there was a hold on the property until he gave the County 5ft right of way donation. He came in yesterday with the
Warranty Deed to the County for the right of way. [wanted to let him know or you can tell him the CO is ready to put

SUBJECT: David Mann Construction Site Development Assistance (SDA-8201925576)
This memo is in regards to the David Mann Construction Site Development Assistance (SDA) application. The
project site is located at 904 South Market Avenue. The current property owner, David Mann Construction Inc.,
proposed a new 3,000 ft'- office/warehouse with 800 ft2 canopy, support parking, stonmvater facilities, security
fencing, and landscaping on the 0.64-acre site. This development will connect to Fort Pierce Utility Authority
(FPUA) water & wastewater facilities, including an annexation agreement with the City of Fort Pierce (COFP).
The South Market Avenue right-of-way (ROW) is a substandard width along this segment, therefore the County is
requesting a 5ft. ROW dedication from the owner. The proposed development will. meet the minimum required
25ft. front yard setback Land Development Code (LDC) Section 7.04.01 for the IL (Industrial, Light) zoning
district) and the minimum required 15ft. landscape buffer between the vehicular use areas and ROW, until
dedication of ROW.
Due to the County's minimum required 25ft. front yard setback, for the IL zoning district, and the minimum required
15ft. landscape buffer, the 5ft. ROW dedication will create a non -conforming structure, as per LDC Section
10.00.03.
The imminent annexation into the City of Fort Pierce, however, would result in assignment of a City I-1 (Light
Industrial) zoning designation. The City's minimum front yard (setback) for this site will become 15ft., whereas a
minimum required 1Oft. landscape strip for the project site. The anticipated annexation and application of the City's
LDC would resolve the setback implication created by the ROW dedication.
The property owner has supplied a letter affirming willingness to dedicate the 5ft. of ROW prior to the issuance of
a certificate of occupancy, with a full understanding of the non -conforming circumstances due to ROW dedication.
Review was coordinated by the St. Lucie County Development Review Committee (DRC) on this premise.
Res:dting Action
Staff authorized Zoning Compliance for the development permit based upon compliance with Comity LDC prior to
ROW dedication, conformity with City LDC as confirmed by the City of Fort Pierce Planning Department, and the
unique circumstances related to redevelopment and forthcoming annexation. The applicant will proceed with ROW
dedication before issuance of a Certificate of Occupancy. The City of Fort Pierce is presumed to proceed with
annexation action thereafter, in accordance with typical procedures.

I'm writing to identify a pending development review application within St. Lucie County, which Is contiguous to the City of Fort
Pierce limits while seeking verification of compliance with the City of Fort Pierce's setback requirements for development within the
1-1, Light Industrial District (the presumed district assignment at the time of annexation).
The current property owner, David Mann Construction Inc., is proposed development of a new 3,000 sq. ft. construction
office/warehouse, 800 sq. ft. canopy, support parking and stormwater facilities, security fencing, and required landscaping on the
subject 0.64 acre site. The property previously held a small structure and was used for business storage. The owner would like to
redevelop the site to increase their business footprint in St. Lucie County. The project includes connection to FPUA water &
wastewater facilities, inclusive of an annexation agreement. Due to the substandard right-of-way width for South Market Avenue
(60ft., where 70 ft. is required), the County Is requesting dedication of Sft. from the owner concurrent with the development.
The prospective right-of-way donation, upon completion, the proposed structure would fail to meet the required 25ft. front yard
(Ftback) as required by St. Lucie County Land Development Code (LDC) Section 7.04.01 for the IL, Industrial Light Zone, as well as a
deficiency in the required landscape buffer between vehicular use areas and ROW, of 15ft. In review of the City of Fort Pierce LDC,
based upon future annexation of the site and assignment of an 1-1, Light Industrial zoning designation (equivalent to SLC's IL), it
appears the noted deficiencies may be rectified, as the City's minimum yard for the 1-1 district is 15ft. from the ROW or non-
industrial property, and a 30ft. landscape strip for the project site. I've attached a site aerial & zoning snapshot, site plan exhibit with
notes, and County & City LDC excerpts for reference.
At the convenience of your team, we're requesting review and affirmation that the presented site improvement plan would meet
required dimensional standards of the 1-1 district.
It's acknowledged that the City's parking stall depth requirement is 19ft., however a 1 ft. overhang is allowed, and a typical two-way
driveway is 24ft., where not abutting parking stalls. The County's minimum standards are 18ft. in depth, and 20 ft. in width,
respectively. Additionally, the City mandates stormwater areas are situated oat the rear of the property away from public right-of-
ways, or in no instance closer than 15ft. from the front property line. We are willing to encourage the applicable to adjust the
conveyance areas to accommodate such requirement.

Revise the site and landscape plan to indicate the 15 ft. landscape buffer along the front begins at the future
property line. It is currently measured from the existing property line.
Revise the size of the hedge material along the western and northern property lines to be Oft. at the time of
planting (Land Development Code 7.09.04.13).
Revise the plant material schedule to indicate the trees will measure 2 Y2" DBH instead of caliper inches.
Revise the plant material schedule to indicate four (4) crepe myrtles instead of six (6). There is only four shown
on the plan.

2. Section 7.06.02(B) Design Standards. All required off-street parking spaces, access aisles,
and vehicular use areas shall be constructed with an all-weather surface meeting the
requirements of the St. Lucie County Public Works Department. The permitted impervious
surface materials are concrete, asphalt, brick pavers, stamped concrete, or paving block.
3. Surveys are required for all building permits having a construction value exceeding $10,000.

marked. All off-street parking and vehicular use areas shall be incompliance with Section
7.06.00 OH -street Parking.
4. All handicapped parking spaces shall be appropriately outlined with Blue Painted lines,
minimum four (4) inches wide, and shall be posted with the international symbol of
accessibility. Handicapped accessible spaces shall meet the minimum design, signing and
marking standards of the Florida Department of Transportation as depicted below. Spaces
shall be accessible to a curb -ramp or curb -cut, to allow access to the building served and shall
be located so that users would not be compelled to wheel behind parked vehicles.

8. An As -Built survey is required along the EOR's certification upon request for a final inspection of the
site and access improvements. A published benchmark utilized for site elevations shall be referenced

I would like your opinion about the determination of Impact Fees for above project.
They are building a warehouse with office for a building contractor. The total sf of building is 3843 divided in:
Office 805 sf. (General Office)
Warehouse 2187 sf (Warehouse)
Covered work area under attached canopy 821 sf (General Industrial)
Mezzanine 965 sf. (Warehouse)

I have discussed with the plans examiner if the mezzanine is going to be used for mechanical equipment only. He
informed that the way it is presented on the plans, based on the building code, this is considered storage/warehouse
area.
Based on the above I have three different calculations for Impact Fees. What are your thoughts about this?

Good morning Lydia,
The office is over 15% of the finished area, therefore it seems appropriate to have a separate figure. If the coverage area
(canopy) is for a work area, as opposed to an area to park a vehicle, I think the break down and use assignments are
appropriate.
Are there impact fee credits/off-sets eligible from the prior structure on the site? If the property owner hasn't included
the specific request for offsets, shall we touch base with him to provide documentation and the written request?

Hi Lydia,
On card one is a 1,000 square foot industrial type building with a year built of 1972.
On card two is a 2400 square foot barn type building with a year built of 1972.
In our system it was on 2 separate cards and buildings. I am not able to see if they were physically attached or not but
we had them as two separate buildings.
The buildings were removed from our system for the 2009 tax roll.

Good afternoon Juanita,
We are working with David Mann, owner of above property, to try and get his building permit complete for his new
building. The property originally had a building that was demolished somewhere after the hurricanes in 2004. We don't
have a demolition permit on file. To be able to apply Impact fee credit towards the new building I need to know the
original square foot of the building and the year the buildings were demolished. You were so kind to print out attached
property cards. However, it is still not clear what the size of the.building was. I have some questions that I hope you can
answer, or at least can forward the question to a co-worker or supervisor that is able to provide the following
information:
- A copy of the sketch of the building and area legend that typically is included with a property card.
- When was the building taken off the property records? The year is important to determine if impact fee credits
are available.
Was there one or two buildings? The attached card indicates a base area of 1,000 sf and barn of 2,400 sf but it is
not clear if they were attached to each other.
I would greatly appreciate the help so we can finalize the review for Mr. Mann's new building.
