and Assignment: This Agreement will be construed, interpreted and applied according to the law of the State of Florida, United States of America. This contract shall not be assigned without the written consent of all parties and Contractor shall not leave the job before completion under penalty. 11: Effective Date and Signature: This contract shall become effective on the day it is signed by both parties. 12: Warranties: Contractor agrees to promptly make good, without cost to Company, any and all defects due to faulty workmanship and/or materials which may appear within one (1) year from the date of completion and acceptance of the work by Company. 13.- Right to Cure: FLORIDA LAW CONTAINS IMPORTANT REQUIREMENTS YOU MUST FOLLOW BEFORE YOU MAY FILE A LAWSUIT FOR DEFECTIVE CONSTRUCTION AGAINST A CONTRACTOR, SUBCONTRACTOR, SUPPLIER, OR DESIGN PROFESSIONAL FOR AN ALLEGED CONSTRUCTION DEFECT IN YOUR HOME. SIXTY DAYS BEFORE YOU FILE YOUR LAWSUIT, YOU MUST DELIVER TO THE CONTRACTOR, SUBCONTRACTOR, SUPPLIER, OR DESIGN PROFESSIONAL A WRITTEN NOTICE OF ANY CONSTRUCTION CONDITIONS YOU ALLEGE ARE DEFECTIVE AND PROVIDE YOUR CONTRACTOR AND ANY SUBCONTRACTORS, SUPPLIERS, OR DESIGN PROFESSIONALS THE OPPORTUNITY TO INSPECT THE ALLEGED CONSTRUCTION DEFECTS AND MAKE AN OFFER TO REPAIR OR PAY FOR THE ALLEGED CONSTRUCTION DEFECTS. YOU ARE NOT OBLIGATED TO ACCEPT ANY OFFER MADE BY THE CONTRACTOR OR ANY SUBCONTRACTORS, SUPPLIERS, OR DESIGN PROFESSIONALS. THERE ARE STRICT DEADLINES AND PROCEDURES UNDER FLORIDA LAW. All requests for an extension beyond 30 days must be made in writing to the Building Official stating the reason for the request. Power may be removed from the site and/or a Stop Work Order issued if the Final Inspection has not been approved within 30 days. A fee of $100.00 will be required to lift the Stop Work Order. WE HEREBY RELEASE AND AGREE TO HOLD HARMLESS, ST.
