Request Permission to Advertise a Hearing to Consider the Historical Commission's Recommendation on the Designation of Property at 9809 S. PUBLIC UTILITIES Bid Waiver and Capital Equipment Purchase - Two eFactor3 Metso Waste Shredders St. Lucie County Solid Waste (SLCSW) requests a bid waiver per Section 8.1 (a) (3) of the purchasing manual to purchase two used Metso eFactor3 Waste Shredders (cost reduced on unit 1 by $83,839.00 because it has 721 hours and cost reduced on unit 2 by $103,841.00 because it has 1,732 hours). This would allow SLCSW to mulch yard waste and garbage in-house. SLCSW expended $671,561.72 in FY 19-20 and $502,424.51 in FY 20-21 for an outside vendor to mulch yard waste. A waste -shredder would eliminate the need for an outside vendor. A second waste shredder would allow SLCSW to shred garbage. Based on a four -month period of demonstrations, this would result in smaller, denser bales and increase garbage bale weights by an average of 1,000 pounds. This translates to 3 bales of shredded garbage for every four (4) bales of un-shredded garbage. This is an airspace savings, increasing the life of the SLC Landfill. Staff recommended the Board authorize staff to purchase the two used eFactor3 Metso Waste Shredders and one cutting table for a total cost of $1,549,151.00 Adopted by Consent Vote 2. Seaside (Ouanalao) Resort - Major Adjustment to Conditional Use Permit - THIS ITEM IS QUASI- JUDICIAL This public hearing was Quasi -Judicial, and the commissioners made the following disclosures regarding this item: Commissioner Frannie Hutchinson - Spoke with staff only Commissioner Linda Bartz - Spoke with staff and applicant. Jodi Kugler, Planning & Services Department, Senior Planner, presented this item to the Board. The applicant Lee Heaton of Seaside 20 LLC. and representative, Lee Dobbins, Esq., Dean, Mead, Minton & Moore, have applied for a Major Adjustment to the existing Seaside (aka Ouanalao) Resort Conditional Use Permit to amend the owner's length of stay restrictions. The project site is located at 7700 S. Ocean Drive, St Lucie County, Florida, east and west of Ocean Drive SR-A1A South, approximately five (5) miles north of North Causeway Boulevard, of Jensen Beach Causeway, Frank Wacha Bridge. On July 6, 2021, the Board approved Resolution 2021-306 for a conditional use permit to develop a tourist court resort and alcohol waiver for on -premises consumption of fewer than 1,600 feet of an existing public park accessory a tourist court resort. Additionally, the Board approved Resolution 2021-312 for the Major Site Plan for a 37,000 square foot tourist court resort containing twenty-five (25) oceanside villas and twenty-five (25) internal cottages, clubhouse amenity center with restaurant and bar, and accessory dock with twenty (20) slips, associated parking, drainage, and utility infrastructure. The amendment will not require any modifications to the approved site plan. The project site is located within the Urban Service Boundary (USB). The proposed parameters are 12,775 minimum lodging nights available, and the proposed conditions are: 6 1 P a g E BOCC Regular Meeting Tuesday, February 1, 2022, 6:00 PM "Owners of the resort units (villas and cottages) shall not stay in their units for more than 185 calendar days per year. No less than 70% of all room nights (18,250) in any calendar year shall be offered to the public (not the unit owner) for rent. Upon request from the County, but no sooner than 30 days after the end of any calendar year, the management of the resort shall provide the County with a report confirming the foregoing condition was satisfied for the previous year. All resort units (villages and cottages) must be placed in the rental program run by the resort management and made available for rental by the public when the owner of the unit is not staying in the unit." Under public notice requirements outlined in the St. Lucie County Land Development Code, notices and response forms were mailed to adjacent property owners located within 500 feet of the subject property. Of the three (3) notices mailed out, the Planning & Development Services Department received no responses. The proposed Major Adjustment is consistent with the standards of review outlined in St. Lucie County Land Development Code Section 11.07.03 and St. Lucie County Comprehensive Plan Goals, Objectives, and Policies. Staff recommended the Board adopt the proposed resolution approving this request for a major adjustment to the conditional use permit, subject to the conditions outlined in Resolution No. 2022-23. Staff Initiated Text Amendment to the Land Development Code to Establish Stormwater Design Standards for Single-family and Duplex Infill Development - 2nd Reading of the Ordinance Monica Graziani, Building & Code Regulation Manager, presented this item to the Board. The purpose of this text amendment to the Land Development Code, Chapter VII, Development Design and Improvement Standards, Section 7.04.01 D.3 - Area, Yard, Height, and Open Space Requirements, Filled Lands, is to establish requirements for a stormwater grading plan for single- family and duplex infill development. Currently, applicants for infill development execute a Filled 7 1 P a g e BOCC Regular Meeting Tuesday, February 1, 2022, 6:00 PM Lands Affidavit, stating the owner shall be responsible for assuring adequate drainage so the immediate community will not be adversely affected. Infill development in an established neighborhood is constructed at higher elevations than the older adjacent homes. Thus, the runoff from the infill lot impacts the neighboring properties. It is difficult for staff to address complaints from citizens affected by new infill development because there are no stormwater design standards. The proposed ordinance was drafted to provide a Do -It -Yourself method of determining the required stormwater swale for infill development of single-family and duplexes. The homeowner or contractor could prepare the stormwater grading plan without retaining the services of a design professional. The Treasure Coast Builder's Association has provided a letter of support regarding the text amendment. Also, the County's Public Works Director, Assistant Director, and County Engineer have reviewed the proposed text amendment and offer no objections. The Planning and Zoning Commission unanimously approved the item on October 21, 2021. The proposed amendment provides standards to capture the stormwater runoff. Below are highlights of the proposed regulations: • Limit the amount of fill placed on a site. • A one-time exemption for additions or accessory structures less than 300 square feet. • The plan must include roof drainage. • The stormwater grading plan shall provide a swale design along the lot's perimeter, rear to front drainage flow. • DIY formula is provided to determine the flow area of the swale • An approved final inspection of the stormwater grading plan is required for a certificate of occupancy. The Board unanimously approved this item on the first reading of the ordinance on January 11, 2022. Staff recommended the Board approve the second reading of the ordinance to establish stormwater grading requirements for infill of single-family and duplex development. REGULAR AGENDA A. COUNTY ATTORNEY 1.Opioid Litigation - Proposed Settlements with Endo Health Solutions, Inc. and Endo Pharmaceuticals, Inc., ("Endo")(collectively, "Settling Defendants") Daniel McIntyre, County Attorney, presented this item to the Board. St. Lucie County has filed suit against various companies, including the Distributors and Settling Defendants referenced above in what has been referred to as the "National Prescription Opiate Litigation." On January 22, 2022, the County Attorney received an email from the firm representing the County in Litigation. As indicated in the email, there is a "Participation Agreement" that the firm recommends the Board's approval on or before February 9, 2022. Settlement funds will flow into the state and be allocated between the state and its local governments. The County previously passed a resolution that approved a Memorandum of Understanding (MOU) to fairly apportion settlement funds between the state and its local governments. It was contemplated the Memorandum of Understanding (MOU) would be reduced to a formal, consistent agreement. By executing the Participation Agreement, the County accepts the terms of the Agreement. Florida has reached a proposed state-wide settlement with Endo, a manufacturer of opioid drugs. This settlement provides a total payment of $65 million from Endo, $55 million of which will be used for opioid abatement, with the remainder for legal fees. These funds will be allocated between the state and local governments as outlined in the previously executed Memorandum of Understanding (MOU) with the State of Florida. PLANNING & DEVELOPMENT SERVICES Request Permission to Advertise a Comprehensive Plan Amendment to Expand the Urban Services Boundary and Update Associated Goals, Policies, and Objectives Essential to Plan for the Expansion Benjamin Balcer, Assistant Director, and Kori Benton, Planning Manager, Planning & Development Services Assistant, presented this item to the Board. St. Lucie County maintains an Urban Service Area Boundary (USB) to ensure new developments are designed and planned in a manner that does not place an economic burden upon the services and facilities within the County. While limiting the negative impacts of a sprawling low -density development pattern and the fiscal burden that development pattern has on the community's ability to meet its service needs. The Board has discussed, at Informal Agenda Meetings, the necessary updates to the USB to account for experienced, pending, and anticipated growth in St. Lucie County. The planning staff is preparing a Comprehensive Plan Amendment (CPA) to expand the Urban Services Boundary and update associated Goals, Policies, and Objectives To provide a planning strategy for said growth and associated public facility demands. Two key components for the expansion: Phase I: South County expansion effective immediately to account for Port St. Lucie's Western Annexation Area & Oak Ridge Ranch Phase II: Establish the expanded boundary, deferring the effective date while initiating a Planning Study for middle and north County In February or March, the CPA will be presented to the Planning and Zoning Commission, acting as the Local Planning Agency (LPA), before the Board's hearing. Staff has coordinated with the Treasure Coast Regional Planning Council (TCRPC) Executive Director to initiate a Planning Study related to the proposed expansion. At the same time, exploring any policy guidelines to preserve and protect the rural character of well -established areas within the USB expansion area. Staff recommended permission to advertise the proposed ordinance for the first of three public hearings, with the first hearing before the Planning and Zoning Commission projected on February 17, 2022, or March 17, 2022, at 6:00 PM, or soon thereafter as may be heard. Every ten (10) years in the year after the United States Decennial Census, counties in Florida are required by the Florida Constitution and Florida Stabiles to examine the remits of the Census and rebalance commission districts by population. The population of St Lucie County has increased by more than 50,000 people since the 2010 Census, The Comfy's population from the 2020 Census is now 329,226, up tram 277,789 To 2010.A majority of the growth occurred in the City of Port St Lucie, which increased 22.9%to 201,851 residents compared to 164,203 in 2010. 0-11, the Coumy's population increased by 18.5% The '.. population changes in each district highlight the need to rebalance the fare districts' population. Staff has prepared three draft redistricting map scenarios for the Board to select from and adopt as the new Commission district map, Staff originally prepared five 15) scenarios and presented them to the Board at the Informal Meeting m Mato, 12, 2021. In that meeting, the Board had a consensus on reducing the number of scenarios to the three (3) attached to the agenda item. Staff also staged an open house for the public to see each sceneria in the Commission Chamber on November 4, 2021. The scenarios have been posted on the County s websim since mid-Oclabec To date, public comment has been somewhat limited and what has been received is part of the backup agenda. Consistent with the 2011 redistricting process, public comment has prlmaHty included North and South Hutchinson Island in the same commission district Also, consistent with the 2011 redistricting process, the St Lucie County School District has indicated a desire to have their districts mimic the Board of County Commissioners Districts. To that end, each scenario maintains the school board members in their current districts. Adoption of the new commission districts does not require a public hearing. However. consistent with policy, staff has placed the item on the agenda as a public hearing. State statute provides some additional rudimentary steps to which the County must adhere in the adaptlon process. In adopting new districts, the Board must also: • Enter en accurate description of the new boundaries as changed into the Board meeting minutes. The County Surveyor has created descriptions of the new districts, • Publish a certified copyof the proposed newdistricts at leastmce each week for two consecutive we. in A loot newspaper. • Include proof of such public in the Board meeting minutes.
